On August 17, 2011, the Planning and Building Department of the City of Huntington Beach
took action on your request and APPROVED your request with conditions. Attached to this
letter are the conditions of approval for your application.
Please be advised that the Department of Planning and Building reviews the conceptual plan as
a basic request for entitlement of the use applied for and there may be additional requirements
prior to issuance of building permits. It is recommended that you immediately pursue
completion of the conditions of approval and address all requirements of the Huntington Beach
Zoning and Subdivision Ordinance (HBZSO) in order to expedite the processing/completion of
your project. The conceptual plan should not be construed as a precise plan, reflecting
conformance to all Zoning and Subdivision Ordinance requirements.
Under the provisions of the HBZSO, the action taken by the Department of Planning and
Building is final unless an appeal is filed to the Planning Commission by you or by an interested
party. A person desiring to appeal the decision shall file a written notice of appeal to the
Secretary of the Planning Commission within ten calendar days of the date of the Planning and
Building Department's action. The notice of appeal shall include the name and address of the

appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494
shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in
detail the action and grounds by which the applicant or interested party deems himself
aggrieved. The last day for filing an appeal and paying the filing fee for the above noted
application is Monda Au ust 29 2011 at 5:00 m.

CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 11-014:
1. The floor plan received and dated May 26, 2011, shall be the conceptually approved layout.
2. The home occupation use shall comply with the following:
a. Music instruction shall be limited to a maximum of two students during any class
session.
b. Music instruction shall be limited to between the hours of 9:00 AM and 9:00 PM on a
daily basis.
c. All exterior doors and windows within the living and dining rooms shall remain closed
during the times of music instruction.
d. Students shall only enter/exit from the main entrance of the dwelling facing Nassau
Lane.
e. All students waiting for lessons shall either wait in the vehicle that is dropping them off or
the student may wait inside the dwelling; all students waiting to be picked up after their
lessons shall wait inside the dwelling.
f. All vehicles dropping off/picking up students shall park in the driveway or in front of the
residence, in a legal manner, and not impede the public right-of-way.
g. All music instruction shall be conducted entirely within the dwelling. Required garage
parking area shall not be used in connection with such use except to park business
vehicles.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. No one other than a resident of the dwelling shall be employed on-site or report to work at
the site in the conduct of a home occupation. This prohibition also applies to independent
contractors. (HBZSO Sect. 230.12.C.2)
2. There shall be no display of merchandise, projects, operations, signs or name plates of any
kind visible from outside the dwelling. The appearance of the dwelling shall not be altered,
or shall the business be conducted in a manner to indicate that the dwelling or its premises
is used for a non-residential purpose, whether by colors, materials, construction, lighting,
windows, signs, sounds (excluding music utilized in association with music instruction) or
any other means whatsoever. (HBZSO Sect. 230.12.C.3)
3. The home occupation shall not substantially increase pedestrian or vehicle traffic beyond a
level which already exists within the neighborhood. (HBZSO Sect. 230.12.C.4)
4. No commercial vehicle or equipment used in conjunction with the home occupation shall be
parked overnight on an adjacent street or in any yard visible from the street. (HBZSO Sect.
230.12.C.5)

5. The home occupation shall not include an office or salesroom open to visitors, and there
shall be no advertising of the address of the home occupation. (HBZSO Sect. 230.12.C.7)
6. Any authorized City employee may inspect the premises of a home occupation upon 48
hours notice to ascertain compliance with these conditions and any requirements of this
code. The permit for a home occupation that is not operated in compliance with these
provisions shall be revoked by the Director after 30 days written notice unless the home
occupation is altered to comply. (HBZSO Sect. 230.12.C.9)
7. Administrative Permit No. 11-014 shall not become effective until the ten-calendar day
appeal period has elapsed. (HBZSO Sect. 241.14)
8. Administrative Permit No. 11-014 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the
Director pursuant to a written request submitted to the Planning and Building Department a
minimum 30 days prior to the expiration date. (HBZSO Sect. 241.16.A)
9. The Planning and Building Department reserves the right to revoke Administrative Permit
No. 11-014, pursuant to a public hearing for revocation, if any violation of these conditions or
the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.

10. The development shall comply with all applicable provisions of the Municipal Code, Planning
and Building Department, and Fire Department as well as applicable local, State and
Federal Fire Codes, Ordinances, and standards, except as noted herein, including Chapter
8.40-Noise Control of the Municipal Code. (City Charter, Article V)
