Devlin: This letter is in response to your letter received and dated December 10, 1992 in regards to the property located at 17141 Edgewater Lane. On February 6, 1991, the Zoning Admini strator acted upon a request by RMG/The Keith Companies to adjust the property line between Lot 43 of Tract 4880 and Lot 1 of Tract .11881 southward approximately 25 feet. Lot Line Adjustment No. 89-5 was approved by the Zoning Administrator with three findings of fact and three conditions of approval. Lot Line Adjustment No. 89-5 was recorded with the County Recorder on May 21, 1991. The recorded Lot Line Adjustment identifies a 5 foot public access easement L o the south of the subject property. The Huntington Leach Ordinance Code does not require a public hearing for a Lot Line Ad_ustment. On January 16, 1.991., the City Attorney's office rerz.°1ered a decision regarding the processing of a Lot Line Adjustment in lieu of a Tentative Tract Map, Based on this opinion, a Lot Line Adjustment was processed and approved by the Zoning Administrator on Febr-uary 6, 1991 as previously stated. I have included a copy of this opinion for your review. As you indicated in your letter, a building permit, was issued : o TFWF Construction on Decemoerr 4, 1992 for 85 feet of 6 foot high block wall. This information was given to you on December 4, 1992 by Construction Permit Aid, Gloria Gitsham. The Building Permit is a valid permit and does not require any additional approvals. A Coastal Development Permit is required for additions to the dwelling which exceed 1.00 of the floor area. A public hearing is required for a Coastal Development Permit prior to any action by the City of Huntington Beach. Request for Lot January 16,. 1991 Line Adjustment LL89-5 an Land Situated within Huntington Harbour Specific Plan QUESTION: Does a lot line adjustment fall within the provisions of Section IV of the Huntington Harbour. Say Club Specific Plan which requires a tentative tract map to be filed for any development proposal? ANSWER: FACTS: Mr. Ferydoun Ahadpour and William Lansdale contiguous land owners reached an agreement whereby Mr. Ahadpour agreed to grant to Mr. Lansdale a '.p of land 25 feet by 100 feet adjacent to Mr, Lansdale's property (see map attached). Both parties signed the application for the lot line adjustment. Mr. Ahadpour's property lies within the Huntington Harbour Bay Club Specific Plan. Mr, Lansdale's property does not, ANALYSIS : Section IV of the Huntington Harbour Bay Club Specific Plan reads follows: Title 9 does not define development or project Under the California Environmental Quality Act., project is defined in California Public Resources Code §21065 (c)which states: "Activities involving the issuance to a per son of a lease, permit, license, certificate, or other entitlement for use one or more public agencies." e section of the specific plan? The Huntington Beach Ordinance Code "APPLICATION PROCEDURE w..Any request for a development pro shall be accompanied by an application for a Conditional U Permit. Any request for subdivision or subdivision Of any parcel shall also be accompanied by a Tentative Tract Map. Does the proposed lot line adjustment requested fall tinder this by Page Two Re: Opinion January 16, 1991 It appears that, by any interpretation of the term development project, treat a lot line adjustment is not a development project. Nothing is constructed and there is no development. If either party desires development, the party must have an additional application for the development independent of the lot line adjustment. The specific plan requires a tentative tract map for subdivision or resubdivision, This is neither a subdivision or resubdivision sine: by definition, a subsdivision or resubdi%ision changes the number of lots in the subdivision. A lot line adjustment does not change the number of lots in either existing subdivision. CONCLUSION: For the aforementioned reasons M. Lansdale's lot line adjustment application should be immediately processed thr ugh the Zoning Administrator pursuant to HuntingtonBeac ode §9811.31 since it is not subject to the Huntington Harbour Specific Plat. I personally came into the office of the Planning 1, -partmcn1: on Wednesday, December 2 and Thursday, December 3, and spoo :c to Mile Strange sn the Planning Department and told him that I believed that there was a land trust easement for the State of California for the