Administrative Permit No. 11-014 Noise Study
Equipment
American Recorder Technologies SPL Meter model SPL-8810 (specifications) set to "Slow Response" (1-second) and
"A-Weighting", db(A).
Location
Measurements were taken on property line between 16172 (Shen's Studio) and 16162 (Ray Holt) on Nassau Lane,
at 10 feet away from any reflective walls.
Measurement Periods
1. August 6, 2011 (Thurday)
• 8:30 AM to 9:00 AM, in the course of a morning piano lesson.
• 9:00 AM to 9:30 AM, this represents morning ambient noise levels.
2. August 8, 2011 (Friday)
• 1:30 PM to 2:00 PM. This represents afternoon ambient noise levels.
• 2:00 PM to 2:30 PM, in the course of an afternoon piano lesson.
Ambient Noise
During the morning study the most prominent noises came from bird calls (crow caws were especially pervasive),
dog barks, pedestrians, bicycles, passenger cars, airplanes and nearby home construction. Ambient noise levels
were entirely between 37-66 dB(A) with 40-60 dB(A) as the characteristic range.
During the afternoon study, the 3 other schools across the street were in session and accordingly produced
playground noises and vehicular and pedestrian noises related to their students. Other noise sources included
home construction, bicycles, lawn mower, passenger cars, garbage trucks, courier trucks, street sweeper, airplanes,
dog barks and bird calls. The more distant noises were associated with Springdale Street and Edinger Avenue.
Ambient noise levels were entirely between 41-67 dB(A), with 46-63 dB(A) as the characteristic range.

The City has already given me all its rationales in writing, thank you, and I've read every word and understood it. Does it
have new rationales? The HBMC needs to be the basis of its rationales.
I'll let you know when we can meet ASAP. Invitations are being sent out at this point. In the mean time please respond to
my July 31st email.
In that email I responded to your latest draft conditions quoting the HBMCas basis. We are interested to know exactly
what the City disagrees with based on HBMC. The City may want to respond in the following example format:
Studio said: "The school does not have exclusive rights to park in front of its own building. There are
times when the curb in front of the residence is packed full of vehicles unrelated to the School.
Where do studio students park if they are not guaranteed available parking?"
City's response: "The City may restrict parking for a business without assuring availability of parking to
said business per HBMC xx.xxx.xx"
I request this because it seems there's no central person at the City that's accountable for both studying the case AND
making decisions. The two tasks appear to be delegated to two separate individuals. As result, the decisions miss the
facts.

3. HBMC "8.40.090 Special provisions. The following activities shall be exempt from the provisions of
this chapter (meaning Chapter 8.40 Noise Contr%... (b) Activities otherwise lawfully conducted in
public parks, public playgrounds and public or private school grounds;"
Therefore Shen's Studio, being a school, is exempt from HBMC8.40 Noise Control.
Second part of this email alerts the City that if it decides to impose the latest draft conditions it will be committing abusive
regulation.
Condition 2b. "Music instruction shall be limited to between the hours of 9:00 AM and 9:00 PM"
• The only places in the HBMC 8.40 that contain references to the 9 AM start time restriction are
• 8.40.090 Special Provisions (h) regulating home maintenance activities on Sundays and Federal Holidays.
• 8.40.095 Leaf Blowers (c) Special prohibitions (1) Time restriction, which is just an application of 8.40.090(h)
above to specifically leaf blower operations.
• Even if, by some contrived interpretation, the City felt the HBMC noise restrictions applied to the school, which I
absolutely disagree with, music instruction is still permitted between 7:00 AM and 10:00 PM per 8.40.050(a) and
8.40.070(a).
Condition 2d "All exterior doors and windows shall remain closed during the times of music instruction."
• This is found nowhere in the HBMC, has no basis, and does not address any actual violations of any code
Condition 2f "All students waiting for lessons or to be picked up shall wait inside the dwelling."
• This is found nowhere in the HBMC, has no basis, and does not address any actual violations of any code
Condition 2g. "All vehicles dropping off/picking up students shall park in front of the residence..."
• The school does not have exclusive rights to park in front of its own building. There are times when the curb in front
of the residence is packed full of vehicles unrelated to the School. Where do studio students park if they are not
guaranteed available parking?
• Mr. Holt apparently intentionally parks his vehicles in front of my residence, which is detrimental to my students'
access to parking.

we have known Shen, and known of her work, there has never been a problem.
We realize that she is a single woman, who is helping her parents and trying to make a living.
As far as the noise, I can say that once and awhile we will hear music, but it is quite pleasant to the ears. I myself, work
at Westminster School District and it has been pretty much cut to the bare minimum. Alot of schools in Huntington
Beach, have fund drives to pay for music. I feel that she is teaching the children an art that has been almost eliminated
from the schools. We are in praise of her work to tomorrow's leaders.
As far as the parking situation, we have never seen a problem. Yes, there are times when people do park in front of our
home. It's usually one car and not for very long. We have never had a problem with any disturbance of her students, or
their parents.

Dear Sirs:
Thank you for your considerations. The Studio agrees that this permit would not serve the Studio's long term needs if it
restricted operating hours to those stated in the Narrative, which was based on the then-current enrollment at the time
this petition was initiated. It would prevent the addition of even a single new student, or the expansion of available hours
during school breaks (which we are now in). Therefore we'll amend the nominal operating hours to include 7 AM to 9 PM
all seven days of the week. The Studio hours also needs to accommodate make-up lessons at odd times for when
students fall ill and miss their regularly scheduled lessons. The survival of a small business depends on its flexibility and
agility.
As for the City's Sunday noise restrictions, we'd like to research the language of HBMC 8.40 Noise Control prior to
providing a response. We may seek expert measurement on our noise levels. At this time, without any actual
measurements, we are fairly certain that by simply keeping our front window closed on Sunday mornings the Studio
would meet any noise ordinances, based on Mr. Ron Gagliano's letter:
"As the flute and piano are not bombastic instruments, I never hear the music/practice in cool weather as the
Studio's windows are dosed, even though the house is directly across from mine and I am standing in my
driveway."
Why do Sunday lessons begins so much earlier than the rest of the week? Self-employed people like myself are not able
to dictate our work hours, we must constantly market ourselves and take whatever work is out there. The Studio's
schedule has always been pretty much dictated by its clients, and Sunday schedule is no exception. Our students being
primarily school aged children, our weekday schedules naturally fall outside of school hours when schools are in session.
On weekends our clients have their own schedules. The current Sunday schedule meets the Studio's Sunday clients'
demands. Please kindly assure your upper management that it is certainly not my dream to have to work on Sunday
mornings, nor is it my family's dream to not have their Sunday mornings to themselves. We are just trying to keep a roof
over our heads.
As of this week the Studio has nine students on its busiest day. The lesson durations are between 30 minutes and 60
minutes. The lesson times are scattered from 9 AM to 8:15. This is typical for summers. We'd like them to come in blocks
of time to make it easier to run errands and conduct other businesses (such as applying for a Home Occupation Permit),
but this is what the clients demand. Services that do not meet customer demands are naturally selected out of existence.

