9.0 ISSUES AND ANALYSIS:
The applicant is requesting the two (2) year extension of time in
order to allow the Chrysler Corporation to exchange the sign faces
of the previously manufactured American Motors Jeep Eagle brand
autos. The change of copy is necessary to permit the nationwide
Chrysler Jeep Eagle advertising program.
Section 9610.8(c) specifies that the Planning Commission may grant a
two (2) year extension of time for non-conforming signs. A cash
bond ($5,000 for freestanding signs, plus $2,500 for each business
identification and directional sign) is required to guarantee the
removal of the non-conforming signs after the expiration of the
extension of time. The applicant will be required to submit a
planned sign program for the auto dealership to provide conforming
signs for the site.
The following is a zoning conformance matrix which compares the
existing signs with the current sign code requirements of Article
961 (Signs).

Note: All freestanding, business identification and

placement requirements shall conform to the placement
requirements of Article 961 (Signs) through the
submittal and approval of a planned sign program.
The existings non-conforming signs provide the current American
Motors Jeep Eagle auto dealership at 16751 Beach Boulevard with
identification. As a result of the elimination of the American
Motors Corporation , a nationwide Chrysler Jeep Eagle identification
program is necessary. The applicant is requesting a limited sign
permit to extend the service life of the existing non-conforming

signs for a temporary two (2 ) year period . The immediate removal
and compliance with the current sign ordinance would delay the
nationwide advertising program. The face changes include tenant
identification , colors and logos. The appl icant/owner has met the
intent of the limited sign permit by requesting a change of face
only and understands that the permit is for a maximum period of two
(2) years. After the two (2) year period the signs shall be made to
conform to the current code requirements for signs through a planned
sign program for the auto dealership.
10.0 RECOMMENDATION:
Staff recommends that the Planning Commission approve Limited Sign
Permit No . 90-3 with the following findings and suggested conditions
of approval:

1. Allowing the maintenance of the signs for an additional two (2)
years will not adversely affect other signs in the area. The
signs along the Beach Boulevard corridor are undergoing
compliance with the current sign ordinance and the two (2) year
extension will allow the applicant to design a sign program for
the auto dealership.
2. The proposed extension of time will not be detrimental. to
property located in the vicinity of such sign , and will be in
keeping with the character of the surrounding area. The
adjacent commercial and residential area will not be affected by
the non-conforming signs and are in keeping with the commercial
uses and signs along Beach Boulevard.
3. The signs in their existing locations will not obstruct
pedestrian or vehicular traffic vision.
4. Due to the unique circumstances applicable to the signs,
immediate alteration, removal or replacement of the signs will
result in a substantial economic hardship. The immediate
conformance to the sign ordinance for the change of sign copy
from American Motors to Chrysler will delay the national
advertising program.
CONDITIONS OF APPROVAL -- LIMITED SIGN PERMIT NO. 90-3:
1. The site plan and sign elevations received dated August 13,
1990, shall be the conceptually approved layout.
2. Limited Sign Permit No. 9C-3 shall be valid for two (2) years
until August 21, 1992.
3. The applicant /owners shall submit a planned sign program for the
auto dealership for review and approval by the Planning
Commission prior to the expiration of Limited Sign Program No.
90-3.
4. Prior to issuance of building permits, the applicant/owner shall
file a cash bond (cash, cashiers check, money order) in the
amount of $17,500 with the City for the purpose of indemnifying
the City for any and all costs incurred in the removal of the
signs. If the signs are not made to conform with the applicable
provisions of the sign ordinance after the two (2 ) years from
the date of approval, or remodel of the property , which ever
comes first , the City of Huntington Eeach or its agents or
employees may enter the property where said signs are located
and remove said sign s and the cost of removal shall be deducted
from the cash bond and summarily forfeited and paid over to the
City of Huntington Beach, and the remainder , if any , returned to
the person depositing the bond.
5. Limited Sign Permit No. 90-3 shall not become effective for any
purpose until an "Acceptance of Conditions " form has been
properly executed by thc applicant and an authorized
:e-presentative of the owner of the property, and returned to the
L-Manning Division; and until the ten (10) day appeal period has
elapsed.
11.0 ALTERNATIVE ACTION:
The Planning Commission may deny Limited Sign Permit No. 90-3 with
findings.

Area is Commercial Zoned both sides of Beach Boulevard.
Population served would include the apartment, condo
and single family dewelings which parallel Beach
Boulevard (beyond the Commercial Zoned property ) and
foot and auto traffic northbound and southbound.
DESCRIPTION OF PROJECT AND SERVICES
Project is a planned Sign Program incorporating stand-
ard Brand logo, graphics and colors within the National.
Brand Identification for dealerships.
Dealership offers New Cars and Used Cars sales, parts
and service, and auto body repairs.
DESCRIPTION OF SURROUNDING USES
Area is Commercial Zoned both sides of Beach Boulevard.
Business ranges from restaurants, strip centers with
all normal operations ( hot foods, florists, and retail
sales ).
Existing auto dealerships with sales and service oper-
ations are business commen-ring at Heil Avenue on the
north, and ending at Terry Drive, subject dealer--ship.
