Included in this letter are the Conditions of Approval for this application. You must submit this notice of action letter to the Building Department upon requests for Certificate of Occupancy or Building Permit. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department becomes final at the expiration of the ten-day appeal period. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. Principal Planner Limited Notification No. 03-13 October 22, 2003 Page 2 of 2 ATTACHMENT NO. 1 CONDITIONS OF APPROVAL - LIMITED NOTIFICATION NO. 03-13 1. The floor plan received and dated October 8, 2003, shall be the conceptually approved layout. 2. The use shall comply with the following: a. The instruction area shall be limited to a maximum of 75% of the total occupied floor area (1,800 sq.-ft.). b. The number of clients shall be limited to one per 200 sq.-ft. of occupied floor area (Max. 12 clients). 3. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan or floor plan are proposed. 4. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE RE UIREMENTS: 1. Limited Notification No. 03-13 shall not become effective until the ten-calendar day appeal period has elapsed. 2. Limited Notification No. 03-13 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Planning Department reserves the right to revoke Limited Notification No. 03-13, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. A Certificate of Occupancy must be approved by the Planning Department and issued by the Building and Safety Department prior to occupying the building. 5. All permanent, temporary, or promotional signs shall conform to Chapter 233 of the HBZSO. Prior to installing any new signs, changing sign faces, or installing promotional signs, applicable permit(s) shall be obtained from the Planning Department. Violations of this ordinance requirement may result in permit revocation, recovery of code enforcement costs, and removal of installed signs. 6. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