Sorry I missed your call earlier, but I presented your project to upper management and they have concerns with some of
the conditions I'm recommending. First, with Condition No. 2(a) they are contemplating limiting the hours of musical
instruction according to the hours provided in your narrative. This means that musical instruction would only operate
Monday, Wednesday, and Friday between 2:00 PM and 8:30 PM and Saturday between 4:00 PM and 5:00 PM. Sunday,

however, is an area of concern with sk and would request that the hours not orate any earlier than 12:00 PM. The
recommended commencement hour on Sunday's is consistent with the City's Noise Ordinance (HBMC 8.40 Noise
Control) which has stringent limitations on noise levels on that day. As a compromise I had requested that we allow you
to provide us with a schedule that takes into consideration future growth allowances so that way you have the flexibility
to change your schedule according to availability and enrollment increases. If this is a viable alternative, please provide
me with a new schedule that takes into consideration the anticipated growth of your school.
Also, management had a couple of questions related to the hours of operation. First, on Sunday's they questioned why
classes start so much earlier than the rest of the week? Second, what are the maximum number of class sessions you
have in a given day and what are the duration of those sessions?
At your earliest convenience please provide me with your response to the aforementioned questions and directions.

Dear Mr. Gonzales:
The City, ever since June 1, 2011, has had in its possession an unsolicited letter of enthusiastic endorsement from Mr.
Ron Gagliano who lives directly across the street from my Studio. His letter was dated May 27, 2011 and bears a stamp
indicating it was received on June 1, 2011 by the Dept of Planning and Building. Strangely, the City appeared to have
dismissed the fact that this letter refutes the original complaint virtually point by point.
Mr. Gagliano composed that letter outside of our knowledge, and he had no knowledge of the contents of Mr. Holt's
complaint. His letter is attached here, please especially note the following points expressed by it:
"... noise/sound from the studio is not an issue."
"... vehicular traffic congestion is a non-issue"
"... pedestrian congestion isn't evident"
"With our school systems having been financially battered over the years, the arts have all but vanished from our
schools. It is very evident that music is a large part of our societal desires, and any institution that offers quality
music instruction is certainly a benefit for the public as a whole. As with the kind of music that Shen's Studio
advocates - the classics - our community will continue to grow in its appreciation of the fine arts.... For reasons
stated in these four points, I encourage the City of Huntington Beach to approve the proposal of Shen's Studio."
Per your request to help drive the point home for the City, the Studio will solicit other neighbors for comments. I'm
hopeful that these will be forthcoming. Please continue to furnish us with copies of public comments as the City receives
them. If the comment is verbal, please provide a report or case diary, whatever the City uses to document such inputs. We
will need the documentation for any future troubles with Mr. Holt as he has expressed that he will stop at nothing, and we
have reasons to fear him.

My name is Danay Hoang and I am the parent of two of Ms. Shen Liu's piano students.
My children have taken lessons from Ms. Liu for over two years. In that time I have had two
encounters with her neighbor, Mr. Holt. In the first encounter my then two-year-old son (not
a student of Ms. Liu) had stopped me in Ms. Liu's driveway to ask about an insect he had seen
scurrying out of a crack in the concrete. After I squatted down to talk to him about it, Mr.
Holt came out of his house to curtly ask if I was part of the pre-school down the street. I
explained that my two older children were currently taking a piano lesson from Ms. Liu. He
informed me that we were not to be out in front of the house. I must admit that this
directive stymied me, as my son and I had been speaking in a conversational tone at about
9:30 in the morning, and I was unaware of any statutes barring our presence in Ms. Liu's
driveway. However, I complied, with apologies to Mr. Holt, and continued to my car which was
parked in front of Ms. Liu's house. The second encounter was about a year ago when I parked
to the north of Ms. Liu's driveway, which is partially in front of Mr. Holt's house. We did
not exchange words, but he emerged from his house and imperiously watched as I parked and
escorted my children into Ms. Liu's house.
I understand that the location of Ms. Liu's business in her home presents unique challenges
for her and her neighbors. I am eager to comply with reasonable guidelines to ensure the
success of her livelihood and the comfort of her neighbors. I do have a few questions
regarding the "Conditions of Approval" regulating Ms. Liu's business. Guideline 2c states,
"Music instruction shall be prohibited a minimum of 15 minutes between the conclusion and
commencement of each session. " Does this mean that there must be 15 minutes between my each
of my children's lessons? It would be very inconvenient for my family to have to wait or
leave between the lessons. Guideline 2g reads, "Vehicles dropping off/picking up students
shall park in a legal manner and not impede the public right-of-way. " Does this bar parking
alongside the curb in front of any of Ms. Liu's neighbors? Guideline 2k instructs, "The home
occupation shall not adversely increase pedestrian or vehicle traffic in the neighborhood. "
I occasionally push my infant daughter in a stroller while my four-year-old son walks with me
on the sidewalks in the neighborhood, during my older children's lessons. Is this allowed?