parking lot property on Edc ewater° Lane belonging to the Huntington Harbour Bay Club and Marina. (Please 5t e the enclored photocopy of the letter from the State Lands Commission dated November 6, 1992 signed by Curtis L. Fossum--which you have previously received.) On Thursday, Mr. Strange told me that he had checked with Mr. Mike Adams and Mr. Adams had confirmed that there was a Land Tr- st Easement on the parking lot but that no permits had been asked for or issued on that property. I told him I wanted to be apprised if a permit was issued and I would come down to the City for a copy of same, Mr= Strange assured me that he would call rne if a permit was issued. On Friday, December 4 earth moving equipment was delivered to the site and after calling the, City I found out that apermit was issued late on Friday, December 4 . To date in spite. of several --phone calls to Mr. Mike Strange I have not had the courtesy of <„ reply from him in, spite of his promise to me. I am enclosing for your perusal a copy of a Lot Line Ad.!ustment requested by the Keith Co. (taken from city files ) on Jan. 30, 1991 and heard F eb. 6, 1991. Neither myself or any of my neighbors were notified of this bearing i On August 27, 1991 there was filed at the Orange County Recorder's office a Quit Claim Deed for valuable consideration to Mr. Lansdale by Mr, Ahadpour, for a twenty-five foot portion of the parking lot on Edgewater Lane (the northern part of same adjoining Mr. Lansdale's residence at 171.11 Edgewater Lane (a photocopy of same is enclosed.) The City accepted this new twenty-five font wide parcel that I believe has a State Lands Trust Easement on it as a "Lot Line Adjustment. " (Photocopy of same enclosed.) On or about December 2, 1992 , Mr. Landsdale allegedly sold his risi.dencc at 17141 Edgewater Lane (including the additional parcel from Mr . Ahadpour , supp ,-redly) to a Mr. & Mrs. James Watson who, have moved i n already . IOn my last visit tc.- <e Orange County Recorde r 's Office this last transaction ha,-l not been recorded.) On Wednesday, Dec. 9 1992 I spoke to Curtis Fossum of the State Lands Commission and he asked that all papers be sent to him imrneoiately. He said that he believes that the land in question has a State Lands Trust Easement on it. He also told inc that he believes that the complete walkway around the boat marina has been dedicated to the State and that the new owner, Mr. James Watson, has no right to the land dedication. Mr. Fossrcrra also went on to say that this was not really a "Lot Line Adjustment. " This was a "Lo: Extension. " From the papers it also appears to me that the pierhead line has been changed. Mr. Fossurz went on to tell me that he is going to contact thn. Coastal Corr mis lion right away as he believefi that Coastal Permission is needed for any eonstruc.fton on t;lzi.s piece Of property. Box 190 Huntington Beach CA 92648 Dear Mr. Uberuaga: SUBJECT: Huntington Harbour File Ref.: W 24642 AD 162 Huntington Beach LCP The purpose of this letter is to clarify certain questio fis which have arisen regarding public ownership interests within Huntington Harbour. The State acquired sovereign ownership of all previously trtgranted tidelands, submerged lands, and beds of navigable waterways upon its admission to the United States in 1850. Tidelands are those lands which lie between the lines of ordinary high and ordinary low tide. Submerged lands lie below the line of ordinary log} water as it last naturally existed. The, landward boundaries of the State's sovereign interests are generally based upon the ordinary high water marks (Civil Code §830) of these waterways. as they existed prior to any filling or artificial accretion, and th us may not be readily apparent from present day site inspection. The Public Trust Easement is a sovereign public property right held by the St its delegated trustee for the benefit of all the people. This right is intended for public use of these lands for waterborne commerce, navigation, fisheries, open space, recreation, or other recognized Public Trust purposes. Huntington Harbour is generally adjacent to the Mexican land grant Rancho La Bolsa Chica granted on July 1, 1841 to Joaquin Ruiz by Governor Juan 13. Alvarado, confirmed by the 11S. District Court on February 23, 1857, surveyed by the United States in 1873 and patented by the United States on May 7, 1874. On January 6, 1903, the State patented