(For public hearing and Commission action at the meeting of November 17, 1992) SYNOPSIS Public hearing and action on request by the City of Huntington Beach to amend the certified Local Coastal Program Implementation Plan to change the zoning at three locations. Zone change number 1 would result in a change from Medium Density Residential (R-2) to Low Density Residential (R-1); zone change number two would result in a change from Medium Density Residential (R-2) to Recreational Open Space (ROS); and zone change number three, would result in a change from High Density Residential (R-4) to Recreational Open Space (ROS). Zone change number one is located on the North side of Palm Avenue approximately 150 feet east of Cherryhill Lane. Zone change number two is located at the North side of Palm Avenue, just east of the location of zone change number one. Zone change number three is located, approximately 200 feet north of the intersection of Ofelia Lane and Morning Tide Drive, within the Seacliff Country Club Golf Course. All the sites are within the City of Huntington Beach, County of Orange. SUMMARY OF STAFF RECOMMENDATION Staff recommends the Commission certify the Implementation Plan amendment 2-92 as submitted. To obtain copies of the staff report by mail, or for additional information, contact Meg Vaughn in the Long Beach office at (310) 590-5071. i Huntington Beach LCP Amendmei. 2-92 Page 2 STANDARD OF REVIEW For amendments to certified Local Coastal Program Implementation Plan, the standard of review, pursuant to sections 30513 and 30514 of the Coastal Act, shall be conformance with and adequacy to carry out the provisions of the Land Use Plan portion of the certified City of Huntington Beach Local Coastal Program. STAFF RECOMMENDATION Staff recommends adoption of the following motion and resolution: POTION I: "I move that the Commission reject the Implementation Plan amendment 2-92 of the City of Huntington Beach." Staff recommends a NO vote which would result in the adoption of the following resolution and findings. An affirmative vote of a majority of the Commissioners present is -eded to pass the motion. RESOLUTION 'TO CERTIFY Thr iMPLEMENTATION PLAN AMENDMENT The Cam;:,fission hereby a proves the certification of the Implementation Plan amendment 2-92 of the City of Huntington Beach LCP on the grounds that the Zoning Ordinances, are in confi !a.nce with and are adequate to carry out the provisions of the Land Use Plan as certified. There are no feasible alternatives or feasible mitigation measures available which would substantially lessen any significant adverse impact which the approval of this implementation plan will have on the environment. FINDINGS FOR APPROVAL OF THE IMPLEMENTATION PLAN AMENDMENT A. Amendment Description The proposed Implementation Plan Amendment would change the zoning at three locations in the Huntington Beach coastal zone. Two of the zone changes would be from residential to recreational open space. The third change would be from medium density residential to low density residential. The three sites are located inland of Pacific Coast High, just north of Palm Avenue between Seapoint Street and Goldenwest Street (See Exhibit A). The site of zone change one is currently vacant. The existing use at the site of zone change number two is the Seacliff Country Club tennis courts. And the site of zone change number three is currently a part of the Seacliff Country Club golf course. The proposed changes will be in conformanance with or will bring the zoning into conformance with the existing land use designations and :!its the current uses at the site. Adequac of Amendment to Carr Out LtIP Policies Sections 30513 and 30514 of the Coastal Act require that any amendments to a certified implementation Plan be cdnsistent with and adequate to carry out the certified Land Use Plan. Zone change number one, a 1.76 acre parcel located near the intersection Cherry Hill Lane and Palm ftenue, will change the zoning from R2-PO-01-CZ (Medium Density Residential-Planned Development-Oil Production-Coastal Zone) to Rl-01-CZ (Low Density Residential-Oil Production-Coastal Zone). Currently the site is vacant. The land use designation at the site is Low Density Residential. The proposed zone change will bring the zoning at the site into conformance with the certified Land Use Plan designation. Zone change number two, a 1.64 acre parcel located along Palm Avenue just east of zone change number one, will result in a, zone change from R2-PD-O-CZ (Medium Density Residential-Planned Development-Oil Production-Coastal Zone) to ROS-O-CZ (Recreational Open Space-Oil Production-Coastal Zone). Currently the subject site is developed with the Seacliff Country Club tennis courts. The land use designation at the site is Residential Low Density. The Residential Low Density designation allows "private recreation areas." The proposed zone change is consistent with the certified Land Uce Plan designation for the site. Zone change number three, a 1.96 acre site located within the Seacliff Country Club golf Course, will change the zoning from R4-01-CZ (Residential High Density-Oil Production-Coastal lone) to ROS-01-CZ (Recreational Open Space-Oil ProducLion-Coastal lone). The land use designation at the subject site is Recreation Open Space. The proposed change will bring the. zoning at the site into conformity with the City's certified Land Use Plan land use designation. Two of the three proposed zone changes will bring the Implementation Plan into conformance with the certified Land Use Plan. The third proposed zone change is an allowable use under the certified Land Use Plan land use designation. Additionally, two of the changes will result in a higher priority use under the Coastal Act: from residential to recreational. Therefore, the Commission finds the proposed Implementation Plan amendment consistent with and adequate to carry out the policies and goals of the certified Land Use Plan. showing the request to be consistent with any applicable requirements of the California Environmental Quality Act (CEQA). C. CALIFORNIA ENVIRONMENTAL QUALITY ACT Section 13096(a) of the Commission's administrative regulations requires Commission approval of LCP amendment requests to be supported by a finding Section 21080.5(d)(2)(i) of CEQA prohibits a proposed development from being approved if there are feasible alternatives or feasible mitigation measures available which would substantially lessen any significant adverse impact which the activity may have on the environment. .-,. Huntington Beach LCP Amendmerefl 2-92 Page 4 As submitted, the proposed amendment is consistent with the Chapter 3 policies of the Coastal Act. The proposed increase of land zoned recreational open space will promote increased recreational opportunities. The proposed decrease in intensity from medium density residential to low density residential will lessen demands on coastal access and recreation support systems such as parking and traffic. Anticipated environmental impacts resulting from the project have been determined to be insignificant.