Regarding: Administrative Permit No 2011-014, Ms. Shen Liu
I am writing in regards to the complaint filed by Mr. Holt and the required conditions of
approval for the above case.
My daughter has been taking piano lessons with Ms. Liu for many years. Personally, I
have witnessed the same procedure for drop off and pick up of students at her house for
lessons, and it has always been quiet and orderly. The parent pulls up in front of her
house and escorts the student to the front door and knocks on the door. Ms. Liu answers,
lets the student in and if the previous student is done with lessons, the student then leaves
at that time with the parent or remains in the house until the student is ready to be picked
up. I have never witnessed any prolonged conversations between Ms. Shin, the parents or
students. Per my observation, the entire process typically takes about 30 seconds at most.
I do not even know that musical lessons are going on until I get to the front porch and the
door opens, because I have never been able to hear the music radiating from the house.
Ms. Liu is a very soft-spoken, quiet teacher. She is a respected classical music teacher.
The students are required to train in their field of music several hours a week in their
respective instrument. They typically are above average and or honor students. I have
attended semiannual recital and honors concerts over the years at respected venue halls
and have never witnessed destructive or inappropriate behavior on the part of teachers,
students or parents. The complaints by Mr. Holt seem to contradict with the type of
student and parent that seek the services of Ms. Liu.
The street that Mr. Holt and Ms. Liu reside on is a very busy street utilized as a
thoroughfare from Springdale to Edinger by parents whose students attend one of the
multiple schools/daycares directly across the block from them. There are also many
students that walk through the neighborhood on their way to Marina High School. I have
noticed a great deal of traffic through the neighborhood, but I have never been unable to
park in front of Ms. Liu's house because of cars blocking the driveway, nor have I noticed
multiple cars parked at or in front of her house at one time.
Although I have never discussed this with Ms. Liu, I personally would not want to be Mr.
Holt's neighbor on either side of him due to his apparent lack of regard for maintenance
of his house or yard. His home has looked like an abandoned home/case of blight for
many years due to the lack of lawn care and paint on his house. I don't understand why he
wants strict regulations applied to Ms. Liu, when he can't seem to consider the impact his
home condition has on the neighborhood. Personally, this is why I live in the
Summerlane neighborhood with an association so that I would not have to be subject to
looking at a house in disrepair so close to me. I also bring this up, because Mr. Holt was
in my neighborhood last Halloween, trick or treating with his son and he was arguing
with someone. I don't know why he was in my neighborhood, when I do not live close to
him or who he was arguing with, but I recognized him because he has come out of his
house a few times when I have dropped my daughter off. Perhaps he has trouble getting
along with society as a whole. I think he might suffer from some sort of cognitive
dissonance.
I find this whole situation disappointing. On occasion, I have sat with my daughter during
her lessons and have noticed the doors and windows are shut. The music lessons are
orderly, relaxing and have brought much joy to my daughter, my family and myself. It
would be a travesty to punish Ms. Liu with these harsh restrictions. It does not make
sense that any one would want to aspire to be a teacher when they are forced with the
prospects of unemployment, low pay and lack of respect and then people have the nerve
to wonder why the U.S. continues to fall behind other countries in regards to education.
I urge to consider this case carefully.

Thank you for your time. I have also attached an PDF account by my wife of the March evening 'incident'
which was also 'summerized' by Ray Holt in his letter to you. I was also there and I estimate that less than 20%
of what Ray said was factual or remotely true.
Here's my cut:
1) Over the last several years, on my way home from work in LA, I have occasionally dropped by Shen's house
(always parking across the street from Shen) to meet my wife at the end of her lesson and escort her to home or
dinner from there. I have had a chance to observe some of her other students entering or leaving Shen's house
and noted nothing out of the ordinary. No noises, no racass behaviour, no loitering, no anything... Nothing. (I am
a very observant, 30 yr, Sr. Scientist in the aerospace arena and I also keep a watchful eye on things but I see
absolutley nothing for this man to become concern with, what so ever)
2) Her students all appear to be young females escorted by their mothers, all small of stature. They enter or
egress quietly, without any commotion.
3) My first 'experience' with Mr. Holt occurred late last Fall (Nov/Dec 2010). It was between approximatly 6:30
and 7 o'clock, dark and cold outside. I parked my new 2010 car ("0%" pollutants) across from Shen's House
with my car running (I had the heater and radio on) and waited for my wife's lesson to end. Out of nowhere, a
large, up-set appearing middle-aged man startled me by banging his clentched fists on my driver's side car
window, scaring the hell out of me. He was strongly telling me to turn off my car. Startled, I partially rolled
down the window and asked him to repeat what he was saying. He strongly told me that he and his son were
still outside and that my'exhaust' was chocking he and his son..I was so upset, that I immediately complied with
his 'request' without provocation.
4) In the future, so as not to be confronted by this 'angry' appearing man, I would park further up the street, most
times with my engine off. Also, from this point, my wife and I become aware that this 'neighbor' may be an
unstable and unreasonable person and would watch out for him in the future.
5) Fast forward to late April, 2011. *also refer to my wife's attached pdf. account). At approximately 600 -
630pm, on a Wednesday in late April, I got a frantic call from my wife (who was parked across the street from
Shen's house, engine off, awaiting for her 600 lesson) saying that Shen's neighbor (Mr. Holt) was angrily
banging on her window and telling her to come out of her car immediately (I believe that I could hear her telling
him to leave her alone over her cell) ...At the time I was on my way home and close to Shen's address. I called
the Police (twice) but they would not come out because I could not quote an exact address.
When I arrived, my wife was no where to be found.(she was hiding from Holt along with the previous student
behind Shen's locked door). Apparently, just before I had arrived, Holt had gone over to Shen's property, angrily
banging on her door and yelling at her to come outside to talk to him (they were scared for their lives and also
called the Police as I did as well).

When the Police arrived they got eryone 's account of the event and told *t to go inside his house, that he
had no business telling us to turn off any car engines, and that anyone can sit in a car with the motor running;
that it was not against the law.
6) Because of these incident's and Holt's irratic behaviour, Shen now comes over to our house (located on the
other side of HB) for the lessons. Luckily, we have a piano at our house, but other student's are not so lucky.
(The same night, I talked to one of his neighbors and they say that he calls himself the neighborhood watchdog)
This man has absolutely no business banging on peoples windows, threatening or demanding anything from
neighborhood visitors. The visitors are not hoodlums, they are law abiding citizens who are NO threat to
ANYONE in ANY neighborhood. They are taking classical music lessons!! (and in a quiet manner).
They (we) are the victims of neighborhood bullying by Holt and, in fact, we still may take this issue to the
police . It is trusted that Mr. Holt's opinions, conjectures, claims, etc. should be carefully weighed against the
other Emails/Letters from all of Shen's students (who are not too afraid to send in their accounts).

