PROJECT PLANNER: Rami Talleh, Associate Planner Dear Applicant: The Planning Department/Director of Planning of the City of Huntington Beach acted upon your application on June 13, 2006, and your request was Conditionall A roved. Included in this letter are the Conditions of Approval for this application. Under the provisions of the McDonnell Centre Business Park Specific Plan, the action taken by the Planning Department/Director of Planning is final unless the applicant (you) files an appeal to the Zoning Administrator. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant deems himself aggrieved. Said appeal must be accompanied by a filing fee of $494. The appeal shall be submitted to the Department of Planning within ten (10) calendar days of the date of the Planning Department/Director of Planning's action. The last day for filing an appeal and paying the filing fee for the above noted application is June 23, 2006. 536-5271 374-1540 Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any application becomes null and void one (1) year after the final approval, unless actual construction has begun. If you fail to file a written protest regarding any of the fees contained in this Notice, you will be legally barred from later challenging such action pursuant to Government Code §66020. Please be advised that the Planning Department/Director of Planning reviews the conceptual plan as a basic request for entitlement of the use applied for in relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan reflecting conformance to all Code requirements. The Planning Department will perform a comprehensive plan check relating to all Code requirements upon submittal of your completed structural drawings. It is recommended that you immediately pursue completion of the Conditions of Approval and address all requirements of the Huntington Beach Municipal Code, Zoning & Subdivision Ordinance and McDonnell Centre Business Park Specific Plan, in order to expedite the processing of your total application. G:\PLANNING\Site Plan Review\NOA\2006\SPR 06-01 (Chlorination Upgrade).doc • ATTACHMENT NO. 1 FINDINGS AND CONDITIONS OF APPROVAL SITE PLAN REVIEW NO. 06-01 FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Director of Planning finds that the project is covered by Mitigated Negative Declaration No. 01-07, will comply with all applicable mitigation measures, and will not have a significant effect on the environment. FINDINGS FOR APPROVAL - SITE PLAN REVIEW NO. 06-01: 1. Site Plan Review No. 06-01 for the installation of a chlorination facility consisting of two one- ton chlorine feed and storage units covered by a 15 ft. by 25 ft. canopy as an ancillary use to City Well No. 13, is consistent with the site's General Plan Land Use Element designation of I-F2A-d-sp (Industrial - 0.75 maximum floor area ratio - design overlay - specific plan) on the subject property and all applicable requirements of the Municipal Code. In addition, it is consistent with the following goals and policies of the General Plan: Goal U 1: Provide a water supply system, which is able to meet the projected water, demands; upgrade deficient systems and expand water treatment, supply, and distribution facilities. Objective U 1.1.6: Provide for the construction of necessary pump and storage facilities to ensure adequate water supply, and proper water system balance. The proposed chlorination facility will provide increased storage capacity to meet the chlorine demands necessary to treat water pumped by Well No. 13. The additional storage capacity will allow the system to operate longer and will provide flexibility to the existing well operations for possible maintenance issues. 2. Site Plan Review No. 06-01 will be compatible with surrounding uses and will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The proposed chlorination facility is an ancillary use to Well No. 13 and the Springdale Reservoir. The facility will be located at the rear of the site and will be screened from view from the surrounding properties. Other properties are developed with similar ancillary outdoor facilities with similar screening methods. 3. The proposed project will not adversely affect the Circulation Plan. Vehicular access to the project site is already provided in a manner, which is consistent with the requirements of the Circulation Plan. Existing vehicular access from Springdale Street will not be obstructed by the proposed facility. The facility is proposed to be located to the rear of the site adjacent to and not obstructing an existing drive aisle. 4. The proposed project will comply with the provisions of the McDonnell Centre Business Park Specific Plan and other applicable regulations or special conditions required for the project, including applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance, except for a Request for Deviation approved concurrently to allow 61.2 percent lot coverage in lieu of the maximum allowed 60 percent lot coverage. 6/13/06SPR No. 06-01 Page 1 of 3 FINDINGS FOR APPROVAL - REQUEST FOR DEVIATION: The Request for Deviation to allow 61.2 percent lot coverage in lieu of the maximum allowed 60 percent lot coverage: 1. Promotes better design, environmental and land planning techniques and contributes to the economic viability of the community, through aesthetically pleasing architecture, landscaping and site layout. The proposed chlorination facility is an ancillary use to Well No. 13 and the Springdale Reservoir. The existing structures on the site are designed with aesthetically pleasing architecture, which includes pilasters with a decorative cap, a decorative cornice, and scoring details on the building wall. Landscaping is provided along the front property line to adequately screen the facility from the Springdale Street. The proposed chlorination facility is located towards the rear of the site and will not be visible from the public right-of-ways. The facility will also be screened from view from the adjacent industrial properties. The granting of the Request for Deviation serves to allow construction of upgrades to the water supply system serving existing and future demands in a cost efficient manner by facilitating the most cost efficient site design and structure configuration. 2. Will not be detrimental to the general health, welfare, safety and convenience of the neighborhood or City in general, nor detrimental or injurious to the value of property or improvements of the neighborhood or of the City in general. The proposed project will not result in an increase of noise, traffic, or any other impact beyond levels anticipated for the zone in which it is located. 3. Will be consistent with objectives of the Specific Plan in achieving a project adapted to the area and compatible with the surrounding environment. The facility will be located at the rear of the site and will be screened from view from the surrounding properties. Other properties are developed with similar ancillary outdoor facilities with similar screening methods. 4. Will be in compliance with State and Federal Law and consistent with the site's General Plan Land Use Element designation of 1-F2A-d-sp (Industrial - 0.75 maximum floor area ratio - design overlay - specific plan) on the subject property and all applicable requirements of the Municipal Code. The site plan, floor plans and elevations received and dated April 13, 2006, shall be the conceptually approved layout with the exception of the following modification: a. The facility shall be screened with a combination of masonry block and chain link with slats on the north, south, and west sides of the canopy structure. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Two Hundred Fifty-Five Dollars ($255.00) if the appeal is filed by a single-family dwelling property owner appealing the decision on his own property and Eight Hundred Sixty-Five Dollars ($865.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Zoning Administrator's action.
