Included in this letter are the Conditions of Approval. for this appl ^ ation. Under the provisions of the Huntington Beach Zoning and Subdivision. Ordinance, the action taken by the Planning Director is final unless an appeal is filed to the Planning Commission by you or by an interested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Two Hundred Dollars ($200.00) if the appeal is filed by.a single family dwelling property owner appealing the decision on his own property and Six Hundred Ninety. Dollars (*'690.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Planning Director's action. The property owner shall sign, notarize, and record with the County Recorder a covenant` restricting the number of dwelling units on site to the five (5) existing units. The covenant shall be submitted a minimum of 4.5 days prior to building permit issuance for approval by the Planning Department and City Attorney as to form and content. Upon approval, the covenant shall be recorded in the Office of the County Recorder. Prior to building permit final, a copy of the recorded covenant shall be filed with the Planning Department. The existing water service and meter serving the site may potentially be utilized if they are of adequate size, conforms to current standards, and are in working condition as determined by the Water Division. If a new water service or meter is required, it shall be installed per 'Water Division standards and sized to meet the minimum requirements set by the Uniform Plumbing Code (UPC) and. Uniform Fire Code (UFC), and a backflow prevention devi";e shall be installed per Water Division standards. (P )ND Address numbers will be installed to comply with City Specification No. 428. (FD) . Only the uses described in the narrative submitted shall be permitted. 6. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed. as a result of the plan check process. Building permits shall not be 'issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the approval and the conditions herein. FINDINGS FOR PRO,EGTS EXEMPT FROM CEOA: The. Planning Director finds that the project will not have any significant effect on the enviromnent and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to. Section 15301, Class 1 of the CEQA Guidelines, because it involves minor alteration to an existing facility involving no expansicn of use and no net increase in the number of dwelling units from that currently existing. FINDINGS FOR APPROVAL - INITIAL PLAN AND ZONING REVIEW NO. 99-9: Initial Plan and Zoning Review No 99-9 for the interior remodel to. convert an existing recreation room into a new studio dwelling unit and combine two existing dwelling units on the 2Udfloor into one two-•edroom dwelling unit will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the, property and improvements in the neighborhood. The proposal only involves interior remodel and inc project will maintain a maximum of five (5) dwelling units as currently existing. It will remove the illegal use of the recreation room as a sixth dwelling unit which is not permitted 2. The conditional use permit will be compatible with surrounding uses because the use of the subject development as a multi-family residential complex will not change. The number of dwelling units (five) and building footprint and bulk will not be altered. 3. The proposed ulterior remodel will comply with the provisions ofthe base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located because there- will be no change in density, building footprint anii height, as well as parking requirements. Open space requirements are provided for the recreation room converted to a dwelling unit. CONDITIONS OF APPROVAL - INITIAL PLAN AND ZONING REVIEW NO.: 99.9„ 1. The site plan, floor plan, and eievations received and. dated December 13,1999 shall be the conceptually approved- layout. 2. Prior to'submittal for building permits, the following shall be completed' IPZR No. 99-9 Page No. 3 a. (FD). Prior to issuance of building permits, the following shall be completed: a. The property owner shall sign, notarize, and record with the County Recorder a covenant restricting the number of dwelling units on site to the five (5) existing units. The covenant shall be 'submitted a minimum of 45 days prior to building permit issuance for approval by 'the Planning Department and City Attorney as to form and content. Upon approval, the covenant shall be recorded in the Office of the County Recorder. Prior to building pet, final, a copy of the recorded covenant shall be f led with the Planning Department. 4.. Prim to final building permit inspection and approval (occupancy ), the following shall be completed: a. The applicant shall submit a cony of the covenant required under condition 3(a). b. The existing water service and meter serving the site may potentially be utilized if they are of 'dequate sized conforms to current standards, and are in working condition as determined by the Water Division. Initial Plan and Zoning Review No. 99-9 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department, a minimum 30 days prior to the. expiration date, 3. ThePlanning Director reserves the right to revoke Initial Plan and Zoning Review No 99-9, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable Public Works fees shall be paid. (PW) 5. Traffic Impact Fees shall t,.r paid at the time of final inspection or issuance of a Certificate of Occupancy. (P 6. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 7; Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shallbe prohibited Sundays and Federal holidays.