I have been a student of Shen Liu since 2005. My piano lesson is scheduled every
Wednesday at 6:15 pm.
On March 9,2011, at around 6:05 pm , I parked my car across 16172 Nassau (piano
teacher's residence) and started getting my purse and piano book when all of a sudden
I heard a loud banging on the driver's side window. I was startled and very afraid of a
man standing and motioning me to get out of my car. I immediately got my cell phone
and called my husband. I do not know this person at all. While talking to my husband,
he left and I went to my teacher's residence and got her out while she was teaching a 6
year old girl. My teacher came to my car and asked me to come inside the house now. I
noticed that she was pale and afraid as well. I came out of my car while the man (Ray)
who lives next house (16162 Nassau) from my teacher was still yelling and threatened
to call the police. I do not know what his problem was or what did I do to him to harass
me? Then my teacher and the mother of the 2 students told me that these next door
neighbor has been harassing all the students/parents.
My husband came and later the police came. We talked to the police officer R. Besuzzi
#1068 and told him about the harassment and bullying that these person has been
doing.
We are hoping that we the family and students of Shen Liu will be protected from this
bully. We are good citizens/ professionals who obey and respect the laws and we want
to feel secure that we can take a piano lesson instead of being intimidated by a
neighborhood bully.

I am writing with reference to the letter of complaint written by Mr. Holt regarding Ms.
Liu's music studio and the ensuing conditions that need to be followed by her.
I am a parent whose child has been learning music under Ms. Liu's tutelage for the past 6
years. At no time during these 6 years have I observed any other parent behaving in the
manner that Mr. Holt has mentioned in his letter nor have I seen them disrupting the
neighborhood. I have always parked legally on Nassau Lane and have never obstructed Mr.
Holt's driveway, nor have I seen other cars doing so. Needless to say that "Nassau Lane" is a
public street and does not belong to Mr. Holt.
I am requesting you to re-consider the conditions, namely "C" and "F". If there was to be a
"15 minutes" interval between the conclusion and commencement of lessons, it would mean that
fewer students would have the opportunity to learn music, as Ms. Liu would have to re-
schedule her lessons to comply with the conditions of approval. Furthermore, why should Ms.
Liu, who is earning an honest day's living, be penalized to satisfy her neighbor's
unreasonable and psychotic behavior?
I would be grateful if you would re-consider the conditions that I have mentioned above.

Dear Mrs. Dimaggio & others addressed in this email,
First of all, I don't know why you wrote this letter when you have no knowledge of what my family & I have had to endure these last 2-3
years. If you bothered to read my letter, you would see that my complaint is not with Shen or her teaching music, it's with the
incredibly rude and uncaring clients. I have no problem with the music, good and bad, coming out of Shen's house, it's the traffic, noise
and rude people who are her clients.
I guarantee if you had to deal with constant car alarm horns every 20-30 minutes, car doors slamming, kids playing in front of your
house, people talking on cell phones in front of your house, people leaving their car engines running for 30+ minutes in front of your
house, you'd be singing a different tune. Have you had your life & safety threatened by nasty people parking in front of your house ?
Have you had really angry people aim a speeding car at you with your child watching and your child thinking that they're about to see
their father run over by some out of control monster ? Have you had people stand in front of your door for 30+ minutes talking on their
cell phone in front of your door ? Do you have people turning their car alarms on & off on Sunday mornings at 7am or yelling kids
coming & going so they wake your children up ? Why would you even write a letter in support of Shen, when you have no idea what
the issues are. Have you ever had to go through ANYTHING that I've written about? If you haven't, then you have no reason to write
the letter you did and unless you're willing to spend a week or 2 living in my house to see what we have to put up with, any comment
you make is useless.
You make a comparison between Nassau and Robinwood baseball park, but there's a huge difference that you neglected to mention.
When you buy / rent a home around a park, airport or other busy area, you know what you're getting into and you move there with the
knowledge of the traffic, noise and other issues that go with living there. When I purchased my home, Shen didn't live here, her
husband Jemi did. There was no traffic, noise, car alarms, rude people standing and parking in front of my house at all hours. Had I
known there was a retail business in the house next door to me, I would have NEVER purchased my home. Unfortunately Shen
decided to open her business without asking any of her neighbors or caring what the impact would be on our peace & enjoyment of our
home. I bought my house because it was a quiet area, even with the 1-2 hours a day of traffic from the school on Clark, but with
the Shen's clients coming & going at all hours, it's become too much of a disruption to my family and myself.
Let me ask you, how would you like 5-15 strangers parking in front of your house EVERY SINGLE DAY? How happy would you be
with car alarm horns, slamming car door, yelling kids, people on cell phones, cars left running, along with 10-30 cars coming & going
every day in front of your house ??? Until you have to live with the mentioned disturbances in your life, you have no standing and your
opinion has no bearing on what I have had to go through.
I'm a very polite person, I have raised my son to be the same and I do not impose on, disturb, annoy or bother my neighbors in any
way. When I've asked Shen's customers to turn off their car engines because the fumes were coming into my home, only to be told to
go fuck myself in front of my son, I'm done being nic It's painfully obvious that Shen hasn't asked her customers to park elsewhere or to
keep the noise down or turn off their car engines or not disturbing her neighbors. WHY ??? When my life is threatened by insane
customers of Shen, I'm done being nice and when my enjoyment of my house is no longer allowable because of Shen's customers, I'm
done being nice. Do you really think it's too much for Shen's customers to park in the school parking lot on Clark and walk their kids
over ? Is it too much to have people park in the Von's parking lot and walk their kids I block in order to be polite and have
consideration for others? We live in a residental area, there are no retail stores in my neighborhood and if Shen wants to have a retail
business in a residental neighborhood, then she should at least be considerate enough to have her clients park in an area that doesn't
disturb her neighbors. When you go to a mall, you walk further to go to a store, than you would by parking in the school parking lot on
Clark. So if parking less than a block away would prevent your neighbors from being disturbed, why is this a problem ?
Walk a mile in my shoes, then you have the right and the knowledge to speak. I guarantee you wouldn't tolerate what I have put up
with by Shen's customers and there's no reason anyone should have to. If something isn't done to stop these people from destroying
the peace & comfort of my home, then I will take further action to prevent any further disturbance to my enjoyment of my home. I'm
happy to meet with the city, Shen or anyone else, if it will mean I don't have to put with dozens of cars coming & going in front of my
house everyday.

