This letter comes as a request for an Initial Planning Zoning Review. We are requesting
that you review the conditions that exist on the property in respect to what is the rear yard
and that you consider our request for a variance to the rear yard setback from 15 feet to
10 feet for the following reasons.
When the property was developed by New Urban West about 3 years ago the two end lots
on the cul-de-sac of Rockinghorse Lane (18975 and 18976) required variances because
of the City's interpretation of rear and side yards. The adjacent property (18976) was
allowed a rear yard (south property line) of 10'-0" and actual conditions show 9'-1 ". In
2001 a garage addition was approved aligning with that setback.
My clients property (18975) was granted a variance for a 15'-0" rear yard and the actual
conditions show to be 12'-0". We are requesting that we be allowed to build to 10'-0"
from that property line which we feel should be looked at as a sideyard.
The Homeowners Association has approved the plans and they also have restrictions that
agree with our view of the required yards. They are requesting a 25'-0" rear yard along
the west property line and a 10'-0" sideyard along the south property line
