REQUEST: To permit a waiver of development standards pursuant to Section 241.22 in
conjunction with the facade improvement of an existing single family home.
The waiver of development standards is to allow a lot coverage of 51.85%
in lieu of the maximum allowed lot coverage of 50% to expand the building
footprint by 125 sq. ft. to reorient the main entrance and construct a turret
on the rear elevation.

Dear Mr. Mirhosseini:
The Planning Department of the City of Huntington Beach reviewed and approved your request for a
Waiver of Development Standards on September 7, 2004. Attached to this letter are the findings and rec-
ommended conditions of approval for your application. You must submit this notice of action letter to the
Planning and Building & Safety Departments upon request for a Building Permit.
Please be advised that the Department of Planning reviews the conceptual plan as a basic request for enti-
tlement of the use applied for and there may be additional requirements prior to issuance of building per-
mits. It is recommended that you immediately pursue completion of the conditions of approval and ad-
dress all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the
processing/completion of your project. The conceptual plan should not be construed as a precise plan, re-
flecting conformance to all Zoning and Subdivision Ordinance requirements.

Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the
Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in-
terested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secre-
tary of the Planning Commission within ten calendar days of the date of the Planning Department's action.
The notice of appeal shall include the name and address of the appellant, the decision being appealed,
and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. The appeal fee is
$485 for a single-family dwelling property owner appealing the decision on his/her own property. The
appeal fee is $1,540 for all other appeals. Said appeal must be in writing and must set forth in detail the
action and grounds by which the applicant or interested party deems himself aggrieved.
The last day for filing an appeal and paying the filing fee for the above noted application is September 17,
2004.

FINDINGS AND CONDITIONS OF APPROVAL
ADMINISTRATIVE APPROVAL NO. 04-11
FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Department of Planning finds that the project will not have any significant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Sec-
tion 15301 of the CEQA Guidelines because the project consists of a minor alteration to an existing single
family dwelling.
FINDINGS FOR APPROVAL:
1. The proposed lot coverage of 51.85% resulting from the expansion of the building footprint does not
exceed a ten percent (10%) deviation from the maximum allowed lot coverage of 50% applicable in
the RL-CZ (Residential Low Density - Coastal Zone) base-zoning district, pursuant to Section 210.06
of the Huntington Beach Zoning and Subdivision Ordinance.
2. The proposed expansion of the building footprint by 1.85% will allow for a 70 sq. ft. first floor addi-
tion to reorient the main entrance and a 52 sq. ft. first and second story addition to construct a turret
like feature on the rear elevation. Currently the entry is located at the eastern side of the dwelling and
recessed into the structure. The proposed first floor addition will reorient the entry so that it is visible
from the front of the property and provide an attractive entrance. The rear elevation of the structure is
long and unarticulated. The proposed first and second story addition on the rear elevation will en-
hance the appearance of the structure by providing a tower shaped projection to break up the mass and
bulk. The additions will provide an overall improvement to the site, which could not be accommo-
dated without the expanded building footprint.
3. The proposed building footprint expansion would not otherwise require any discretionary permits, and
will not in any way degrade the environment or result in any changes to land use. With the exception
of the proposed 51.85% lot coverage, the proposed addition conforms to all applicable development
standards, including maximum height, and minimum front and side yard setbacks.
CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 04-11:
1. The site plan and floor plans received and dated September 1, 2004, shall be the conceptually ap-
proved layout.
2. Administrative Permit No. 04-11 conditions of approval and code requirements identified herein, shall
be printed verbatim on one of the first three pages of all the working drawing sets used for issuance of

building permits (architectural, structural, electrical, mechanical and plumbing) and shall be refer-
enced in the sheet index. The minimum font size utilized for printed text shall be 12 point.
3. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all
plans and information submitted to the City for review and approval.
INFORMATION ON SPECIFIC CODE RE UIREMENTS:
1. Administrative Permit No. 04-11 shall not become effective until the ten-calendar day appeal period
has elapsed.
2. The project shall comply with all applicable requirements of the Municipal Code, Building & Safety
Department and Fire Department, as well as applicable local, State and Federal Fire Codes, Ordi-
nances, and standards, except as noted herein.
3. Any modifications or reconstruction of the existing cantilevered deck, deck rails, dock, and/or ramp
improvements located in the public waterway shall require separate permits.
INDEMNIFICATION AND HOLD HARMLESS CONDITION:
The owner of the property which is the subject of this project and the project applicant if different from
the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold
harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or
proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or
employees, to attack, set aside, void or annul any approval of the City, including but not limited to any
approval granted by the City Council, Planning Commission, or Design Review Board concerning this
project. The City shall promptly notify the applicant of any claim, action or proceeding and should coop-
erate fully in the defense thereof.