as outlined in his letter and would hope that whoever these parents are realize they are making life difficult not only for Mr. Holt, but for

parents who placed our children in her instruction to add to their childrens' educational foundation, who have high aspirations for our
children to reach goals that include contributions to society at large and to teach them to give back to their community. I can say that
without a doubt, her teachings are part and parcel to our children's outstanding academic performance, which ultimately contributes to
local schools' test scores, which drive the funding for our public schools.
For my part, if I am doing a drop-off, I park briefly in front of Ms. Liu's home, not in front of Mr. Holt's, my child exits the car and I leave
immediately after they enter her home. For the times that I do stay for a given lesson, I make sure I park in Ms. Liu's driveway or in front
of her house, turn off the car and go directly into her house, never stepping foot on Mr. Holt's property or sitting in my car with the
engine running or radio blaring. I can't imagine why anyone would feel the need to leave their engines running or allow their children to
run around in anyone's yard that is not their own. So if this is the case, I would like to directly confront those parents as well to ensure
we are all on the same page-I don't want one set of parents making things difficult for the rest of us.
I would like to congratulate Mr. Holt's son on making the baseball playoffs with Robinwood Little League; this is an outstanding
accomplishment I'm sure he is very, very proud of. My son also plays in Robinwood Little League and I would ask Mr. Holt to give
serious consideration to the idea that the residents who live around the Robinwood Little League fields must feel much like he does
year round while baseball parents and their extended families come and go, parking wherever they can, in the surrounding
neighborhoods, talking and slamming car doors or setting car alarms without thinking about how it may affect those living in the nearby
homes. I would ask Mr. Holt how he would feel were he to be accused of egregious behavior carried out by others as he's described, or
worse, be instructed to park a long distance away every time to attend practices or games when the park's parking lot is filled to
capacity. I am fairly certain he or his family members have had to park in the nearby neighborhood at a very early hour to attend a
Robinwood game. I don't know about Mr. Holt, but I would be seriously bummed out if the city told me I couldn't park there anymore
because a resident complained about behavior I personally did not indulge in and directed me instead to park a distance away and haul
all my son's equipment and such to the field(s). This hypothetical situation would be inconvenient at best and dangerous at worst.
The bottom line, is we live in an urban area where people come and go all the time. In addition, Nassau Street is a very busy street due
to the nearby daycare and private schools situated on Clark Drive and because it is one of the main streets running through that
specific neighborhood. It seems an overstatement to claim that Ms. Liu's clients are adding so much more traffic to this street as to
warrant such strict conditions that apply to her and her alone. I would also be curious to know how Ms. Liu's other neighbors feel about
her clients. If we are impeding on more than just Mr. Holt's living situation, I personally want to know this as I would want to ensure I am
doing everything I can to not cause harm or disruption to them or their property. Has anyone asked them?
I would like to see us all have a meeting with Mr. Holt and a city representative to discuss his concerns so that we may achieve
conditions that satisfy everyone, as opposed to the city reacting with harsh conditions placed upon Ms. Liu without full information or
research to Mr. Holt's generalized complaints against all of her clients. I think a peaceful and satisfying resolution can be reached if we
all sit down and listen and try to work out a solution rather than dole out a punishment. If there are parents who are as confrontational
as Mr. Holt has described, then perhaps a case-specific solution needs to be made for/with them, outside of an agreement reached for
the majority of her clients. Would this be possible?

I am writing in regards to the complaint letter Mr. Ray Holt filed against Ms. Shen Liu.
My daughter is taking piano lesson with Ms. Liu over the past 2 years. Ms. Liu is the nicest, classiest, most
wonderful, and most professional person/piano teacher I know. She genuine cares for her students, and she will
go way beyond her means just to help her student reach his/her potential. Under her constant guidance and
patience, my daughter does recitals and National piano testings like most of her other students. As a result, we
as parents, were able to meet and talk to other students/parents at these events. I cannot imagine any of these
students' parents would be so disrespectful to Mr. Holt and his family. I am sorry if Mr. Holt had encountered
some unfortunate incidence, is it possible a misidentified neighborhood kids/family as oppose to Ms. Liu's
clients?
When I take my daughter for her lesson, I see prior student's parents car park either on or in front of Ms. Liu's
driveway, I would proceed to do so as well. I haven't seen any of Ms. Liu's clients in the car with engine
running and radio blasting in front of Mr. Holt's property. As we all know, residential streets are suppose to be
public property for all. Yet, Ms. Liu is fully aware of Mr. Holt's concern; she did not want any trouble from her
neighbor and informed all her clients not to park in front of Mr. Holt's property. So, I do not understand why
would Mr. Holt want to file such a ludicrous complaints against Ms. Liu! Was there any other neighbors
complaining? There are always two sides to the story. Please investigate before a harsh condition put upon
Ms. Liu! There must be a peaceful solution for all!

Dear Mr. Gonzales,
I am writing in reference to the attached e-mail that was sent to you on June 12, 2011.
My name is Kelly Seidel, and my daughter has been taking piano lessons with Ms. Shen for over 5 years. Our
regularly scheduled lesson is Wednesday afternoon from 4 to 4:30 pm, occasionally we will stay and wait
quietly outside, with the car off parked in front of Ms. Shen's house, or we go inside. When we don't stay we
drop off and come back to pick up without disturbing any of the neighbors. I'm appalled at the language Mr.
Holt used in this e-mail and am concerned about his anger towards the '40 something woman' he referred to,
Ms. Shen, and her clients in general. I've observed the traffic on Nassau Lane and I can assure you that it's not
the clients of Ms. Shen that Mr. Holt has a problem with. The traffic issues on Nassau Lane are caused by
residents who speed by going to and from their houses, or the people dropping off/picking up children at the
school on Clark Ave. just around the corner from Mr. Holt's house. People drive excessive speeds in this
neighborhood and I've often wondered how many children have almost been run over.
We have had one incident involving Mr. Holt:
We are acquaintances of the student and family that take lessons prior to ours on Wednesdays. As the student
was leaving from Ms. Shen's house my daughter was going up to the door for her lesson the girls exchanged
hellos and hugs. My daughter proceeded into Ms. Shen's house and the other student joined her family on the
side walk in front of Ms. Shen's house. We talked briefly and exchanged in short conversation - it had been
awhile since we had seen each other. We were not being loud at all. Mr. Holt approached us in front of Ms.
Shen's house and rudely told us to leave. We thought he was joking, but he was serious and he used foul
language at us in front of my 6 year old daughter and the 10 year old student who had just finished her lesson.
He was very confrontational and threatening to us. We all felt very uncomfortable and threatened by his
behavior and thought we should report his abuse to Ms. Shen. Ms. Shen was very apologetic and told us that
Mr. Holt has never been very nice to her. He has been known to be verbally abusive to her students and
parents. Ms. Shen feels very bad about his behavior and apologizes all the time to us since the incident. I can
vouch for Wednesdays from 3 to 4:30 pm that none of Ms. Shen's clients were involved in any of the
accusations he made in his e-mail to you. I've heard of other complaints from parents of the children who
attend lessons with Ms. Shen about "the neighbor", Mr. Holt.
Also, I've witnessed Mr. Holt at school functions where my daughter attends using foul, abusive language,
while he rants and raves; he has a reputation for being a hot-tempered man. In my opinion Mr. Holt needs to go
to anger-management class and respect the law abiding citizens who are simply there for the betterment of their
children by taking music classes. He is a scary man, and should be evaluated by a psychiatrist; I do not feel safe
with him next door to my daughter's piano teacher. If anything, the police should monitor Mr. Holt's activity
and, if necessary, issue a restraining order to keep him away from Ms. Shen and her clients.
Ms. Shen is a kind, respectful, considerate neighbor and makes sure her clients are not disturbing or
disrespectful to her neighbors on either side. Why is Ms. Shen being punished for her neighbor's crazy,
unsupported accusations that cannot be proven by any witnesses?

