(a) Pizza Hut of San Diego , Inc. is embarking-ron-"z ieNi take-out and
delivery-only pizza business in Southern . Caliiornia. Because of the
many unknowns regarding the success ' df ' this venture, Pizza Hut is
respectively requesting the utilization of the existing pole sign through
this Limited Sign Permit to initially give the business better visibility
and a better chance of success.
(b) Since there are other pole signs in the vicinity of this site this request
will not constitute a granting of special privileges inconsistent with
normal limitations.
(c)This Limited Sign Permit is requested in order to give this new business
every opportunity to succeed at this location, which is necessary for the
preservation and enjoyment of our property rights.
(d) The reason why the granting of this request will not be materially
detrimental to the public welfare is as follows:
1. The pole sign already exists, therefore upgrading of the sign
with new sign faces and the painting of the base will only
enhance the site.
2. The better visibility which the pole sign gives this site will
allow the public to be better informed as to the services
provided at this location.

On October 18, 1990, I contacted you icy letter on behalf on Pizza Hut to
ascertain your specific requirements for the "detailed p' ans" that must be submitted for you
to issue "final approval" of the above-limited sign pern'dt applications.
Previously I visited your office on September 21, 1990, to ascertain the exact
status of the application process. At that time I learned that the permits for the signs had
not been issued, but I was not furnished with the particular i .°quirements to complete same.
For instance, I asked if a bond was in place to which I received the reply that the bond was
handled in another department and if there was no note in the fib, that it is missing, and
it was probably filed.
I am now informed that you wish to close this matter by estinguishing all rights
to maintain the signs in question.
The plan detail submitted with the application and included with my October
18, 1990 letter appears to be the documents referred to in item 1. of the conditions of
approval set forth in your two August 22, 1990 letters relating to the above permits. These
plans detailed the building dimensions, site dimensions, drawings, relative positions to
nearest intersections, street names, etc.
Without advising us in particular what plan features you desire submitted for
review and analysis as a condition to your final determination and approval, our client
cannot finalize a course of action regarding the sign permits.

For example, Pizza Hut believes that certain aspects of the permit approval
should be reviewed by the city council through the appellate process. However, the lack of
a final ruling by the Planning Commission leaves the subject of the appeal without
substance. Without knowing what terms and conditions will be part of the final approval
of additional plan detail submission, the actual physical sign configuration would not be the
subject of an appeal due to the Planning Commission's reserved right to further plan review.
If other aspects of the Planning Commission sign conditions are objectionable,
a partial appeal of these matters, if sustained, still leaves the Planning Commission with the
power to establish further conditions upon remand as "part of their process of final
approval." This could generate two appeals of the same permit which is wholly improper
and unwarranted.
Leaving the permits in an unfinished state, whether inadvertent or others;ise,
effectively deprives Pizza Hut of its administrative due process right to proceed to final
administrative review.
Pending your clarification of the finalization requirements of the above sign
permit application, a preservation of the status quo is requested.

FINDINGS FOR DENIAL - LIMITED SIGN PERMIT NO. 90-7:
1. Allowing the maintenance of the sign for an additional, two years
will adversely affect other signs in the area.
2. The proposed sign face change will be detrimental to property
located in the vicinity of such sign, and will not be in keeping
with the character of the surrounding area.
3. The sign in its existing lo- Lion along Beach Boulevard will
obstruct pedestrian or veh ar traffic vision.
4. Due to the unique circumstances applicable to the sign,
immediate alteration, removal or replacement of the sign will
not result in a substantial economic hardship.
