LOCATION: 1815 Pine Street (west side, north of Springfield) PROJECT PLANNER: Peter Vanek Dear Applicant: Your application was acted upon by the Zoning Administrator of the City of Huntington Beach on July 21, 1999, and your request was Conditionall A roved. Included in this letter are the Conditions of Approval for this application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Zoning Administrator is final unless an appeal is filed to the Planning Commission by you or by an interested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Two Hundred Dollars ($200.00) if the appeal is filed by a single family dwelling property owner appealing the decision on his own property and Six Hundred Ninety Dollars ($690.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Zoning Adnniaistrator's action. The last day for filing an appeal and paying the filing fee for the above noted application is August. I 999. Negative Declaration No. 99-8/Variance No. 99-8/ Tentative Parcel Map No. 99-133 Page No. 2 FINDINGS FOR APPROVAL, FOR NEGATIVE DECLARATION NO. 99-8., 1. Negative Dectaration No. 99-8 has been prepared in compliance with Art:iclc 6 of the California Environmental Quality Act (CEQA) Guidelines. It was advertised and available for a public comment period of twenty (20) days. No comments were received during the comment period. 2, There is no substantial evidence in light of the whole record before the Zoning Administrator that the project will have a significant effect on the environment. FINDINGS FOR APPROVAL - VARIANCE NO. 99-8: The granting of Variance No. 99-8 for the subdivision of an existing 100 foot wide lot into two 50 foot wide lots in lieu of a minimum lot width of 60 feet will not constitute si grant of special privilege inconsistent with limitations upon other properties in the vicinity and under an identical zone classification. The majority of the properties within the general vicinity are 50 feet wide, Because of special circumstances applicable to the subject property, including size, location or surroundings, the strict application of the zoning ordinance is round to deprive the subject property of privileges enjoyed by other properties in the vicir ty and under identical zone classification. The granting of a variance is necessary to preserve the enjoyment of one or more substantial property rights. The variance regTrest will permit the property owner to develop the subject parcels in accordance wituu what has been granted to the surrounding property owners. 4. The granting of the variance will not be materially detrimental to the public welfare or injurious to property in the came zone classification. The proposed 50 foot lot width will allow the property to be well integrated into the surrounding neighborhood, and will be more compatible with the surrounding properties that contain one single family dwellin.c& on one lot. The granting of the variance will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Residential Low Density on the subject property as the subject lots will comply with the minimum lot size, therefore not compromising the maximum density of seven units per acre of the Residential Low Density general plan designation. Negative Declaration No. 99-8/Variance No. 99-8/ Tentathe Parcel Map No. °7.i33 Page No. 3 FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO. 99-133: 1. Tentative Parcel Map No. 99-133 for the subdivision of one lot into two 50 foot wide lots is consistent with the General Plan Land Use Element designation of Residential Low Density on the subject property and other applicable provisions of this Code, with the exception of the lot width reduction from 60 feet to 50 feet. 2, The site is physically suitable for the type and density of development. The existing 100 foot r wide lot will be subdivided into two 50 foot wide lots for the future development of two single family dwellings. The development of two single family dwellings on the two lots is consistent with the surrounding development which consists mainly of single family dwellings on 50 foot wide lots. The design of the subdivision or the proposed improvements will not cause serious health problems or substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. An environmental analysis and Negative Declamation has been prepared as the proposed project will not produce any substantial negative impacts. The design of the subdivision or the type of improvements will not co nflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision unless alternative easements, for access or for use, will be provided, No easements :xist on the subject property currently. CONDITIONS OF APPROVAL - VARIANCE NO. IVE PARCEL 'iAP NO999-133: 1. The tentative parcel map received and dated March 24, 1999 shall be the approved layout. 2. The following conditions shall be completed prior to recordation of the final map unless otherwise stated. Bonding may be substituted for construction in accordance with the provisions of the Subdivision Map Act. (PTV) On-site drainage shall not be directed to adjacent properties, but shall be handled by a Public Works approved method. h. The engineer or surveyor preparing the final map shall tie the boundary of the map into the Horizontal Control System established by the County Surveyor in a manner Negative Declaration No. 99-8/Variance No, 99-8/ Tentative Parcel Map No. 99-133 Page No. 4 described in c'ctions 7-9-330 and 7-9,337 of the Orange County Subdivision Code and Orange County Subdivision Manual, Subarticle 18. c. The engineer or surveyor preparing the final map shall submit to the County Surveyor a digital-graphics file of said map in a manner described in Sections 7-9- 330 and 7-9-337 of the Orange Count, Subdivision Code and Orange County Subdivision Manual, Subarticle 18. d. A reproducible mylar copy and a print of the recorded parcel map, along with a digital graphic file of the recorded map per the City of Huntington Beach "CAD Standard Manual for Consultants", shall be submitted to the Department of Public Works at the time of recordation. 3. Tads map shall record prior to issuance of building permits. TPiZORMATION ON SPECIFIC CODE REC'U[FEMENTS: 1. Negative Declaration No. 99-8/Variance No. 99-8/Tentative Parcel Map No. 99-133 shall not become effective until the !en day appeal pr.iod has elapsed, 2. Negative Declaratioi. No. 99-8/Variance No. 99-8/Tentative Parcel Map No. 99-133 shall become null and void unless exercised within two (2) years of the date of final approval. An extension of time may be granted by the Planning Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Negative Declaration, No. 99- 8/Variance No. 99-8/Tentative Parcel Map No. 99-133, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable Public Works fees shell be paid. (PW) 5. Park and Recreation Fees shall be paid prior to approval of the final map by the City Engineer. (P `W) An encroachment permit shall be required for all work within the right-of-way. (PW) Negative Declaration No. 99-8/Variance No. 99-8/ Tentative Parcel Map No. 99-133 Page No. 5 The development shall comply with a:1 applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 8. The applicant shall submit a check in the amount of $38,00 for the posting of the Notice of Determination at the County of Orange Clerk's Office, The check shall be made out to the Coun of Oran e and submitted to the Planning Department within two (2) days of the Zoning Administrator's action. The Planning Department will perform a comprehensive plan check relating to all Municipal Code requirements upon submittal of your completed structural drawings. Please be advised that the Zoning Administrator reviews the conceptual plan as a basic request for entitlement of the use applied for in relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan reflecting conformance to all Code requirements. It is recommended that you immediately pursue completion of the Conditions of Approval and address all requirements of the Huntington Beach Municipal Code in order to expedite the processing of your total application.
