SUBJECT: ADMINISTRATIVE PERMIT NO. 07-015 (LEDWITH RESIDENCE)

REQUEST: To permit a waiver of development standards, pursuant to Section
241.22 of the Huntington Beach Zoning & Subdivision Ordinance, to
allow 54.9 percent lot coverage in lieu of the maximum allowed lot
coverage of 50 percent, in conjunction with a 450 sq. ft. addition to
an existing single family dwelling.

On August 21, 2007 the Department of Planning of the City of Huntington Beach APPROVED
your request for a waiver of development standards. Attached to this letter are the findings and
conditions of approval for your application.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Department of Planning is final unless an appeal is filed to the Planning
Commission by you or by an interested party. A person desiring to appeal the decision shall
file a written notice of appeal to the Secretary of the Planning Commission within ten calendar
days of the date of the Department of Planning's action. The notice of appeal shall include the
name and address of the appellant, the decision being appealed, and the grounds for the
appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in
writing and must set forth in detail the action and grounds by which the applicant or interested
party deems himself aggrieved. The last day for filing an appeal and paying the filing fee for the
above noted application is Friday, August 31, 2007 at 5:00 p.m.

FINDINGS FOR APPROVAL - ADMINISTRATIVE PERMIT NO. 07-015:
1. The proposed lot coverage of 54.9% does not exceed a 10% deviation from the maximum
allowed lot coverage of 50% applicable in the RMH-A (Residential Medium-High Density -
Small Lot) zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and
Subdivision Ordinance.
2. The waiver of development standards improves the project design by allowing a 420 square
foot addition above an existing detached two-car garage while maintaining consistency with
the architectural character of the existing dwelling and surrounding neighborhood. The
addition provides a rooftop deck as usable open space , a bay window to minimize the mass
and bulk of the garage facade, and additional storage space in the garage and under the
stairway. Furthermore, the project includes a uniform building exterior with adjacent
neighbors along the alley, compatible roof design, pitch, and materials to match existing
conditions, and internal circulation between the proposed addition and existing dwelling.
3. The number of parking spaces located within the garage area complies with the intent of the
residential off-street parking requirement, pursuant to Section 231 .04 of the Huntington
Beach Zoning and Subdivision Ordinance. The addition contributes to the dwelling's lot
coverage, but will not create detrimental impacts to surrounding properties by complying with
required side and rear yard setbacks and maximum height limits.
4. The proposed addition would not otherwise require any discretiona ry permits, and will not in
any way degrade the environment or result in any changes to land use or density. With the
exception of the proposed 54.9% lot coverage, the proposed room addition, as modified by
conditions of approval, conforms to all applicable development standards, including
maximum height and floor area ratio, minimum yard setbacks and required on-site parking.
The existing dwelling will continue to be used for single-family residential purposes after
construction of the proposed room addition.
CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 07-015:
1. The site plan, floor plans, and elevations received and dated August 2, 2007, shall be the
conceptually approved layout with the following modifications:
a. The proposed bay window above the garage shall be at least 18" above the first story
plate line.
b. The length of the proposed bay window shall not exceed 1/3 of the building length on
which it is located.
c. The single-family dwelling shall be limited to a maximum of three bedrooms, including
the proposed room over the garage, which shall be considered a bedroom.

2. Prior to submi ttal for building permits conditions of approval shall be printed verbatim on one
of the first three pages of all the working drawing sets used for issuance of building permits
(architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the
sheet index. The minimum font size utilized for printed text shall be 12 point.
INDEMNIFICATION AND HOLD HARMLESS CONDITION:
The owner of the property which is the subject of this project and the project applicant if
different from the property owner, and each of their heirs, successors and assigns, shall defend,
indemnify and hold harmless the City of Huntington Beach and its agents, officers, and
employees from any claim, action or proceedings, liability cost, including attorney's fees and
costs against the City or its agents, officers or employees, to attack, set aside, void or annul any
approval of the City, including but not limited to any approval granted by the City Council,
Planning Commission, or Design Review Board concerning this project. The City shall promptly
notify the applicant of any claim, action or proceeding and should cooperate fully in the defense
thereof
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The applicant and/or applicant's representative shall be responsible for ensuring the
accuracy of all plans and information submitted to the City for review and approval.
2. Administrative Permit No. 07-015 shall not become effective until the ten-calendar day
appeal period has elapsed.
3. Administrative Permit No. 07-015 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the
Director pursuant to a written request submitted to the Planning Department a minimum 30
days prior to the expiration date.
4. The development shall comply with all applicable provisions of the Municipal Code, Building
Department, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.