I am a parent of a child who takes flute lessons from Ms. Shen Liu. I have read the June 12, 2011 letter complaint filed
by Mr. Holt as well as the City's Conditions of Approval for the Administrative Permit No. 11-014. In support of Ms. Liu, I
would like to respond to both of these documents.
Personal Ex erience
Initially, please know that Ms. Liu is a very sweet and courteous young women. She is a teacher, and her students are
children. The people who come to Ms. Liu's home are parents and children. Ms. Liu teaches children flute and piano;
she does not teach rock band musicians. She provides an invaluable service to the community where music has largely
been eliminated from school instruction. In every town there are, thankfully, music teachers who provide student
lessons in their homes under identical circumstances, and undoubtedly there are academic tutors who operate in the
same manner. If these teachers are regulated out of business, those who will suffer the most are our children.
Over the last seven (7) months, I have had the pleasure of bringing my daughter to Ms. Liu's home for a flute lesson one
time per week on Saturday afternoons. During our initial interview with Ms. Liu, she asked me to park on the side of
the street opposite from her home and to be particularly careful not to block any driveways and to be respectful of her
neighbors. I have always complied with Ms. Liu's request as have the other parents whom I have observed brining their
children to and from lessons either before or after my daughter's lesson. Due to occasional scheduling conflicts, I have
brought my daughter to Ms. Liu's home at other times and on other days of the week. At no time have I ever observed
any student or parent of Ms. Liu's sitting in their cars blowing exhaust onto any of Ms. Liu's neighbors' properties. Nor
have I ever observed any of Ms. Liu's students or their parents yelling, playing music loudly in their cars, beeping car
alarms or throwing garbage of any kind onto any properties in the area. Based on my personal experience, the picture
Mr. Holt paints is simply untrue.
Mr. Holt's letter
While I have no personal knowledge of the events Mr. Holt describes in his letter, I would like to comment on his
omissions, which I'm sure you also noticed. With regard to the vulgar incident he describes, Mr. Holt provides no
objective verifying information to substantiate his claim. He fails to report a date or time of the incident nor any
identifying information such as the names of the individuals involved, their license plate numbers, or verification that in
fact a student or parent of a student of Ms. Liu's was involved. He fails to reference police incident report numbers.

His statement that "All of the kids & rents routinely dump their garbage in front of my house and I've taken some
pictures of the problem" is patently offensive and false. I have never dumped garbage in front of anyone's home nor
anywhere other than in a proper receptacle. In fact, my daughter and I participate every year in the Back Bay Cleanup
picking up other people's garbage to keep our Bay and the City of Newport Beach clean. I find it very curious that Mr.
Holt says he is sending pictures but failed to include them with his letter. Perhaps there are inconsiderate individuals
who dump garbage on his lawn, but I would highly doubt that such individuals are the mothers, fathers and children who
travel to Ms Liu's home for music lessons.
Administrative Permit Conditions
With all due respect, the conditions of approval of Ms. Liu's permit seem to be arbitrary. There is no citation to any
municipal code ordinance, state statute or other applicable law to support the conditions of approval. How did you
determine that there shall only be one student per class session? (What about siblings, and are you going to eliminate
any possibility of a child learning to play a duet?) On what basis did you determine that there must be a 15 minute
interval between music lessons? Are the same conditions always imposed upon teachers who provide academic tutoring
in their homes? Where in the City of Huntington Beach municipal code do you find authority for such regulations? How
can the City truly impose a restriction on a homeowner's right to open and close their doors? How can subsection (f)
possibly be enforced as written? What constitutes waiting outside the dwelling before and after a lesson? How many
minutes is "waiting", 3, 5, 10, 30 seconds? What if you were taking your son or daughter for a music lesson and your
spouse called on your cell phone to tell you that a close relative passed away and to report the funeral arrangements. If
this conversation lasted 10 minutes before your child's lesson, would you conclude that Ms. Liu had violated her
conditions of approval? Hopefully you can see that the conditions are in fact arbitrary and impose unreasonable
restrictions upon both Ms. Liu and her students and that the conditions cannot possibly be enforced.

