Approve Limited Sign Permit No. 88-3 for a one-year period of time
with findings and conditions of approval.
2.0 GENERAL INFORMATION:
Limited Sign Permit No. 88-3 is a request to grant a 2-year
extension of use for an approximately 17 foot high, approximately
182 square foot, internally illuminated non-conform.ng freestanding
sign for the Shell Station located at 16990 Beach Boulevard. The
Planning Commission may grant such approval pursuant to
Section 9610.8(c) of the Huntington Beach Ordinance Code subject to
specific findings.

The proposed project is exempt pursuant to Section 15311, Class
11(a) from the provisions of the California Environmental Quality
Act.

9.0 ISSUES AND ANALYSIS:
The following is a matrix which illustrates sign standards for
commercial uses based on the City's Ordinance Code ,Section
9610.5(d):

The non-conforming pole sign is located at the southwest corner of
the property facing Warner Avenue and northbound Beach Boulevard
traffic. This sign was brought to the City's attention because the
owner did not apply for and receive a building permit to change to
existing facia (see letter from Code Enforcement, Attachment No.
5). The owner was notified by the Land Use Division to bring the
sign into conformance with the Sign Code. Subsequently, the
applicant filed this limited sign permit to extend the life of the
sign for two years in lieu of removing or modifying the sign at this
time.
As noted in the previous matrix, the applicant's pole sign is not in
conformance with Code. The sign is approximately 17 feet tall with
five sections advertising "credit cards accepted" at the bottom
section to the largest section at the top (4 feet x 21 feet), which
contains the word "Shell" and the Shell logo extending out of one
corner that is a round shape measuring over 5 feet in diameter.

The applicant contends that traffic counts and speed warrant the
existing sign visibility. The intersection of Beach Boulevard and
Warner Avenue is the second most congested intersection in the
City. The speed of the traffic, or lack thereof, would appear to be
an advantage for the applicant, giving motorists ample time to
consider stopping at his station for gasoline. The massi- sign at
the corner appears unnecessary in response to the condition of the
intersection.
Staff , however , while concerned and working towards signage
conformance in the City, is not interested in creating any undue
hardship for the applicant and therefore recommends approval of this
request for one year in order to give the applicant time to bring
the sign up to Code.
10.0 RECOMMENDATION:
Lcaff recommends that the Planning Commission approve Limited Sign
Permit No. 88-3 with the following findings and conditions of
approval.
FINDINGS FOR APPROVAL:
1. The sign will not adversely affect other lawfully erected signs
in the area.
2. The sign will not be detrimental to properties located in the
vicinity.
3. The sign will not obstruct vehicular or pedestrian traffic
visibility and will not be a hazardous distraction.
CONDITIONS OF APPROVAL:
1. The site plan and elevation received ?nd dated July 21, 1988,
shall be the approved sign permit.
2. Limited Sign Permit No. 88-3 shall be valid for up to one year
(until August 2, 1989).
3. Prior to issuance of building permits, the applicant shall file
a cash bond in. the amount of $1,000 with the City for the
purpose of indemnifying the City for any and all costs incurred
in the removal of the freestanding pole sign. If the sign is
not made to conform with the applicable provisions of the sign
ordinance after two years from the date of approval , the City
of Huntington Beach or its agents or employees may enter on the
property where said signs are located and remove said signs and
the cost of removal shall be deducted from the cash bond and
summarily forfeited and paid over to the City of Huntington
Beach, and the remainder, if any , returned to the person
depositing the bond.

11.0 ALTERNATIVE ACTION:
Deny Limited Sign Permit No. 88-3 with findings.
