1.0 SUGGESTED ACTION:
Deny Limited Sign Permit No. 90-5 with findings.
2.0 GENERAL INFORMATION:
Limited Sign Permit No. 90-5 is a request for a two year extension of
time for an existing non-conforming pole sign pursuant to Section
9610.8(c) of the Huntington Beach Ordinance Code. The sign is
sixty-four (64) square foot in size and twenty (20) feet in height, as
opposed to the allowed fifty (50) square foot and seven (7) foot tall
sign.

ISSUES AND ANALYSIS:
Pro'ect Descri tion:
The applicant is requesting a change of face to an existing
non-conforming pole sign and that the sign be permitted to remain on
site for a maximum of two (2) years,
The 64 square foot sign is approximately 20 feet tall. Section
9610.5(b;) of the Huntington Beach Ordinance Code states that sites
with less than 400 feet of frontage are permitted one seven (7) foot
tall monument sign with a maximum area of 50 square feet.
Section 9610.8(c) allows the life of a non-conforming sign to be
permitted "for a time period deemed appropriate, not to exceed two
(2) years" subject to the following findings:
1. Due to unique circumstances, the sign's immediate removal
will result in a substantial hardship for the applicant.
2. The sign will not adversely affect other lawfully erected
signs in the area.

3. The sign will not be detrimental to properties located in the
vicinity
4. The sign will be in keeping with the character of the
surrounding area.
5. The sign will not obstruct vehicular or pedestrian traffic
visibility and will not be a hazardous distraction.
b. Anal sis of Findirg
(1) The application presents no "unique circumstances" which
would result in "a substantial hardship for the applicant"
if the sign were to be removed. The face change is for a
new tenant to enter the building . The applicant feels
that by approving Limited Sign Permit No. 90-5 the sign
would give them the exposure they need to begin business
at this location . The applicant has already placed signs
on the front and north side of the building. In addition,
the applicant would be permitted a freestanding monument
sign (50 square feet). The removal of the pole sign would
therefore , not result in a substantial hardship to the
applicant . Findin I cannot be made.
(2) The sign will not adversely affect other lawfully erected
signs in the area because the sign has been in this
location for a number of years and is not proposed to be
enlarged. Findin 2 can be made.
(3) The sign will not be detrimental to properties in the
vicinity since it was originally constructed many years
ago and is not proposed to be enlarged.
(4) The sign will be in keeping with the character of the
surrounding area because there are a number of existing
pole signs in the area, however when the businesses at
these locations change , these signs will be required to be
brought into compliance with the sign code. Findin 4 can
be made.
(5) The sign is approximately five (5) feet back from the
sidewalk , directly adjacent to the drive aisle therefore,
the sign is located within the site angle which obstructs
views for vehicles entering or leaving the site. Finding
5 cannot be made.
In summary, two of the five necessary findings for granting of a
Limited Sign Permit cannot be made . Specifically , the hardship
finding and the safety finding cannot be made. Given the
significance of those findings , staff cannot support the requested
Limited Sign Permit.

10.0 RECOMMENDATION:
Staff recommends that the Planning Commission deny Limited Sign
permit No. 90-5 with the following findings:
FINDINGS FOR DENIAL - LIMITED SIGN PEhL.T NO. 90-5:
1. Strict compliance with Article 976 will not result in a
substantial hardship to the applicant, because a 50 square foot
seven (7) foot tall would be permitted.
2. The existing sign at 19131 Brookhurst may obstruct pedestrian or
vehicular traffic vision.
11.0 ALTERNATIVE ACTION:
The Planning Commission may approve Limited Sign permit No. 90-5
with alternative findings and conditions of approval.
