Attached to this letter are the findings and conditions of approval for your application. Please be advised that the Department of Planning reviews the conceptual plan as a basic re- quest for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Sub- division Ordinance in order to expedite the processing/completion of your project. The concep- tual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Administrative Permit No. 0.08 May 29, 2007 Page 2 of 4 Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commis- sion by you or by an interested party. A person desiring to appeal the decision shall file a writ- ten notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. I FINDINGS FOR APPROVAL - ADMINISTRATIVE PERMIT NO. 07-008: 1. The proposed rear year setback of 9'-0" does not exceed a 10% deviation from the minimum rear yard setback of 10'-0" applicable in the RL (Residential Low Density) base zoning dis- trict, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordi- nance. 2. The proposed residential addition enhances the overall project design by incorporating a variation to building form with enhanced roof articulation that breaks up the overall building mass and creates visual interest to the residence without having to cutoff a portion of the rear elevation. The above-mentioned details will enhance the project with no detrimental impacts to surrounding properties by complying with required front and side yard setbacks, height limits, and maximum lot coverage. 3. Due to the irregular lot configuration and location of the existing dwelling on the subject site, in addition to the existing dwelling's architectural style (i.e., roof configuration), the number of options to provide additional floor area is primarily limited to the rear portion of the home. A small corner of the first floor kitchen and second floor master bedroom addition contribute to the dwelling's 1'-0" rear yard encroachment, but are not anticipated to create detrimental im- pacts to surrounding properties by complying with required front and side yard setbacks, height limits, and maximum lot coverage. 4. The proposed dwelling would not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the proposed 9'-0" rear yard setback, the proposed addition conforms to all applicable de- velopment standards, including maximum height, minimum front and side yard setbacks, and maximum lot coverage. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 07-008 1. The site plan, floor plans, and elevations received and dated May 22, 2007, shall be the con- ceptually approved layout. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The applicant and/or applicant's representative shall be responsible for ensuring the accu- racy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 07-008 shall not become effective until the ten-calendar day ap- peal period has elapsed. Administrative Permit No. 07-008 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Direc- tor pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 4. The Planning Department reserves the right to revoke Administrative Permit No. 07-008, pursuant to a public hearing for revocation, if any violation of these conditions or the Hunt- ington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