those tidelands surrounded by Rancho La :llolsa Chica, pursuant to Tide Land Location 221 (TLL 221), to R. J. Northam. The waterward boundary of the rancho lands and landward boundary of the tidelands is the ordinary high water mark. On December 22, 1960, the State Lands Commission entered into a boundary line agreement (BLA 18) with the Huntington Harbour Corporation which established, pursuant to Public Resources Code §6357, the ordinary low-water mark of certain portions of Anaheim Bay. That agreement established the boundary betwee:ii lands sold by the State pursuant to TL L 221 and the unsold submerged lands located within the perimeter description of TL L, 221. At the same time, the State Lands Commission and the Huntington Harbour Corporation exchanged certain fee owned lands but, again, did not extinguish the Public Trust easement over the patented tidelands. More recently, as a result of an ownership dispute, on July 15, 1991, the State Lands Commission authorized a compromise title settlement agreement with Destiny 11, a California general partnership, concerning ownership of approximately 1.7 acres of real property within Huntington Harbour. In reaching. this agreement , the State Lands Commission found that the property had been filled and reclaimed since the 1960s, and was no longer available or useful for Public Trust purposes. The agreement provided that the State would convey all i ts right, title, and interest and would terminate the Public Trust interest in the property in exchange for Destiny 11 depositing the sure of SOO,00 l into the Kapiloff Land Bank Fund for future purchase of land: for trust purposes in the area. Huntington Harbour is located within the California Coastal Cornmission's original permit jurisdiction as depicted on "red line" maps provid~ , by the SLC. 'lhrerefore, the SLC should be consulted on any future projects in or adjacent to Huntington flarbour and within the "red line" maps. If you have any questions, please feel free to give me a call. Mr. Lansdale has not received a copy of that letter from me but I verbally told both Mr. & Mrs. Lans3ale that it was the position of the State Lands Commission that there was a Land Trust Easement on the Huntington Harbour Bay lv Marina property and I also informed them that the plaintiffs in our lawsuit had been offered $150, GOO by the title insurance company to drop only that part of the suit and that we refused. I also told Mr. Lansdale about the letter from ,ur predecessor at the Los Angeles office of the Attorney General, dated September 6, 1991 and addresstm>d to Patricia Snyder--the letter from Deputy Attorney General Robert Collins, I read him the last paragraph on,page 7 of that letter and he gave me a reply which I do not want to repeat here but he made the remark in the presence of my husband and Mrs. Klar.in, my next door neighbor, (At that time none of us knew that Mr. Lansdale had purchased any property from Mr. Ahadpo'ir. ) While looking for Mr. Collins letter I came ac,rrsss a recording by the Coastal Commission (photocopy enclosed) dated 11 -10 -88 and signed by Ferydoun Ahadpour and Doris Ahadpour. On page 2, paragraph 2. indented it states, .. "and that any future development concerning the beach and its shoreline, submerged land or the boat slips in the marina, or other development that is within the Cotntntssh n's primary jurisdiction which is development as defined in Section .3010 of the Coastal Act will require an additional Coastal Development Permit from the California Coastal Commission or its successor agency. Property In Huntington Harbour namely 17141 Edgewater Lane and parking lot adjacent t1 ereto Dear City Administrator and Members of the City Council: This letter is to inform you that I hereby oust the issuance of a building permit for a hlockwall to be constructed at 17141 Edgewater lane--25 to 35 feet from the e5eisting home an the lot and extending into the "lit" on the parking lot space of the Huntington Harbour Bay Club and Marina. ,.. personally came into the office of the Planning Department on Wednesday, December 2 and Thursday, December 3, and spoke to Mi ke Strange in the Planning Department and told him that I believed that there was a land trust easement for the State of California for the parking lot property on J dgewater Lane belonging to the Huntington Harbour Bay Club and Marina. (Please see the enclosed photocopy of the