Administrative permits will be reoorted on the administrative calendar. If four or more cossmsissioners request that an item be held for public hearing, the project sill be removed from the administrative calendar and scheduled for a public hearing and possible vote at the next regular ce - nisssion meeting. Conditions, may be attached to an administrative permit. Applicants and other interested parties may speak in opposition to the pr',ject or its conditions. Testimony is limited to 3 minutes for each side. Broadway, Suite 380 Long Beach, CA 90802-4416 Subject: AMENDMENT 2-`'2 TO THE HUNTINGTON BEACH LOCAL COASTAL PROGRAM Dear Meg: I- G-, L h V, Es ( ^i % 99 CALIFORNIA COASTAL COMMISSION UTHCOAST DISTRICT The following is an item analysis to the letter dated October 16, 1992 which indicates an inconsistency between the City's certified land use designation of Low Density-Residential and the proposed zone change from R2-PD-O-CZ to ROS-O-CZ: 1. On page 100 of the Coastal Element (see attachment 1), which is the City's Coastal Land Use Plan, Section 9.2.1 states "All of the following residential designations also allow certain support uses by special permit: elementary and private schools, neighborhood parks and rivate re reation areas..." Since this section states that private recreation areas are permitted in residential land use designations, the proposed zone change from R2-PD-O-CZ to ROS-O-C: is in conformance with the City's Certified Land Use Plan and would not create an inconsistency between the proposed zoning and existing land use designation. 2. As stated in the City's transmittal dated September 15, 1992, the adopted provisions contained in the City's General Plan do not require an amendment to the Land Use Plan the parcel is less than 20 acres. The Size Criteria for Determining Land Use Designations table on Page 109 (see attachment 2) of the City's General Plan indicates only parcels 20 acres or more in size need an amendment to the City's Land Use Plan. Since the Coastal Land Use Plan is a portion at the City-wide land use plan, an amendment is not required. Meg Vaughn Page Two 3. On page 144 of the City's adopted General Plan (see attachment 3) ROS zoning is clearly consistent with all, residential zoning classifications therefore an amendment is not necessary. Since the Coastal Element and Coastal Land Use Plan are a part of the City's overall General Plan, the City has demonstrated internal consistency between the existing Land Use Designation of Low Density Residential and the proposed zoning classification of ROS (Recreation Open Space). 4. Also, the proposed zone change is consistent with the existing use of the property. The current use of the property is the tennis courts for the Seacliff Country Club. Since the Country Club is a permitted recreational use, the rezoning of the parcel to ROS-O-CZ recognizes the existing use of the parcel. In fact, the rezone will guarantee the continued recreational use of the parcel. In summary, staff feels that the rezone request from R2-PD-0-CZ to ROS-O-CZ has been processed properly and is consistent with the adopted policies of the City's General Plan and Certified Local Coastal Program. The City's Coastal Element states that recreation used are consistent with all residential land use categories therefore internal consistency has been achieved. Staff also maintains that since the Coastal Element is a part of the City's General Plan, the rezone request is consistent with the existing Coastal Land Use Plan. Based on this information, staff recommends that the rezone request be supported and approved by the California Coastal Commission at the November meeting in Santa Monica. Robert L.- Franklin Associate Planner 1 ,w. 9.2 LAND USE CATEGORIES The land use plan utilizes the same designations currently found in the Land Use Element, as well as six new or revised designations which more specifically reflect intended coastal land uses . This section describes the various categories and briefly discusses their relationship within the coastal zone. The general height limit for all categories of development is three stories. In specified areas , bonuses for parcels of one half block or more may be granted provided that the following conditions are met: 1. The bulk and siting of structures shall be controlled to protect public access and scenic and visual resources. A number of approaches may be used to achieve this, such as a step approach to building heights, staggered building envelopes, limits on the site coverage and building orientation, and use of view corridors. 2. Adequate parking shall be provided. Areas where increased intensities may be granted are depicted in Figure 9.8 on page 123. 