Our children are students of Ms. Shen Liu, who is the subject of a complaint letter submitted by her neighbor, Mr. Holt. I
personally, have not encountered or had any interactions of any kind with Mr. Holt. I feel badly he has experienced such
a stressful situation as outlined in his letter and would hope that whoever these parents are realize they are making life
difficult not only for Mr. Holt, but for the majority of Ms. Liu's clients who are respectful and conscious of their
presence while attending her music instruction. While I assume there must be some truth to Mr. Holt's complaints, I think
it would be any observer's opinion that what he has described is definitely not the general behavior of all of Ms. Liu's
students' families. In other words, I think we've all been painted with one brush by Mr. Holt.
Ms. Liu is one of the most intelligent, respectful, soft-spoken and kind individuals I've ever met. Of the parents I've gotten
to know who have students attending her instruction, I cannot conceive of any of them behaving in ways described by
Mr. Holt. Most of us are parents who placed our children in her instruction to add to their childrens' educational
foundation, who have high aspirations for our children to reach goals that include contributions to society at large and to
teach them to give back to their community. I can say that without a doubt, her teachings are part and parcel to our
children's outstanding academic performance, which ultimately contributes to local schools' test scores, which drive the
funding for our public schools.
For my part, if I am doing a drop-off, I park briefly in front of Ms. Liu's home, not in front of Mr. Holt's, my child exits the
car and I leave immediately after they enter her home. For the times that I do stay for a given lesson, I make sure I park
in Ms. Liu's driveway or in front of her house, turn off the car and go directly into her house, never stepping foot on Mr.
Holt's property or sitting in my car with the engine running or radio blaring. I can't imagine why anyone would feel the
need to leave their engines running or allow their children to run around in anyone's yard that is not their own. So if this
is the case, I would like to directly confront those parents as well to ensure we are all on the same page--I don't want
one set of parents making things difficult for the rest of us.
I would like to congratulate Mr. Holt's son on making the baseball playoffs with Robinwood Little League; this is an
outstanding accomplishment I'm sure he is very, very proud of. My son also plays in Robinwood Little League and I would
ask Mr. Holt to give serious consideration to the idea that the residents who live around the Robinwood Little League
fields must feel much like he does year round while baseball parents and their extended families come and go, parking
wherever they can, in the surrounding neighborhoods, talking and slamming car doors or setting car alarms without
thinking about how it may affect those living in the nearby homes. I would ask Mr. Holt how he would feel were he to be
accused of egregious behavior carried out by others as he's described, or worse, be instructed to park a long distance
away every time to attend practices or games when the park's parking lot is filled to capacity. I am fairly certain he or his
family members have had to park in the nearby neighborhood at a very early hour to attend a Robinwood game. I don't
know about Mr. Holt, but I would be seriously bummed out if the city told me I couldn't park there anymore because a
resident complained about behavior I personally did not indulge in and directed me instead to park a distance away and
haul all my son's equipment and such to the field(s). This hypothetical situation would be inconvenient at best and
dangerous at worst.
The bottom line, is we live in an urban area where people come and go all the time. In addition, Nassau Street is a very
busy street due to the nearby daycare and private schools situated on Clark Drive and because it is one of the main
streets running through that specific neighborhood. It seems an overstatement to claim that Ms. Liu's clients are adding
so much more traffic to this street as to warrant such strict conditions that apply to her and her alone. I would also be
curious to know how Ms. Liu's other neighbors feel about her clients. If we are impeding on more than just Mr. Holt's
verything I can to not cause harmliving situation, I personally want to *w this as I would want to ensure I am doing e0
or disruption to them or their property. Has anyone asked them?
I would like to see us all have a meeting with Mr. Holt and a city representative to discuss his concerns so that we may
achieve conditions that satisfy everyone, as opposed to the city reacting with harsh conditions placed upon Ms.
Liu without full information or research to Mr. Holt's generalized complaints against all of her clients. I think a peaceful
and satisfying resolution can be reached if we all sit down and listen and try to work out a solution rather than dole out a
punishment. If there are parents who are as confrontational as Mr. Holt has described, then perhaps a case-specific
solution needs to be made for/with them, outside of an agreement reached for the majority of her clients. Would this be
possible?

I am not entirely sure which conditions you are referring to which would result in the potential failure of your business.
Most, if not all the conditions, were crafted according to your project narrative. The only condition that may have a
major bearing on your business is related to the 15 minute commencement time from one session to next. This was put
in place to ensure that the amount of vehicular traffic is minimized. Keep in mind that it is not the intention of the City
to hamper the success of your business, but the City has an obligation to inject protection measures to ensure that
surrounding property owners are not negatively impacted. The City received a couple of complaints from members of
the public related to this fact. As the Huntington Beach Zoning and Subdivision Ordinance states, "a home occupation
permit shall not increase pedestrian or vehicular traffic in the neighborhood". Therefore, these condition are needed to
ensure that the dynamics and characteristics of a single-family neighborhood are maintained.
Although, I am looking to act on this application today, I can postpone the City's action until after you return from your
trip. I can use this email as an official request to put the application on hold. Following your return, please provide me
with a response to these conditions by July 11th for possible action by the City on July 12`h. Please call or email me

An example of what I deal with on a daily basis are 5-1 Oparents of kids taking 1/2 hour lessons sit in front of my house with their car
engines running with the exhaust fumes coming directly into my house, the waiting people in front of my house play loud music, allow
siblings to scream & play on my lawn, speak loudly on their cellphones in front of my front door, constant beeping of car alarm horns
when cars when arriving & leaving every 20-30 minutes. As I told you when we spoke, the police have been called 3 times, the last
incident about a month ago when I politely asked a 40 something woman parked in front of my home, if she would please turn off her
car engine while waiting because the exhaust from her car was going right into my house. Not only did the woman tell me "you don't
own the street", "your house is a piece of shit so why do I care what you think" and "I called my husband and he's coming here to kick
your ass". Then she told me in front of my 10 year old son "go fuck yourself', so I went to Shen and asked her if she would please ask
her client if she would be nice enough to turn off her car engine while waiting for her lesson and she refused to. I called the police desk
to ask if a B/W car was in the area because the woman told me her husband was on his way to "kick my fucking ass" and while on the
phone, this nasty woman's husband came screeching around the corner doing about 40-50, stomped on the gas, then swerved towards
me and screeched his tires next to where I was standing next to the curb. He jumped out screaming "I'M GOING TO KILL YOU
MOTHER FUCKER", at which time my son started crying and I was preparing to defend myself. I took the phone away from my ear
and told this psycho that the cops were on their way and everything he said was being recorded by the HBPD. He then walked away
from me and a minute later 2 BM cars arrived. So now these same 2 nasty people park in front of my house with their car engines
running but nobody is inside of them, just to piss me off. Not wanting a repeat of the incident last month, I didn't confront them, but the
next time I most assuredly will.
Sunday mornings Shen has students arriving at lam, so again, my son is woken up on the one day he gets to sleep in by beeping car
alarm horns and kids yelling with no respect for anyone else. I don't have an issue with Shen's music, but enough is enough and my

I'm not happy with a solution of having kids dropped off in front of my house and the only solution I can see that will reduce the noise &
traffic is to have Shen's students park either in the Von's parking lot and walk 1 block to Shen's house or have the parents park over at
the Meadowlark school parking lot on Clark Ave. and walk their children 150ft to Shen's house. Those to choices will greatly reduce
the impact to the peace & quiet that my family should enjoy and it will make sure that there won't be any other violent incidents with
Shen's rude clients.