letter from the State Lands Commission dated November 6, 1992 signed by Curtis L, Fossum--which you have previously received.) On Thursday, Mr. Strange told me that he had checked with Mr. Mike Adams and Mr. Adams had confirmed that there was a Land Twist Easement on the parking lot but that no permits had been asked for or issued on that property. I told him I wanted to be apprised if a permit was issued and I would come down to the City for a copy of same. Mr. Strange assured me that he would call me if a permit was issued, On Friday, December 4 earth moving equipment was delivered to the site and after calling the City I found out that a permit was issued late on Friday, December 4 . To date in spite of several phone calls to Mr. Mike Strange I have not had the courtesy of a reply from him in spite of his promise to me. I am enclosing for your perusal a copy of a Lot Line Adjustment requested by the Keith Co. (taken from city files) on Jan. 30, 1991 and heard F myself or any of my neighbors were notified of this hearing? r. `6, 19 91. Neither -2- On August 27, 1991 there was filed at the Orange County Rcecordesr's office a Quit Claim Deed for valuable consideration to Mr. Lansdale by Mr. Aha.dpour for a twenty-five foot portion of the parking lot on Edgewater Lane (the northern part of same adjoining Mr. Lansdale's residence at 171.11 Edgewater Lane (a photocopy of same is enclosed.) The City accepted this new twenty-five foot wide parcel that I believe has a State Lands Trust Easement on it as a "Lot Line Adjustment. " (Photocopy of same enclosed.) On or about December 2, 1992, Mr. Landsdale allegedly sold his ri?sidence at 17141 Edgewater Lane (including the additional parcel from Mr. Ahadpour, supposedly) to a Mr. & Mrs. James Watson who have moved in already. On my last visit to the Orange County Recorder's. Office this last transaction ha l not been recorded. ) On Wednesday, Dec. 9, 1992 I spoke to Curtis Fossum of the State Lands Commission and he asked that all papers be sent to him immediately. He said that he believes that the land in question has a State Lands Trust Easement on it. He also told me that he believes that the complete walkway around the boat marina has been dedicated to the State and, that the new owner, Mr. James Watson, has no right to the land dedication. Mr. Fossurn also went on to say that this was not really a "Lot Line Adjustment. " This was a "'Lot Extension. " From the papers it also appears to me that the pierhead line has been changed, lair. Fossurn went on to tell me that he is going to contact the Coastal Commission right away as he believes that Coastal Permission is needed for any construction on this piece of property. In view of all of the above, I suggest that the City order a stop order on this property until this matter is settled. This letter, of course, is to putyou and the City of Huntington Beach on notice regarding what seems to be a possible problem. I fully intend to follow up on this in all possible forums. Harbour. {e risen regarding The State acquired sovereign ownership of all previously ungranted tidelands, submerged lands, and beds of navigable waterways upon its admission to the United States in 1850. Tidelands are those lands which lie between the lines of ordinary high and ordinary low tide. Submerged lands lie below the line of ordinary low water as it last naturally existed. The landward boundaries of the State's sovereign interests are generally based upon the ordinary high water marks (Civil Code §830) of these waterways as they existed prior to any filling or artificial accretion, and thus may not be readily apparent from present day site i.-is,lection, The Public Trust Easement is a sovereign public property right held by the State or its delegated trustee for the benefit of all the people . This right is intended for public use of these lands for waterborne commerce, navigation, fisheries, open space, recreation, or other recognized Public Trust purposes. Huntington Harbour is generally adjacent to the Mexican land grant Rancho La Bolsa Chica granted on July 1, 1841 to Joaquin Ruiz by Governor Juan B. Alvarado, confirmed by the US. District Court on February 23, 1857, surveyed by the United States in 1873 and parented by the United States on May 7, 1874, On January 6, 1903, the State patented those tidelands surrounded by Rancho La Bolsa Chica, pursuant to Tide Land Location 221 (TLL 221), to B.. J. Northam. The waterward boundary of the rancho lands and landward boundary of the tidelands is the ordinary high water mark. MI. ,v11_ JUL l 1. l 1(1C"I h.;;i (:IN)ll'i O, I .