9.2.1 Residential Residential uses are planned for approximately 1,600 acres of the coastal zone to provide opportunities for people to live near the coast. A range of allowable residential densities is proposed in keeping with the City's goal to provide a variety of housing opportunities by type, tenure, and cost for households of all sizes throughout the City. All of the following residential desi nations also allow certain sup ort uses by specie permit: a emertary a private schools, neighbor o pa s a rivate recreation areas, churches , fire stations , utility substations , day care centers, and convenience commercial centers (less than 1.5 'acres in size). Low Density - The low density designation is intended to provide the lowest intensity of residential development in the coastal zone and is applied to areas where residential uses currently exist or are planned to be developed at an intensity of less then seven dwelling units per gross acre of land . Principal uses permitted under the low density residential designation include detached single family dwellings, condominiums, and mobile home parks. Primary areas for low density include sites bounded by arterial highways and conveniently served by nearby elementary schools, commercial development and park and recreation areas. Medium Densit - This designation provides for more intense housing development and allows a density range of seven to 15 dwelling units per. gross acre of land . Principal uses include condominiums , single family dwellings in small lot areas , small multiple -family apartments (2-4 units), and motile home parks . Pursuant to Section 13553 of the California Code of Regulations, the Executive Director has ten working days to review a submittal to determine whether it is in proper order and legally adequate to comply with the requirements of Public Resources Code Section 30510(b). As the tenth working day has passed, the application is considered complete. Therefore, as of September 30, 1992, this item is deemed properly submitted. For future reference, this item has been assigned the following title: Amendment 2-92 to the Huntington Beach Local Coastal Program. The submittal involves an amendment to the Implementation Plan portion of the Local Coastal Program; the amendment has been classified as a major amendment. As a major amendment, the Coastal Commission has 90 days to review a land use plz;n revision or 60 days to review an implementation plan modification. Therefore, the amendment has been tentatively scheduled for Commission review at its November 17-20, 1992 meeting in Santa Monica. Once the acitual agenda is set for the meeting, you will receive a more specific notice for the time and date of the public hearing. Although the ten working day review period has passed, some questions concerning the amendment request have arisen. The request is for three zone changes. Our records indicate that two of the proposed changes would bring the Implementation Plan into conformance with the certified Land Use Plan. However, one proposed change would create an inconsistency between the LUP and the IP. This conflict would result from zone change 92-1, parcel A. The proposed change from R-2-PD-O-CZ to ROS-O-C7 would be inconsistent with the certified land use designation of Residential Low Density. Page Two LCP Amendment 2-92 As the standard of review for amendments to an Implementation Plan is consistency with and adequacy to carry out the certified Land Use Plan, this portion of zone change 92-1 would have to be recommended for denial. An amendment to the Land Use Plan would have to be approved by the Coastal Commission for the site before the proposed change to the IP could take place. Any further information the City Planning staff could provide regarding the LUP land use designation of-parcel A would be helpful in our analysis of the amendment request. LCPA No. 92-2 is a request to amend the City's Certified Local Coastal Program resulting from the adoption of Zone Change no. 90-12 and Zone Change No. 92-1. Pursuant to Section 13551(a) of Article 15 of-the California Coastal Commission Regulations, Resolution No. 6404 was adopted by the City Council on July 20, 1992. A copy of Resolution No. 6404 is included in this transmittal. In addition, the City Council has requested that LCPA No. 92-2 take effect automatically upon Coastal Commission approval. The following is a summary of processing pursuant to Section 13552 (b)(c) of the Coastal Regulations concerning Local Coastal Program Amendment 92-2 and the relationship to other sections of the City's Certified Local Coastal Program. Zone Chan e No. 90-12 • On August 16, 1990 , 'Pacific Coast Homes submitted a Zone Change application to change the zoning on 1.76 acre parcel from R2-PD-01-CZ (Medium Density Residential-Planned Development-Oil Production-Coastal Zone) to R1-01-CZ (Low Density Residential-Oil Production-Coastal Zone). 