NOTICE IS HEREBY GIVEN that Administrative Permit No. 04-18, submitted November 5,
2004, shall be deemed withdrawn, absent submittal of plans and applications materials consti-
tuting a complete application on or prior to April 28, 2006. A "withdrawn" status is applied,
upon notice and failure to respond, to applications which remain idle in excess of one year fol-
lowing the most recent notice of filing status letter. A withdrawn application may be re-initiated
only upon submittal of a complete application package and payment of the corresponding appli-
cation processing fee.

Dear Mr. Paulson:
NOTICE IS HEREBY GIVEN that the Planning Department has reviewed your entitlement
application and has determined that the request can not be processed pursuant to the
provisions of the Huntington Beach Zoning & Subdivision Ordinance (HBZSO), based on the
following:
CODE REQUIREMENTS
1. HBZSO Section 241.22 - Waiver of Development Standards identifies standards which may
be waived by the Planning Director pursuant to the authority granted therein, and further
states that no other standards shall be subject to waiver. Floor area ratio is not among the
standards listed. Accordingly, approval of a variance would be required in order to allow
any increase in floor area ratio above that allowed by the HBZSO.
2. Section 231.04 - Off-Street Parking and Loading Spaces Required requires two
enclose 'rking paces per unit with up to three bedrooms, plus one additional parking
spaces for each addi i6 ttbedfpom. The proposed project would increase the number ofn=. .bedroom from three to four, and acc5rdingJy,.,increase the on-site parking requirement by
one parking space over that existing on the site (v e, atwo--car garage). Parking is not
among the standards which may waived in conjunction wltr'A'n-anistrative permit.
Accordingly, approval of a variance would be required in order to allow a in
required on-site parking.
3. HBZSO Section 203.06 - Definitions defines a dwelling unit as having only one kitchen.
The proposed addition includes construction of a second kitchen on the third floor. The

RMH-A zoning district allows a maximum of one unit on lots less than 50 feet in width. The
HBZSO has no provisions to allow a second dwelling unit on the subject property.
APPLICATION REQUIREMENTS
1. As noted above, multiple variance requests would be required in order to continue
processing of your proposed project, in lieu of the Administrative Permit request. HBZSO
Section 241.22 provides for Waiver of Development Standards only without a variance or
conditional use permit request. The variance application processing fee is $2,402. A credit
for the fees paid to date ($736) may be applied to a variance application filed for the
proposed project. Additional requirements for filing a variance application include a revised
project narrative, an amended application, public hearing noticing requirements and twelve
sets of project plans. Please note that variance application fees are non-refundable.
Alternatively, you may opt to withdraw your administrative permit request and request a
partial refund of the fees paid to date.
2. The submitted project narrative and request is inconsistent with the submitted plans with
respect to the proposed lot coverage and floor area ratio. Based on the to-scale
dimensioned plans, the proposed lot coverage exceeds the permitted lot coverage by 10
percent (vs. 9 percent requested in the submitted narrative) and the floor area ratio
maximum by 7 percent (vs. 4.4 percent requested in the submitted narrative). Any
amended or substitute entitlement application must be corrected for accuracy and
consistency.
STAFF RECOMMENDATIONS
Based on a review and analysis of the submitted plans, and not-withstanding the code
requirements identified above, the Planning Department does not concur that the design of the
proposed project would be improved by the granting of a waiver of HBZSO lot coverage
standards. Moreover, staff has failed to identify unusual circumstances associated with the
project site or a hardship resulting from strict application of the zoning ordinance, that would
serve to meet the required findings for approval of a variance to floor area ratio or parking
requirements. Finally, please note that additional comments or concerns may be generated
upon receipt of revised plans or new information.