` On December 22, 1960, the State Lands Commission entered into a boundary line agreement (BLA 18) with the Huntington Harbour Corporation which established, pursuant to Public Resources Code §6357, the ,ordinary low-water mark of certain portions of Anaheim Bay. That agreement established the boundary between lands sold by the State pursuant to TLL 221 and the unsold submerged lands located within the perimeter description of TLL 221. At the same time, the State Lands Commission and the Huntington Harbour Corporation exchanged certain fee owned lands but, again, did not extinguish the Public Trust easement over the patented tidelands. More recently, as a result of an ownership dispute, on July 15, 1991, the State Lands Commission authorized a compromise title settlement agreement with Destiny 11, a California general partnership, concerning ownership of approximately 1.7 acres of real property within Huntington Harbour. In reaching this agreement , the State Lands Commission found that the property had been filled and reclaimed since the 1960s, and was no longer available or useful for Public Trust purposes. The agreement provided that the State would convey all its right, title, and interest and would terminate the Public Trust interest in the property in exchange for Destiny 11 depositing the sum of $60,000 into the Kapiloff Land Bank Fund for future purchase of lands for trust purposes in the area. Huntington Harbour is located within the California Coastal Commission 's original permit jurisdiction as depicted on "red line" maps provided by the SLC. I personally ca-me into the i,iffice of the Planning De artmefit on Wednesday, December 2 and Thursday, December 3, and spoke to Mike Strange in the Planning Department and told him that I believed that there was a land trust easement for the State of California for the parking lot property on Edgewater Lane belonging to the Huntington Harbour Ray Club and Marina. (Please see the enclosed photocopy of the letter from the State Lands Commission dated November a, 1992 signed by Curtis L. Fossum --which you have previously received.) On Thursday, Mr. Strange told me that he had checked with Mr. Mike Adams and Mr. Adams had confirmed that there was a Land Trust Easement on the parking lot but that no permits had been asked for or issued on that property. I told him I wanted to be apprised if a permit was issued and I would come down to the City for a copy of same. Mr. Strange assured me that; he would call me if a permit was issued. On Friday, December 4 earth moving equipment was delivered to the site and after calling the City I found out that a. permit vas issued late on Friday, December 4. To date in spite of several phone calls to Mr. Mike Strange l have not had the courtesy of a reply from him in spite of his promise to me. I am enclosing for your perusal a copy of a Lot Line Adjustment requested by t If' -2.. On August 27, 1991 there was filed at the Orange County Recorder's office a Quit Claim Deed for valuable consideration to Mr. Lansdale by Mr. Ahadpour for a twenty-five foot port-ion of the parking lot on Edgewater Lane (the northern part of same adjoining Mr. Lansdale's residence at 17141 Edgewater Lane (a photocopy of same is enclosed.) The City accepted this new twenty-five foot wide parcel that I believe has a State Lands Trust Easement on it as a "Lot Line Adjustment." (Photocopy of same enclosed, ) On or about December 2, 1992, Mr. Landsdale allegedly sold his residence at 17141 Edgewater Lane (including the additional parcel from Mr. Ahadpour, supposedly) to a Mr. & Mrs. James Watson who have moved ii, already, 10n my last visit to the Orange County Recorder's Office this last transaction had not been recorded.) On Wednesday, Dec. 9, 1992 I spoke to Curtis Fossum of the State Lands Commission and he asked that all papers be sent to him immediately. He said that he believes that the land in question has a State Lands Trust Easement on it. He also told me that he believes that the complete walkway around the boat marina has been dedicated to the State and that the new owner, Mr. James Watson, has no right to the land dedication. Mr. Fossum also went on to say that this was not really a "Lot Line