The applicant is requesting the two (2) year extension of time in order to consider alternatives to the existing signage on the property. D-3 A-F M-23C .c71 . As a result of a request to permit off-sale beer and wine sales, the applicant is requesting a limited sign permit Lo extend the service life of the existing pylon sign fir a temporary two year period. The face change includes: tenant identification and a logo. The applicant/owner has met the intent of the limited sign permit by requesting a change of face only and understands that the permit is for a maximum period of two years. After the two year period the sign shall be made to conform to the current code requirements for signs (maximum 32 square feet in area and 7 feet in height). 10.0 RECOMMENDATION: staff recommends that the Planning Commission approve Limited Sign Permit No. 90-8 with the following findings and conditions of approval.: FINDINGS FOR APPROVAL - LIMITED SIGN PERMIT NO. 90-8: 1. Allowing the maintenance of the sign for an addi::i.onal two years will not adversely affect other signs in the area. 2. The proposed extension of time pill not be detrimental to property l ocated in the vicinity of such sign, and will be in keeping with the character of the surrounding area. 3. The sign in its existing location along Gothard Street will not obstruct pedestrian or vehicular traffic vision.. 4. Due to the unique circumstances applicable to the sign, immediate alteration, removal or replacement of the sign will result in a substantial economic hardship. CONDITIONS OF APPROVAL - LIMITED SIGN PERMIT O. 90-8: 1. The site plan and sign elevation received and. dated July 24, 1990, shall be the conceptually approved layout. 2. Limited Sign Permit No. 90-8 shall be valid for two years (until August 7, 1992). Staff Report - 8/7/90 -3- (6685d) 3. Prior to issuance of building permits , the applicant ;;hall file a cash bond in the amount of $2,000 with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the sign . If the sign is not made to conform with the applicable provisions of the sign ordinance after two years from the date of approval , or remodel of the pro _rer;:y, whichever comes first , the City of Huntington Beach or its agents or employees ray enter the property where said sign is located and remove said sign and the cost of removal shall be deducted from the cash bond and summarily forfeited and paid over to the city of Huntington Beach, and the remainder, if any, returned to the person depositing the bond. 4. Limited Sign Permit No . 90-8 shall not become effective for any purpose until an "Acceptance of Conditions " form has been properly executed by the applicant and an authorized representative of the owner of the property, and returned to the Planning Division ; and until the ten day appeal period has elapsed. 11.0 ALTE'2NATIVE ACTION: The Planning Commission may deny Limited Sign Permit No. 90-8 with findings. We describe ourselves as a cash and carry wholesale grocery store. Most of our customers are institutional or food service related businesses. For example: caterers, lunch wagons, charitable organizations, restaurants, food service operators, etc. However, some of our customers do represent traditional retail customers because no membership is required to shop at our stores. However, Smart & Final is different frow. the traditional retail grocery store and occupies a ur_ii,ue niche in the market place. One need only visit a Smart & Final store to see that v e are not like a "Vons" or "Ralphs". Again, our emphasis is the business customer who must operate his or her food service establishment with a consistent source of quality bulk product in convenient fashion. This and the fact that we require no membership also separates us from the warehouse clubs such as ".Price Club" and "Costco". The success of our business in the past 100 years and our current operation of over 100 stores throughout the state attests to the success of our niche marketing. Due to the location of our stores, the only people that normally visit our stores are those to whom. we cater, the small business. The Huntington Beach store does not cater to convenie.ace store trade and we are not located in a residential area. The surrounding uses are all zoned light industrial. Therefore, it is important to us that those people who do seek out a Smart & Final can easily locate the store. Our store in Huntington Beach oii Gothard Avenue currently hzs a pillar sign that is over twenty-five feet in height and twenty feet wide. At the time of its constriction the design was approved, by the City of Huntington Beach, but today the design if the sign conflicts with city regulations. This discrepancy was brought to our attention on July 20 by Bob Franklin who indicated that current limitations restrict signs to tie monument type, ro higher than seven feet nor covering more than 35 feet in area. While we consider alternatives to our current sign, Mr. Franklin indicated that it would be possible for Smart & Final to receive a Limited Sign Permit that would allow us two years in which to remove our curreat sign and replace it with one that conforms to code, thus we instituted thi, request. Enclosed are 8 1/2" x 11" plans of the current sign and its location on the subject property. 24" x 36" plans are not included at this time because of our inability to reproduce blue line prints in-house. Mr. Franklin has agreed to allow us to turn the remaining plans by 10 A.M. July 27.
