SUBJECT: ADMINISTRATIVE PERMIT NO. 09-016 (LAM RESIDENCE)

REQUEST: To permit a waiver of development standards, pursuant to Section 241.22
of the Huntington Beach Zoning & Subdivision Ordinance, to allow 53.2%
lot coverage in lieu of the maximum allowed lot coverage of 50%, for a 48
sq. ft. 2d floor addition and 72 sq. ft. 2ndfloor balcony extension to existing
three-story, single-family residence.

Dear Applicant:
On October 19, 2009 the Planning Department of the City of Huntington Beach took action on your
application, and your application was conditional) a roved. Attached to this letter are the conditions
of approval for your application.
Please be advised that the Department of Planning reviews the conceptual plan as a basic request for
entitlement of the use applied for and there may be additional requirements prior to issuance of building
permits. It is recommended that you immediately pursue completion of the conditions of approval and
address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to
expedite the processing/completion of your project. The conceptual plan should not be construed as a
precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by
the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an
interested party. A person desiring to appeal the decision shall file a written notice of appeal to the
Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's
action. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of
appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the

applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the
filing fee for the above noted application is Friday, October 30, 2009 at 5:00 p.m.

FINDINGS AND CONDITIONS OF APPROVAL
ADMINISTRATIVE PERMIT NO. 2009-016
FINDINGS FOR APPROVAL - ADMINISTRATIVE PERMIT NO. 09-016:
1. The proposed lot coverage of 53.2% does not exceed a 10% deviation from the maximum allowed
lot coverage of 50% applicable in the RMH-A (Residential Medium High Density - Small Lot
Subdistrict) zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and
Subdivision Ordinance.
2. The waiver of development standards improves the project with a Spanish influenced architectural
design theme that incorporates design features that assist to break up the mass and bulk of the
existing residence. Window and upper floor recesses along the front and rear elevations provide
variation in the building's form. The recesses enhance the facade by creating areas of useable
private open space that aid to architecturally enhance and modulate the building. Approximately
3.5% of the total lot coverage is devoted to unenclosed areas as the 2ndfloor balcony and
cantilevered 2ndfloor which do not contribute to overall building mass. The open areas include
distinguishable architectural features as glass balcony railing and exposed corbels that create
additional shadow and relief for each elevation and contribute to the building's overall design theme.
The project ensures no detrimental impacts to surrounding properties by complying with required
yard setbacks, maximum height, and minimum off-street parking requirements.
3. The proposed project would not otherwise require any discretionary permits, and will not in any way
degrade the environment or result in any changes to land use or density. With the exception of the
proposed 53.2% lot coverage, the proposed addition conforms to all applicable development
standards, including maximum height, minimum yard setbacks, and required onsite parking.
CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 09-016
1. The site plan, floor plans, and elevations received and dated October 19, 2009, shall be the
conceptually approved layout with the following modifications:
a. Modify the development matrix (Sheet No. A-1) to be consistent with the floor area depicted
in the submitted floor plans (approximately 2,759 sq. ft). The cumulative floor area identified
in the matrix (2,911 sq. ft.), excluding the garage, exceeds the maximum 1.0 floor area
allowable for the subject site.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all
plans and information submitted to the City for review and approval.
2. Administrative Permit No. 09-016 shall not become effective until the ten-calendar day appeal period
has elapsed.
3. Administrative Permit No. 09-016 shall become null and void unless exercised within one year of the
date of final approval or such extension of time as may be granted by the Director pursuant to a

written request submitted to the Planning Department a minimum 30 days prior to the expiration
date.
4. The Planning Department reserves the right to revoke Administrative Permit No. 09-016, pursuant to
a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning
and Subdivision Ordinance or Municipal Code occurs.
5. The development shall comply with all applicable provisions of the Municipal Code, Building
Depa rtment, and Fire Depa rtment as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.
