Under the provisions ofthe Huntington Beach Zoning and Subdivision Ordinance, the action
taken by thePlanning Director, is fma unless an appeal is filed to the Planning Commission by
you or by an interested party. Said appeal must be in writing and must set forth in detail the
action and grounds by which the applicant or intertisted party deems himself aggrieved. Said
appeal must be accompanied by a fling fee of Two Hundred Dollars ($200.00) if the appeal is
filed by a single family dwelling property o , rner appealing the decision on his own property and
Six Hundred Ninety Dollars ($690010) if the appeal is filed by any other party. The appeal shall
be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the

The last day for filing an appeal and paying the filing fee for the above noted application is
August 9, 1999.
Provisions of the HuntingtorL Beach Zoning and Subdivision Ordinance are such that any
application becomes null and void one (1) year after the final approval, unless actual construction
has begun.
FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Planning Director finds that the project will not have any signifca at effect on the
environment and is exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to Section 15301, Class 1 of the CEQA Guidelines, because it involves. minor
alteration to an existing facility involving no expansion of use.
CONDIT IONS OF APPROVA-L INITIAL :.., PLAN AND ZONING It VIEW NO.99-44.
1. The site plan, floor plan, and elevations received and dated June 3, 1999 shall be the
conceptually approved layout with the following modifications:
a. Parking lot striping detail shall comply with Chapter 231 of the Zoning and Subdivision
Ordinance and Title 24, California Administrative Code. The seven new parking spaces
shall be 9 feet by 19 feet and have a minimum of 26 feet of back up space. (Code
Requirement)
b. The fence along Gothard shall be relocated to be flush with or behind the building.
c. Provide an awning or canopy over the new primary entry on the south side of the building
to better define the entrance,
d. Provide 10 feet (interior dimens;on ) of landscaping along the parking lot frontage on
Gothard. Parking spaces lost can be made up by increasing the amoL.tit of wa, 4house
proposed,
2. Prior to submittal for building permits, the following shall be completed:
a. Zoning entitlement conditions of approval shall be printed verbatim on the second page
of all the working drawing sets used for issuance of building permits (architectural,
structural, electrical, mechanical and plumbing).
b. All F re Department requirements shall be noted on the building plans. (FD).

3. Prior to issuance of building permits, the following shall be completed:
Submit cony of the revised site plan, floor plan, and elevations pursuant to Condition No.
1 for review and approval and inclusion in the entitlement file to the Planning
Department:
b. A Lar-'scape Construction Set must'be submitted to the Department of Public "Yorks and
approved by the Departments of Public Works and Planning. The Landscape
Consction Set shall include a landscape plan prepared and sighed by a State License(,
Landscape Architect which identifies the location, type, size and quantity of all existing
plant materials to remain, existing plant materials to be removed and proposed plant
rnateriais; an irrigation plan; a grading plan; an approved site plan and a copy of the
er'itlement conditions of approval.
The ) a ndscape plans shall be in conformance with Chapter 232 of the Zoning and
Subdivision Ordinance and applicable Design Guidelines. Any existing mature trees that
must be removed sL .il be replaced at P. two to one ratio (2;1) with minimum 36 inch box
trees and shall be incorporated into the project's landscape plan. (1PW) (Code
Requirement)
The property owner shall,;ign, notarize, and record with the County Recorder a covenant
restricting t1u amount of office and showroom space to assure that adequate parking is
provided per City code at all times. The covenant shall be submitted, a minimum of 45
days prior to building permit issuance for approval by the Planning Department and City
Attorney as to form and content. Upon approval, the covenant shall be recorded in the
Office of the County Recorder. 'Prior to building permit final and issuance of a
Certificate of Occupancy, a copy of the recorded covenant shall be filed with the Planning
Department.
4. Prior to final building permit inspection and appr6-ral (occupancy), the following shall be
completed:
a. The applicant shall submit a copy of the covenant required under condition 3(c).
b. The existing domestic/irrigation meter and service serving the site may potentially be
utilized for domestic/inigation purposes if it is of adequate size, conforms to current
standards, and is in working condition as determined by the Water Division; however:, the
meter shall be replaced with a touch-read meter, If anew water service is necessary, it
shall be, installed per Water Division standards and sized to meet the minimum:

requirements set by the Uniform Plumbing Code (UPC) (minimum 2 inches in size),

Separate backflowprLteetion shall be installed per the City of Huntington Bch Water
Division standards for domestic, irrigation and fire water services. (PW)
d. The applicant shall modify the median striping to eitl5.:r facilitate or prohibit the left turn
movement into the Edinger A venue driveway.(;W)
e. Unused driveways shall be removed and replaced with full-height curb, gutter, and
sidewalk. New curbing shall be painted red. Driveways to be re-used shall be replaced
with the City standard commercial/industrial driveway approach (Standard Plan 211).
f. Repaint the red curb on Edinger, Avenue and Gothard Street along the property frontage.
g. Outdoor I ghting shall utilize energy-saving lamps. All outside lighting :shall be directed
to prevent "spill over°' onto adjacent properties and shall be shown on the site plan and
elevations. Lighting shall be capable of being dimmed to a minimum security level
during hours,of non-operation of the facility. (Pi ll)
h. All improvements to the property shall be completed in accordance with the approved
plans and conditions of approval specified herein, including:
1) Landscaping;
2) Certify 4-hour separation wall is in compliance. (FD)
3) Fire extinguishers will be installed and loca ted in areas to, comply with Huntington
Beach Fire Code Standards. (FD)
4) Fire lanes will be designated and posted to comply with City Specification No. 415.
(FD)
5) Address numbers will be installed to comply with City Specification No. 428. (FD)
6) Exit signs and exit path markings will be provided in compliance with the Huntington
Beach F ire Code and T' `le 24 of the California Administrative Code. (FD)
7) Fire access roads shall be provided in compliance with City Specification 401.
Include the Circulation Plan and dimensions of all access roads. (FD)
8) A Fire Protection Plan in compliance with City Specification 426 shall be submitted
for Fire Department approval. (FD)
9) Security gates shall be designed to comply with City Specification 403. (FD)

All building spoils, such as unusable lumber, wire, piJ',e, and other surplus or unusable
material, shall be disposed of at an off-site facility equipped to handle then.
5. Only the uses described in the narrative subrnitt(:d shall be permitted.
6, The Planning Director ensures that all conditions of approval herein an, complied with.. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and
floor plans are proposed as a result of the plan check process. Building permits shall not be
issued until the Planning Director has reviewed and approved the proposed changes for
conformance with the intent of the approval and the conditions herein. If the proposed
changes are of a substanr'al nature, an amendment to the original entitlement reviewed by the
Planning Director may be required pursuant to the HB.'ZSO.
INFORMATION ON SPECIFI C CODE RE UIREMENTTS:
1. Initial Plan and Zoni ig Review No. 99-4 shall not became effective until the ten day appeal
period has elapsed.
2.. Initial Plan and Zoning Review No. 99-4 shall become null and void unless exercised
within one year of the date of final approval or such extension of time as may be granted by
the Director pursuant to a written request submitted to the Planning Department a minimum
30 days prior to the expiration date.
The Planning Director reserves the right to revoke Initial Plan and Zoning Rev`ewNo. 99-4,
pursuant to a public hearing for revocation, if any violation of these condition; or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable Public Works fees shall be paid. (PW)
5. Traffic Impact Fees shall be paid at the time of filial inspection or issuance of a Certificate
of Occupancy. (PV)
6. An encroachment permit shall be required for all work within the right-of-way. (PW)
7. A Certificate of Occupancy must be issued by the Departments of Planning, and Building
and Safety prior to occupying the building.
8. The development shall comply with all applicable provisions of the Municipal Code,
Building Division, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.

9. Construction shall be limited to Monday- Saturday 7:00 AM to 8:00 PM. Construction
shall be prohibited Sundays and Federal holidays.
10. All landscaping shall be maintained in a neat and clean manner, and in conformance with
the HBZSO. Prior to removing or replacing any landscaping, written approval must be
obtained from the Departments of Planning and Public Works. Substantial changes shall
require approval by Planning Director.
11. The applicant shall submit a check in the ,amount of $38,00 for the posting of the Notice
of Exemption at the County of Orange Clerk's Office. The check shall b c made out to
and submitted to the Planning Department within two (2) days ofthe County of OELQP C)
the Planning Director's action.
The Planning Department will perform a comprehensive plan check relating to all Municipal
Code requirements upon submittal of you completed structural drawings.
Please be advised that the Planning Director reviews the conceptual plan as a basic request for
entitlement of the use applied for in relation to the vicinity in which it is proposed. The
conceptual plan should not be construed as a precise plan ref'.ecting conformance to all Code
requirements.
It is recommended that you i_nt:.ediateiy pursue completion of the, Conditions of Approval and
address all requirements of the Huntington Beach Municipal Code in order to expedite the
processing of your total application.