Adjustment. " This was a "Lot Extension. " From the papers it also appears io me that the pier"head line has been changed. Mr. Fossum went on to tell me that he is going to contact the Coastal Commission right away as he believes that Coastal Permission is needed for any construction on this piece of property. The State acquired sovereign ownership of all previously ungranted tidelands, submerged lands, and beds of navigable waterways upon its admission to the United States in 1850. Tidelands are those lands which lie between the lines of ordinary high and ordinary low tide. Submerged lands lie below the line of ordinary low water as it last naturally existed . The landward boundaries of the State's sovereign interests are generally based upon the ordinary high water marks (Civil Code §830) of these waterways as they existed prior to any filling or artificial accretion, and thus may not be readily apparent from present day site inspection. The Public Trust Basement is a sovereign public property right held by the State or its delegated trustee for the benefit of all the people . This right is intended for public use of these lands for waterborne commerce , navigation, ff;sheries, open space, recreation, or other recognized Public Trust purposes, Huntington Harbour is generally adjacent to the Mexic Mn land grant Rancho L.a Bolsa Chica granted on July 1, 1841 to Joaquin Ruiz by Governor Juan B. Alvarado, confirmed by the U.S. District Court on February 23, 1857, surveyed by the United States in 1873 and patented by the United States on May 7, 1874. On January 6, 1903, the State patented those tidelands surrounded by Rancho La Bolsa Chica, pursuant to Tide Land Location 221 (TLL 221), to R.. J. Northam. The waterward boundary of the rancho lands and landward boundary of the tidelands is the ordinary high water mark. ivli. MlLltttcl 1, lll1vfll;t.;i 2(Jtltlc'f (, 199-' On December 22, 1960, the State Lands Commission entered into a boundary line agreement (BI.A 18) with the Huntington Harbour Corporation which established, pursuant to Public Resources Code §6357, the ordinary low-water mark of certain portions of Anaheim Bay. Th at agreeitlent established the boundary between lands sold by the State pursuant to TLL 221 and the unsold submerged lands located within the perimeter description of TLL 221. At the same time, the State Lands Commission and the Huntington H arbour Corporation exchanged certain fee owned lands but, again, did not extinguish the Public Trust easement over the patented tidelands. More recently, as a result of an ownership dispute, on July 15, 1991, the State Lands Commissionauthorized a compromise title settlerner t agreement with Destiny 11, a California general partnership, concerning ownership of approximately 1.7 acres of real, property within Huntington Harbour. In reaching this agreement, the State Lands Commission found that the property had been filled and reclaimed since the 1960s, and was no longer available or useful for Public Trust purposes. The agreement provided that the State would convey all its right, title, and interest and would terminate the Public Trust interest in the property in exchange for Destiny 11 depositing The sum of $60,000 into the Kapiloff Land Bank Fund for future purchase of lands for trust purposes in the area. Huntington Harbour is located within the California Coastal Commission's original permit jurisdiction as depicted on "red line" maps provided by the SLC. I personally came into the office of the Planning Department on Wednesday, December 2 and Thursday, December 3, and spoke to Mike Strange in the Planning Department and told him that I belie+red that there was a land trust easement for the State of California for the parking lot property on Edgewater Lane belonging to the Huntington Harbour Bay Club and Marina. (Please see the enclosed photocopy o;" the letter from the State Lands Commission dated November 6, 1992 signed by Curtis L. Fossum --which you have previously received.) On Thursday, Mr. Strange told me that he had checked with Mr. Mike Adams and Mr. Adams had confirmed that there was a Land Trnst Basement on the parking lot but that no permits had been asked for or issued on that property. I told him I wanted to be apprised if a permit was issued and I would come down to the City for a copy of same. Mr. Strange assured me that he would call me if a permit was issued, On Friday, December 4 