Under the provisions of the Huntington Bea ch Ordinance Code, the action
taken by the P'anning commission is final unless an appeal is filed to
the City Council by you or an interested party. Said appeal must be in
writing and must set forth in detail the actions-and grounds by and
upon which the applicant or in t erested party deems himself aggrieved;-
Said appeal must be acctnpanied by a filing fee of one hundred and
sixty-five ($165 ) dollars and be submitted to the City Cleri:'s office
within ten (10) days of the date of the Commission 's action.
In your case, the last day for filing an app al and paying the filing
fee is May 12, 1989
Provisions of the Huntington Beach Ordinance Code are such that any
application becomes null `nd void one (1) year after final approval,
unless actual c onstruction has started.

SUBJECT: LIMITED SIGN PERMIT NO. 89-3
REQUEST: To modif-- (face change) an existing nonconforming
freestanding pole sign and extend the use of the sign for
2 years.
LOCATION: 9872 Hamilton Avenue (south side of Hamilton
approximately 300 feet west of Brookhurst)
DATE OF
APPROVAL: May 2, 1989
FINDINGS FOR APPROVAL:
1. Allowing the maintenance of the sign for an additional two
years will not adversely affect other signs in the area.
2. The proposed sign face change will not be detrimental to
property located in the vicinity of such sign, and will be in
keeping with the character of the surrounding area.
3. The sign in its existing location along Hamilton Avenue will
not obstruct pedestrian or vehicular traffic vision.
4. Due to the unique circumstances applicable to the sign,
immediate alteration, removal or replacement, of the sign will
result in a economic hardship.
CONDITIONS OF APPROVAL:
1. The site plan and sign elevations received and dated April 18,
1989, jhall be the conceptually approved' layout.
2. Limited Sign Permit No. 89-3 shall be valid for two years
(until May 12, 1991.

3. Prior to issuance of building permits, the applicant shall file
a cash bond in the amount of $2,000 with the City for the
purpose of indemnifying the City for any and all costs incurred
in the removal of the sign. If the sign is not made to conform
with the applicable provisions of the sign ordinance after two
years from the date of approval, or remodel of the property,
whichever comes first, the City of Huntington Beach or its
agents or employees way enter the property where said sign is
located and remove said sign and the cost of removal shall be
deducted from the cash bond and summarily forfeited and paid
over to the City of Huntington Beach, and the remainder, if
any, returned to the person depositing the bond.
4. This special sign permit shall not become effective for any
purpose until an "Acceptance of Conditions" form has been
properly executed by the applicant and an authorized
representative of the owner of the property, and returned to
the Planning Division; and until the ten day appeal period has
elapsed.
I hereby certify that Limited Sign Permit No. 89 -3 was approved by
the Planning Commission of the City of Huntington Beach on May 2,
1989, upon the foregoing finc 'ngs and conditions . This approval
represents conceptual approval only; detailed plans must be
submitted for review and the aforementioned conditions completed
prior to final approval.
