Harbor Boulevard, Suite B, Fullerton, CA 92835 To permit a waiver of development standards pursuant to Huntington Beach Zoning and Subdivision Ordinance Section 241.22 in conjunction with the proposed development of two units with a total site coverage of 2,982 sq. ft. on a site area of 5,750 sq. ft. The waiver of development standards is a request to permit lot coverage of 51.86 percent in lieu of the maximum allowed lot coverage of 50 percent (representing a 3.72 percent increase of the maximum lot coverage). LOCATION: 518 & 520 15th Street (east side of 15th Street between Acacia Avenue and Pecan Avenue) DATE OF ACTION: February 3, 2009 On February 3, 2009, the Planning Department of the City of Huntington Beach took action on your request and APPROVED your request with conditions. Attached to this letter are the conditions of approval for your application. Please be advised that the Department of Planning reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an interested party. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. I FINDINGS FOR APPROVAL - ADMINISTRATIVE PERMIT NO. 08-028: 1. The proposed 51.86 percent lot coverage does not exceed a 10 percent deviation from the maximum lot coverage of 50 percent applicable in the RMH-A (Residential Medium High Density - Small Lot Subdistrict) base zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The proposed increase in lot coverage allows for an enhanced project design by allowing for strategi- cally placed decks and other private/common open space areas for both units. In addition, the pro- posed design incorporates building variation and articulation through enhanced roof design, smooth stucco finish, unique glass and solid core windows, and wrought-iron railing, which breaks up the overall building mass and creates visual interest. The above-mentioned details will enhance the pro- ject with no detrimental impacts to surrounding properties by complying with required front and side yard setbacks, open space, height limits, and parking requirements. 3. The proposed dwelling would not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the proposed 51.86 percent lot coverage, the proposed addition conforms to all applicable development standards, including required front and side yard setbacks, open space, height limits, and parking requirements. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 08-028 1. The site plan, floor plans, and elevations received and dated December 30, 2008, shall be the con- ceptually approved layout. INFORMATION ON SPECIFIC CODE REQUIREMENTS - ADMINISTRATIVE PERMIT NO. 08-028: 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 08-028 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 08-028 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a writ- ten request submitted to the Planning Department a minimum 30 days prior to the expiration date. 4_ The Planning Depa rtment reserves the right to revoke Administrative Permit No. 08-028, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Depart- ment, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
