JILL ARABE, ASSISTANT PLANNER (714) 374-5357 / JARABE@SURFCITY-HB.ORG TO PERMIT THE HOME OCCUPATION OF INDIVIDUALIZED TUTORING FOR ELEMENTARY AND MIDDLE SCHOOL AGED CHILDREN AT AN EXISTING RESIDENCE. The following is a list of code requirements deemed applicable to the proposed project based on plans stated above. The list is intended to assist the applicant by identifying requirements which must be satisfied during the various stages of project permitting and implementation. A list of conditions of approval adopted by the Planning Department in conjunction with the requested entitlement(s), if any, will also be provided upon final project approval. Pursuant to Section 230.12 Home Occupation in R Districts of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO), the use shall comply with the following: a. A home occupation shall be conducted entirely within one room in a dwelling. No outdoor storage shall be permitted. Garages shall not be used in connection with such business except to park business vehicles. b. No one other than a resident of the dwelling shall be employed on-site or report to work at the site in the conduct of a home occupation. This prohibition also applies to independent contractors. c. There shall be no display of merchandise, projects, operations, signs or name plates of any kind visible from outside the dwelling. The appearance of the dwelling shall not be altered, or shall the business be conducted in a manner to indicate that the dwelling or its premises is used for a non-residential purpose, whether by colors, materials, construction, lighting, windows, signs, sounds or any other means whatsoever. No commercial vehicle or equipment used in conjunction with the home occupation shall be parked overnight on an adjacent street or in any yard visible from the street. e. No motor vehicle repair for commercial purposes shall be permitted. f. A home occupation shall not include an office or salesroom open to visitors, and there shall be no advertising of the address of the home occupation. g. Neighborhood Notification shall be in compliance with Chapter 241 when a home occupation involves instruction and/or service, e.g. music lessons, beauty shop, swimming lessons. Where a home occupation involves swimming instruction in an outdoor swimming pool, each swimming class shall be limited to 4 students, and no more than 2 vehicles shall be used to transport students to such classes. h. Any authorized City employee may inspect the premises of a home occupation upon 48 hours notice to ascertain compliance with these conditions and any requirements of this code. The permit for a home occupation that is not operated in compliance with these provisions shall be revoked by the Director after 30 days written notice unless the home occupation is altered to comply. 2. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 3. Administrative Permit No. 2009-005 shall not become effective until the ten calendar day appeal period following the approval of the entitlements has elapsed. 4. Administrative Permit No. 2009-005 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 5. The Planning Department reserves the right to revoke Administrative Permit No. 2009-005 pursuant to a public hearing for revocation, if any violation of the conditions of approval, Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 6. The project shall comply with all applicable requirements of the Municipal Code, Building & Safety Department and Fire Department, as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
