LOCATION: 19176 Foxgien Drive (southwest corner of Peninsula Lane and Your application was acted upon 1,y the Zoning Administrator of the City of Huntington Beach on April 16, 1997 and your request was Conditionally pA proved. Included in this letter are the Conditions of Approval for this application. of the Zoning Administrator's action. Tinder the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Zoning Administrator is final unless an appeal is filed to the Planning Commission by you or by an interested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a f ling fee of Two Hundred Dollars ($200.00) if the appeal is filed by a single family dwelling pror._Iy owner appealing the decision on his own property and Slx Hundred Fifty Dollars ($650.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date The last day for filing an appeal. and paying the filing fee for the above noted application is April 28, 1997/ Lot Line adjustment No. 97-2 Page No. 2 Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any application becomes null and void one (1), year after the final approval, unless actual construction has begun. FINDING FOR LOT LINE ADJUSTMENT NO. 97-2: 1. The granting of Lot Line Adjustment No. 97-2 to adjust the lot line between Lot 31 and Lot B of Tract 15036 will not create any additional parcels or building sites. The adjustment will increase the size of Lot B and decrease Lot 31. 2. The resulting parcels from the lot line adjustment will conform to Titles 20-24 of the Huntington Beach Zoning and Subdivision Ordinance because Lot 31 will meet the minimum size requirements; there are no minimums for Lot B. 3. The lot line adjustment will not sever any existing structure on either of the twoparcels. There are no existing structures that will be affected. The monument wall in Lot B is not on the property line. B. 4. The lot line adjustment will not allow a greater number of dwelling units than allowed prior to the adjustment. Only one unit will be allowed on Lot 31 and no units are allowed on Lot 5. A plat map showing the lot line adjustment has been prepared and approved and will be filed in accord with the, provisions of Section 253.24. C NDITION F APPROVAL LO T LINE ADJ UST NT NO. 97-2: 1. The lot line adjustment received March 11, 1997, shall be the conceptually appro..'d layout. 2. All previous condition of approval for Tentative Tract No. 14700, Conditional Use Permit No. 96-49 and Entitlement Plan Amendment No. 96-4 shall remain in effect. 1NF RM TI N ON SPECIFIC CODE RE UIREr.IENTS: 1. Lot Line Adjustment No., 97-2 shall not become effective until the ten day appeal period has elapsed. Lot Line adju ment No. 97-2 Page No. 3 2. Lot Line Adjustment No. 97-2 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Department of Community Development a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Lot Line Adjustment No. 97-2, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and Federal Fire odes, Ordinances, and standards, except as noted herein. 5. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Oran e, and submitted to the Department of Community Development within two (2) days of the Zoning Administrator's action. The Department of Community Development will perform a comprehensive plan check relating to all Municipal Code requirements upon submittal of your completed structural drawings. Please be advised that the Zoning Administrator reviews the conceptual plan as a basic request for entitlement of 'the use appli ed for in relation to the vicinity in. which it is proposed. The conceptual plan should not be construed as a precise plan reflecting conformance to all Code requirements. It is recommended that you immediately pursue completion of the Conditions of Approval and address all requirements of the Huntington Beach Municipal Coda in order to expedite the processing of your total application. I hereby certify that Lot Line Adjustment No. 97-2 was Conditionally Approved by the Zoning Administrator of the City of Huntington Beach, California, on April 16, 1997, upon the foregoing conditions and citations.