This is a typical event that happens everyday in front of my house.
The van in the driveway has a parent waiting to p/u a kid, the van in the street is dropping off a kid and the
other SUV in front of my house has an engine running waiting for their lesson. I realize this may not look like
a big deal, but I have to deal with multiple alarm horns every 20-30 minutes, car engines running, car doors
slamming in front of my front door every 20-30 minutes and this is without the rude people talking on

Gentlemen:
Pursuant to Section 241.24 of the Huntington Beach Zoning and Subdivision Ordinance, I wish to
speak to the Neighborhood Notification as part of the proposal for Shen's Studio, where private,
one-on-one music instructions for piano and flute are given. I live directly across the street from
Shen's Studio and I wish to add my support for this venture, based on the following four points;
noise (sound), vehicular traffic congestion, pedestrian traffic congestion and public service for the
arts.
NOISE (SOUND)
As the flute and piano are not bombastic instruments, I never hear the music/practice in cool
weather as the Studio's windows are closed, even though the house is directly across from mine
and I am standing in my driveway. During warm weather times when the front windows of
Shen's Studio are open, I cannot hear any sounds from her house while I'm inside my house.
While out in front, I do hear either the piano or flute as the students take their lessons. However,
as Shen only teaches the classics, the slight sounds I hear are not offensive, indeed sound
soothing. So noiselsound from the Studio is not an issue.
VEHICULAR TRAFFIC CONGESTION
As students come and go to the Studio, traffic does increase. However, the maximum additional
cars at any one time is two , occurring as one student leaves a lesson and another student arrives
for the lesson. We're fortunate that VERY few home owners park their cars on Nassau Lane, so
there is always parking space at the curbs. And for the usual half hour lesson, there's never more
than two cars parked at the same time. More often than not, if a student's car is parked in front
of the Studio, the arriving student's car is pulled into the Studio's driveway to let out the student.
And most of the times, the student's driver merely drops off the student for the lesson and returns
for pick up when the lesson ends. Therefore, vehicular traffic congestion is a non-issue.

PEDESTRIAN TRAFFIC CONGESTION
The pedestrian traffic entails usually the student or the student and a parent as he/she or they,
walk from/to the parked car, and to/from the Studio. The time element here is very short so
pedestrian congestion isn't evident.
PUBLIC SERVICE TO THE ARTS
With our school systems having been financially battered over the years, the arts have all but
vanished from our schools. It is very evident that music is a large part of our societal desires, and
any institution that offers quality music instruction is certainly a benefit for the public as a whole.
And with the kind of music that Shen's Studio advocates - the classics - our community will
continue to grow in its appreciation of the fine arts.
For reasons stated in these four points, I encourage the City of Huntington Beach to approve the
proposal of Shen's Studio.

to Section 241.24 of the Huntington Beach Zoning and Subdivision Ordinance, the Neighbor-
hood Notification process is required. You may review the proposed plans at the Planning De-
partment, 2000 Main Street, Huntington Beach, CA, from June 1, 2011 to June 14, 2011, or
contact the Planning Department at (714) 536-5271. All comments must be submitted to the
Planning Department prior to the expiration date for review of the proposal.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Director of Planning becomes final, unless appealed. A person desiring to appeal
the decision shall file a written notice of appeal with the Planning Department within ten calen-
dar days of the date of the Planning Department's action. The notice of appeal shall include the
name and address of the appellant, the decision being appealed, and the basis for the appeal. A
filing fee shall also accompany the notice of appeal. The appeal fee is $494.00. The appeal peri-
od starts at the end of the 10-day review period.

230.12 Home Occupation in R Districts
A. Permit Re uired. A home occupation in an R district shall require a Home Occupation
Permit, obtained by filing a completed application form with the Director. The Director shall
approve the permit upon determining that the proposed home occupation complies with the
requirements of this section.
B. Contents of A lication. An application for a Home Occupation Permit shall contain:
1. The name, street address, and telephone number of the applicant;
2. A complete description of the proposed home occupation, including number and
occupation of persons employed or persons retained as independent contractors, amount
of floor space occupied, provisions for storage of materials, and number and type of
vehicles used.
C. Re uired Conditions. Home occupations shall comply with the following conditions:
1. A home occupation shall be conducted entirely within one room in a dwelling. No
outdoor storage shall be permitted. Garages shall not be used in connection with such
business except to park business vehicles.
2. No one other than a resident of the dwelling shall be employed on-site or report to work
at the site in the conduct of a home occupation. This prohibition also applies to
independent contractors.
3. There shall be no display of merchandise, projects, operations, signs or name plates of
any kind visible from outside the dwelling. The appearance of the dwelling shall not be
altered, or shall the business be conducted in a manner to indicate that the dwelling or its
premises is used for a non-residential purpose, whether by colors, materials, construction,
lighting, windows, signs, sounds or any other means whatsoever.
A home occupation shall not increase pedestrian or vehicle traffic in the neighborhood.
5. No commercial vehicle or equipment used in conjunction with the home occupation shall
be parked overnight on an adjacent street or in any yard visible from the street.
6. No motor vehicle repair for commercial purposes shall be permitted.
7. A home occupation shall not include an office or salesroom open to visitors, and there
shall be no advertising of the address of the home occupation.
Neighborhood Notification shall be in compliance with Chapter 241 when a home
occupation involves instruction and/or service, e.g. music lessons, beauty shop,
swimming lessons. Where a home occupation involves swimming instruction in an
outdoor swimming pool, each swimming class shall be limited to 4 students, and no more
than 2 vehicles shall be used to transport students to such classes. (3710-6/05)
9. Any authorized City employee may inspect the premises of a home occupation upon 48
hours notice to ascertain compliance with these conditions and any requirements of this
code. The permit for a home occupation that is not operated in compliance with these
provisions shall be revoked by the Director after 30 days written notice unless the home
occupation is altered to comply.