earth moving equipment was delivered to the site and after calling the City I found out that a permit was issued late on Friday, December 4. To date in spite of sevr ral phone calls to Mr. Mike Strange I have not had the courtesy of a reply from him In spite of his promise to me, I am enclosing for your perusal a copy of a Lot Line Adjustment requested by the Keith Co. (taken from city files) on Jan. 30, 1991 and heard Feb. 6, 1991. Neither myself or any of my neighbors were notified of this hearing! -2- On August 27, 1991 there was filed at the Orange County Recorder's office a Quit Claim Deed for valuable consideration to Mr. Laasdale by Mr. Ahadpou:e for a twenty-five foot p- rtion of the parking lot on Edgewater Lane (the northern part of same adjoining Mr. Lansdale's residence at 17141 Edgewater Lane (a photocopy of same is enclosed.) The City accepted this new twenty-five foot wide parcel that I believe has a State Lands Trust Easement on it as a "Lot Line Adjustment. " (Photocopy of same enclosed.) On or about December 2, 1992, Mr. Landsdale allegedly sold his residence at 17141 Edgewater Lane (including the additional parcel from Mr. Ahadpour, supposedly) to a Mr. & Mrs. James Watson who have moved in already. '(On my last visit to the Orange County Recorder's Office this last transaction hail not been recorded,) On Wednesday, Dec. 9 1992 1 spoke to Curtis Fossurri of the State Lands Commission and he asked that all papers be sent to him immediately. He said that he believes that the land in. question has aState Lands Trust Easement on it. He also told me that he believes that the complete walkway around the boat marina has been dedicated to the State and that the new owner, Mr. James Watson, has no right to the land dedication. Mr. Fassuni also went on to say that this was not really a "Lot Line Adjustment. " This was a "Lot Extension." From the papers it also appears to me that the pierhead line has been ch, raged. Mr. Fossum went on to tell me that he is going to contact the Coastal Commission right away as he believes that Coastal Permission is needed for any construction on this piece of property. In view of all o the above, I suggest that the City order a stop order on this property until this matter is settled, This letter, of course, is to put you and the City of Huntington Beach on notice regarding what seems to be a possible problem . I fully intend to follow up on this in all possible forums. I certai nly do not intend to let anything improper either take place or be swept under the rug. The State acquired sovereign ownership of all previously ungranted tidelands, submerged lands, and beds of navigable waterways upon its admission to the United States in 1850. Tidelands are those lands which, lie between the lines of ordinary high and ordinary low tide. Submerged lands lie below the line of ordinary low water as it Iasi naturally existed. The landward boundaries of the State's sovereign interests are generally based upon the ordinary high water marks (Civil Code §830) of these waterways as they existed prior to any filling or artificial accretion, and thus may not be readily apparent from, present. day site inspection. The Public Trust Easement is a sovereign public property right held by the State or its delegated trustee for the benefit of all the people. This right is intended for public use of these lands for waterborne commerce, navigation, fisheries, open space, recreations or other recognized Public Trust purposes. Huntington Harbour is generally adjacent to the Mexican land grant Rancho f Bolsa Chica granted on July 1, 1841 to Joaquin Ruiz by Governor Juan B. Alvarado, confirmed, by the U.S. District Court on February 23, 1857, surveyed by the United States in. 1873 and patented by the United States on May 7, 1874, On January 6, 1903, the State patented those tidelands surrounded by Rancho La Balsa Cxica, pursuant to Tide Land Location 221 (TLL 221), to R. J. Northam. The waterward boundary of the rancho lands and landward boundary of the tidelands is The ordinary high water mark. N11 I. ;AiIChi1VI I . I fl/el u iV; LIIIIICI(),1(191' On December 22, 1960, the State Lands Commission entered into a boundary line agreement (BI-A 18) with the Huntington Harbour Corporation which establW-ed, pursuant to Public Resources Code §6357, the ordinary low-water mark of certain portions of Anaheim Bay. That agreement established the boundary