The reason the decision is biased is that if the city allows Mr. Abdelmutti of Jack's Surf Shop to set up business in a temporary structure, the income taken in from this temporary structure will be deducted from the down time of Jack's Surf Shop therefore allowing the City to repay Jack's Surf Shop less money in downtime. A biased decision that only benefits the City of Huntington Beach. The reason the decision is detrimental to Downtown Huntington Beach is that it will allow another bad structure to exist among the already bad structures owned by the City of Huntington Beach. This decision will also eliminate much needed parking in the area. The reason the decision is discriminatory is that the City of Huntington Beach is ignoring all the rights of the people who now live Downtown, work Downtown and come Downtown to the beach solely for the benefit and profit of one individual, Mike Abdelmutti of Jack's Surf Shop. I feel the action taken by the Board has shown a flagrant disregard for the rights of all ottiers and an act of discrimination of the worst kind. ITEM 2: A TAL DEVL- PMENT PERMIT N 1-10 PERMIT NO. 1-10 Applicant: City of Huntington Beach 2000 Main Street Huntington Beach, CA 92648 Request: To permit a temporary trailer pursuant to Section 9730.30 of the Huntington Beach Ordinance Code. Location: 420 Pacific Coast Highway - Northeast corner of Pacific Coast Highway and Fifth Street. Mike Connor, Staff Planner reported that the request is to relocate a trailer which is currently located at Main and Orange to the new location at Pacific Coast Highway and Fifth Street. Staff advised that the setback requirements could be met with the trailer on site and that the required parking would be met on site and across the alley upon demolition of the Terry Buick buildings. If the buildings are not demolished prior to placing trailers on site, the parking can be provided on Fifth Street at a new parking lot which is located at the southwest corner of Fifth Street and Walnut Avenue, Staff also advised that seven letters were received from property owners and tenants in opposition to the request. The letters were signed by: Elden Bagstad, Don Nelson, Brian Graham, Wayne Remest, Joy Lynn, Charlotte Gregory, Michael's Surf and Sport and a resident (signature illegible). Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Keith Bohr, City Redevelopment Staff, was present to respond to Zoning Administrator questions. There were no persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 91-10 AND USE PERMIT NO. 91-10 WERE APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH FINDINGS AND ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. The request to permit the placement of a temporary retail sales trailer conforms with the plans , policies, requirements and standards of The Coastal Element of the General Plan, The proposed trailer will not affect public views of the coast because of required setbacks from Fifth Street and Pacific Coast Highway. In addition , the proposed trailer will not impact coastal access. 2. Coastal Development Permit No. 91-10 is consistent with the CZ suffix zoning requirements, the Rl Zoning District:, as we::' as other provisions of the Huntington Beach Ordinance Code applicable to the property. At the time o, occupancy, the proposed t her will be provided with infrastructure in a mariner that is consistent with the Coastal Element of the General Plan. All necessary infrastructure is currently in place 4. The proposed trailer conforms with the p'iblic access and public recreation policies of Chapter 3 of the California Coastal Act. The trailer will not impact public access or water oriented recreation. FINDIN F R APPR VAL SE PERMIT N 1-10: 1. The establishment, maintenance and operation of the temporary trailer for relocation of downtown merchants will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; Because other vacant lots in the immediate vicinity will be pPved to replace parking lost as a result of placing a tra=.ier at this location. b. Property and improvements in the vicinity of such use or building. The proposed trailer is temporary. 2, The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The proposed trailer is in compliance with the General Plan Land Use Designation of mixed use because it will help to promote the v4_sitor serving cor,voercial businesses in the downtown area. PE IAL NDITI N F APPR VAL: 1. The site plan, floor plans, and elevations received and dated March 4, 1991 shall be the conceptually approved layout with the following modifications: a. The structure shall be placed a minimum of fifteen (15) feet from the front and exterior side yard property lines. b. Four (4) parking spaces for the trailer shall be provided on the north side of the alley which are in addition to the four (4) spaces provided on the subject property. c. Landscaping shall be provided in compliance with recommendations from the Design Review Board. UTA 2. The ,Zoning Administrator shall be notified in writing if any cb4iges in 'building height, floor area , setbacks , building elevations or open space are proposed as a result of the plan check process . Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. Proposed structures shall be architecturally compatible with ' existing structures. 5. The trailer shall not be placed on site until the property on the north side of the alley is paved and striped to provide the required parking as well as to replace the six (6) public spaces whicn presently exist on the subject property. The structure is nonconforming due to an existing four and one half (4 1/2) foot side yard setback in lieu of five (5) feet as required by section 9110.7(a) of the _ode. Location: 809 Thirteenth b.reet Mike Connor, Staff Planner, reported that the residence is nonconforming due to a four (4) foot six (6) inch side yard setback in lieu of five (5) feet as required by Code. The request is for an addition to the rear of the structure and a second story. Staff advised that no comments were received in response to the public notification.
