FINDIN FOR DENIAL: 1. Because of the size, configuration, shape and lack of unique topographic features of the subject property, there does not appear to be exceptional or extraordinary circumstances or conditions applicable to the land, buildings or premises involved that does not apply generally to property or class of uses in the same district. 2. Since the subject property can be fully developed within regular established setbacks, such a conditional exception is not necessary for the preservation and enjoyment of substantial property rights. 3. The proposed structure will not be compatible with adjacent properties. 4. The establishment, maintenance and operation of the use will be detrimental to the general welfare of persons working or residing in the vicinity. 5. The establishment, maintenance and operation of the use will be detrimental to the value of the property and improvements in the neighborhood. 6. Although the property is irregular in configuration, the size of the lot satisfies the minimum size of 6,00 0 square feet and exceeds the minimum frontage of sixty (60) feet. 7. Granting of Conditional Exception (Variance) No. 88-_ would constitute a special privilege inconsistent with limitations upon properties in the vicinity. 8. The subject property was legally subdivided and developed in a manner consistent with applicable zoning laws. 9. Exceptional circumstances do not apply that deprive the subject property of privileges enjoyed by other properties in the same zone classifications. 10. Encroachment into the required setback is not compatible with setbacks established for properties to the (North) (South) (East) (West) and would constitute a special privilege inconsistent with limitations upon those properties. 11. Property and improvements in the vicinity of such use or building. 2. The granting of the will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. Granting of reduction in open space minimum dimension and minimum open space area will not reduce the required total open space area (900 Square Feet). 5. Because of special circumstances applicable to the subject property , including size , shape, topography , location or surroundings , the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 6. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Community Development and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. Landscape and irrigation plan to the Departments of Community Development and Public Works for review and approval. Said landscape plan shall include one (1) fifteen gallon tree per landscape pocket area adjacent to north property line, two (2) twenty-four inch box trees in front yard area, and one (1) fifteen gallon tree in each private yard area. 6. Installation of regvir''d landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 7. Special architectural treatment shall be provided on all building walls. Such treatment is subject to approval by tre Department of Community Development/Design Review Board. 8. A planned sign program shall be approved for all signing. Said program shall be approved prior to the first sign request. 9. On-site fire hydrants shall be provided in numuer and at locations specified by the Fire Department. 10. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 11. Service roads and fire lanes , as determined by the Fire Department , shall be posted and marked. 12. Fire access lanes shall be maintained . If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 13. Maximum separation between building wall and property line shall not exceed two inches (2"). 14. Applicant shall pursue CalTrans approval of radius type driveways on Beach Boulevard. 15. Driveway approaches shall be a minimum of twenty-seven feet (271) in width and shall be of radius type construction. -7- (0124D) ni 16. Driveway on Beach Boulevard shall have a minimum width of thirty feet (30'). i7. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 18. All repair work shall be conducted wholly within the building. 19. The site shall be restricted to servicing of automobiles and sale of automobile-related products. A convenience market or "mini-market" shall not be permitted without the approval of a Conditional Use Permit by the Planning Commission. 20. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. 21. Proposed structures shall be architecturally compatible with existing structures. 22. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 23. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 24. Low-volume heads shall be used on all spigots and water faucets. 25. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 26. Prior to issuance of building permits, the subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. 29. Joint use parking shall require that a Joint Use Parking Agreement be recorded between property owners prior to issuance of permits or occupancy. A copy of the legal instrument shall be approved by the City Attorney as to form and Content and, when approved, shall be recorded in the office of the County Recorder. A copy shall be filed with the Department of Community Development. -8- (0124D) 30. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) duelling unit, 31. The developer shall contact FAA prior to issuance of building permits. 32. All applicable Public Works fees shall be paid prior to issuance of building permits. 33 The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 34. The applicant shall meet all applicable local, State, and Federal Fire Codes, ordinances, and standards. 35. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 36. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. 37. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 38. A detailed soils analysis shall be prepared by a registered Sails Engineer. This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 39. All signs shall be brought into compliance with the Huntington Beach Ordinance Code prior to 40.
