S GGESTED ACTION: Motion to: "Approve Limited Sign Permit No. 91 -8 with findings and suggested conditions of approval." 2.0 ENERAL INFORMATION: Limited Sign Permit No. 91-8 is a request to modify (face change) an existing 45 foot high , 392 square foot nonconforming freestanding pole sign for a period of two (2) years. Section 9610 .8(c) of the Huntington Peach Ordinance Code ,specifies that the Planning Commission may allow a change of face for nonconforming s :gns and extend their use for up to two years. REDEVEL PJNT STATUS: Not applicable. 7.0 SPECIFI PLAN : Not applicable. 8.0 SUBDIVI N COMMITTEE : Not applicable. 9.0 ISSUES AND ANALYSIS: The existing 45 foot high freestanding sign provides business identif ication for K-Mart and Savers Thrift Store. The applicant has requested a limited sign permit to change the face on a portion of the existing pylon sign for a two (2) year period . Planning staff has recently received a use permit application requesting approval for facade and landscaping improvements . If approved, the improvements are expected to occur in early 1992 , and would include removal of the pole sign on site. Since the Savers face change has already taken place, staff i s recommending the two year period be retroactive to July 31, 1990. The sign shall therefore , be br,,lught into conformance with current code requirements by July 31, 1992, tc upon the issuance of building permits for the facade improvements. Size 70 sf,392 sf Information Center and/or K-Mart/Savers 10.0 RECOMMENDATION: major tenant Staff recommends that the Planning Commission approve Limited Sign Permit No. 91-8 with findings and suggested conditions of approval: FINDING F R APPROVAL - LIMITED I PER141T NO 1- : 1. The proposed sign face change will not adversely affect other signs in the area. 2. The proposed sign face change will not be detrimental to property located in the vicinity of such sign; and will be compatible with the surrounding area. 3. The proposed sign face change on 19131 Magnolia Street will not obstruct pedestrian or vehicular traffic vision. 4. Due to the unique circumstances applicable to the sign, immediate alteration, removal, or replacement of the sign will result in an economic hardship. CONDITIONS OF APPROVAL - LIMITED PERMIT NO 1- 1. The site plan and sign elevations received and dated July 26, 1991 shall be the approved layout. 2. Limited Sign Permit No. 91-8 shall be valid for up to two (2) years retroactive to July 31, 1990 (expiration date July 31, 1992 ) or upon issuance of building permit for site improvements . 3. The applicant shall file a cash bond with the City in the amount of $5,000 for the purpose of idemnifying the City for any and all costs incurred in the removal of the freestanding pylon sign. If the sign is not made to conform with the applicable provisions of the sign ordinance after the two year period or at the time of site improvements the City of Huntington Beach or its agents or employees may enter on the property where said sign is located and remove said sign, and the cost of removal shall be deducted from the cash bond and summarily forfeited and. paid over to the City of Huntington Beach, and the remainder if any, returned to the person depositing the bond. The bond shall be posted no later than 30 days from approval of Limited Sign Permit No. 91-8. The pylon is currently shared by the other poperty tenant, K Mart and may fall under new guidlines of the sign ordinance . Until such time , the petitioner requests use of the space designated for the secondary tenant. The site is located no8r the major intersec t ion of Garfield and Magnolia , which accommodates numerous other retail occupants. The _.urrounding area has a high density of residential use which benefits from having a discount store that is easily accessible. Limited Si n Permit Request Savers i s located at the farthest point from the intersection ,700 ft. Further, the building has an unusually deep setback of 314 ft. to accommodate the large parking are'..t required by mode and has been landscaped with numerous trees and shrubs which p ar ti al l y block the view of the building facade. The existing pylon sign is currentl y co-occupied by the adjacent tenant, K Mart whic h incurs the same circumstances as the petitioner . K Mart's use o' this pylon grants it adequate street visible signage. Therefore, use of the available existing sign area for the petitioner would not be construed as inconsistent , and would not be a special privilege. Adequate signage is a nece-ary accessory to trade and granting this request is vital i i ts property right. Granting of this request would not be materially detrimental to, the public welfare. In fact, signage visible to vehicular traffic will insure timely lane change and entrance to the parking lot from a highly travelled street.