1:-,_- r,4t&- .4 September 15, 1992 Page 2 On January 28, 1992, the Planning Commission approved Zone Change No. 90-12 and recommended approval to the City Council. On June 15, 1992, the City Council approved Zone Change No. 90-12. During all the public hearings, no coastal concerns were raised. • The City Council retained the Coastal zone suffix which will require a Coastal Development Permit prior to issuance of building permits for permanent structures. Zone Chance No. 92-1: • On January 21, 1992, Pacific Coast Homes submitted a zone change to change the zoning on two (2) parcels in the Coastal Zone. Parcel Acreage Former New A 1.64 RZ-PD-0-CZ ROS-O-CZ C 1.96 R4-01-CZ ROS-01-CZ Both parcels have been rezoned to Recreation Open Space which is consistent with the existing uses on the parcels. Parcel A is currently being used for the Seacliff Country Club Tennis Courts. Parcel C is presently the Tee Box for the Fifth Hole for the Seacliff Golf Course. (Parcel B a third zone change site is not located in the coastal zone). • On June 3, 1992, the Planning Commission approved Zone Change No. 92-1 and recommended approval to the City Council. On July 20, 1992, the City Council approved Zone Change No. 92 -1. During all the public hearings , no coastal concerns were raised. The City Council retained the Coastal Zone S Zfix on both parcels which will require a Coastal Development Permit prior to issuance of building permits for permanent structures. As the certified minutes indicate, there were no coastal concerns expressed by any of the speakers or by written correspondence regarding local Coastal Program Amendment No. 92-2. Envelopes with postage have been included in this transmittal with the names and addresses of each interested party who spoke at the public hearings. -'July 27, 1992 Page 3 The proposed LCPA No. 92 -2 for Zone Change No . 90-12 and Zone Change No. 92 -1 is submitted pursuant to Section 13511 of the Coastal Commission Administrative Regulations which conforms to the requirements of Chapter 6 of the Coastal Act. The Local Coastal Program Amendment No. 92-2 is consistent with the goals objectives and policies contained within the Coastal Element of the City 's General Plan. These policies address Recreation and Shoreline Access (Section 3 .6.2.1) Visual Resources (Section 3.6.2.3 ) and Community Facilities (Section 3 .6.2.7). Regarding public hear ings , all legal notices made reference to the future Local Coastal Program Amendment and all staff reports were available for public review in the Department of Community Development and the Huntington Beach Public Library. Enclosed are copies of legal notices an the minutes from public hearings . Dura_ng the public hearing process , staff made every effort to maximize public participation in the process. The method of transmitting Zone Change No. 90-12 and Zone Change No. 92-1 is to adopt Resolution No. 655 and then forward the resolution to the Coastal Commission. 1 .Ppg D By CITY COUNCILI CI-I' 19 16. CLFY(K - Zs n han N -12 On June 1, 1992 , the Huntington Beach City Council approved Zone Change No. 90-12 which changed the zoning on a 1.76 acre parcel from R2-PD -01-CZ to R1 -CZ. The Zone Change was requested by Pacific Coast Homes which permits the construction of eight (8) single family homes in the Seacliff Area (See Attachment 2). As with all properties in the Coastal Zone, prior to issuance of building permits, a Coastal Development Permit will be required. All rules and regulations contained in the City's Coastal Land Use Plan and the Coastal Commission regulations will be enforced. Zone Chan e No. 92-1: On June 15 , 1992, the Huntington Beach City Council approved Zone Change No . 92-1 which changed the zoning on three (3) parcels in the Seacliff area (see Attachment 3). Two (2) of the parcels are located within the Coastal Zone boundary, therefore the City's Certified Local Coastal Program must be amended . Both Zone Change requests are consistent with the City's Coastal Land Use Plan, and all coastal regulations will be enforced. The request by Pacific Coas : Homes to change the zoning on Parcel A (1.64 acre) from R2 -PD-0-CZ to ROS -CZ and for Parcel C (1.96 acre) from R4-01 -CZ to ROS-CZ is consistent with the existing Coastal Land Use Plan which depicts a recreation land use designation. Parcel B is not located in the City 's Coastal Zone area.