between lands sold by the State pursuant to TLL 221 and the unsold submerged lands located within the perimeter description of TLL 221. At the same time, the State Lands Commission and the Huntington Harbour Corporation exchanged certain fee owned lands but, again, did not extinguish the Public Trust easement over the patented tidelands. More recently , as a result of an ownership dispute, on July 15, 1991, the State Lands Commission authorized a compromise title settlement agreement with Destiny II, a California general partnership, concerning ownership of approximately 1.7 acres of real property within Huntington Harbour . In reaching this agreement, the State Lands Commission found that the property had been filled and reclaimed since the 1960s, and was no longer available or useful for Public TrLf purposes ., The agreement provided that the State would convey all its right, title, and interest and would terminate the Public Trust interest in the property in exchange for Destiny 11 depositing the sum of $60,000 into the Kapiloff Land Bank Fund for future purchase of lands for trust purposes in the area. Huntington i jour is located within the California Coastal Commission's original permit jurisdiction as depicted on "red line" maps provided by the SLC. Staff further advised the applicant that a zone change may be required on the 25 foot wide portion of the property. He seated for the record that the lot line adjustment did not include water rights, warfage or pierhead line rights. Mike Strange :,end Gloria Gitsharc: checked the computer for any current permits to remodel or expand the residence and found none. Mrs. Devlin was told that if such a request was made that she would be contacted. Mrs. Devlin was also told that a Coastal Development Permit is required for expansions of dwellings that exceed 10% of the existing floor area, lnterio,: remodels do not need a Coastal Development Permit. Request for Lot Line Adjustment LL89-5 on Land Situated within Huntington Harbour Specific Plan QUESTION: January 16, 1991 Does a lot line adjustment fall within the provisions of Section IV of the Huntington Harbour Bay Club Specific Plan which reclui.res a tentative tract map to be filed for any development proposal? ANSWER: No FACTS : Mr. Ferydoun Ahadpour and William Lansdale contiguous land owners reached an agreement whereby Mr. Ahadpour agreed to grant to Mr. Lansdale a strip of land 25 feet by 100 feet adjacent to Mr. Lansdale's property (see map attached). Both parties signed the application for the lot line adjustment. Mr. Ahadpour`s property lies within the Huntington Harbour Bay Club Specific Plan, Mr. Lansdale's property does not. ANALYSIS: Section IV of the M.Iuntington Harbour Bay Club Specific Plan reads as follows: "APPLICA T ION PROCEDURE - Any request for a development proposal shall be accompanied by an application for a Cond ition al Use Permit. Any request for subdivision or subdivision of any parcel shall also be accompan ied by a Tentative Tract Map. Does the proposed lot line adjustment requested fall under this section of the specific plan? The Huntington Beach Ordinance Code, Title 9 does not define development or project. Tinder the California Environmental Quality Acts project is defined.in California Publ i c Resources Corte §21065 (c) which states "Activities involving the issuance to d person of a leas,,-e, permit , license , certificate, or other entitlement for use by one or more public agencies." Page Two Re: Opinion January 16, 1991 It appears that, by any interpretation of the term development project, that a lot line adjustment is not a development project. Nothing is constructed and there is no development. If either party desires development, the party must have an additional application for the development independent of the lot line adjustment. Thfi specific plan requires a tentative tract map for subdivision or resubdivision. This is neither a subdivision or resubdivision since by definition, a subsdivision or resubdivision changes the number of lots in the subdivision. A lot line adjustment does not change the number of lots in either existing subdivision. CONCLUSION: For the aforementioned reasons Mr. Lansdale ' s lot line adjustment application should be immediately processed through the Zoning Administrator pursuant to Huntington Beach Code §9811.31 since it is not subject to the Huntington Harbour Specific Plan.
