1.0 SUGGESTED ACTION:
Deny Limited Sign Permit No. 87-1 based on the findings outlined in
the staff report dated March 3, 1987.
2.0 GENERAL INFORMATION:
At the request of the applicant, the Planning Commission continued
Limited Sign Permit No. 87-1 to the March 17, 1987 meeting.
Limited Sign Permit No. 87-1 is a request to permit a face change
and grant a two-year extension of use for an approximately 25 foot
high, 96 square foot internally illuminated freestanding sign for
Sanwa Bank located at 6881 Warner Avenue.
In response to Item Number in the applicant's letter dated
March 3, 1987, staff has consistently maintained the policy that a
two-year extension is a discretionary action by the Planning
A-FM-239
Commission and staff would not have inferred that two-year
extensions are a formality and will be automatically approved.
Previous two-year extensions of non-conforming signs were granted
under the provisions of the former sign code which was adopted in
1976. In August of 1986, the current sign code was adopted whichalso has provisions for two-year extensions for non-conforming
signs. In this case, as outlined in the staff report, the subject
freestanding sign did not conform to the 1976 sign code nor does it
conform to the current sign code. Since the sign has provided over
ten years of service as a non-conforming sign, staff feels that a
two-year extension is not justified and the sign should be modified
to comply with the current sign code.

Huntington BL . for the following reasons:
1) Staff Report suggesting denial was received on March 3
(the date of the planning commission).
Heath & Co. was unable to reach the appropriate party
at Sanwa Bank Property Management, Jim Bracatelli (and
we are sure he would want to be present to represent
his-company).
3) Heath & Co. has no authority to accept or appeal any
decision made at this planning commission.
4) Heath & Co. was under the impression that proceedures
thus far taken for this commission were mere formalities
and that the extension would undoubtedly be approved.
If it is at all possible, Heath & Co requests that we be
put on the next available agenda allowing us time to have
met with the proper representatives at Sanwa ;,ank.

The Sanwa Bank freestanding sign is located in a landscape planter
which is required by the Sign Code. There are a total of five
freestanding signs along the Warner Avenue frontage which do not
conform to the existing Sign Code (see inventory of existing
freestanding signs in attachments). According to the provisions of
the current Sign Code, the retail center is allowed one 15 foot high
center identification freestanding sign and 5 separate monument
signs.

Since the sign did not :onform to the previous Sign Code, staff has
determined that the Sanwa Bank freestanding sign should be lowered
to a 7 foot high, 30 square foot monument sign now. The Sanwa Bank
building has ef.-ective wall signage which in combination with a
monument sign, will provide ample exposure for their business.
Eventually, the other freestanding sign:: will be required to conform
to the Sign code by means of recycle or change of use.
According to the Nonconforming Signs, Section 9610.8, the eventual
elimination of existing signs which are not in conformance with the
provisions of the sign code is as much a subject of health, safety
and welfare as is the regulation of new ^igns. The Sanwa Bank
freestanding sign did not conform to the previous Sign Code and it
exceeds the existing sign code by great proportions. Staff
recommends that the Planning Commission deny the two year extension
and require the freestanding sign be modified to meet the provisions
of sign code in effect at this time.
10.0 RECOMMENDATION:
Staff recommends that the Planning Commission den"" Limited Sign
Permit No. 87-1 based on the following findings.
FINDINGS FOR DENIAL:
1. Due to a lack of unique circumstances, the 25 foot high, 96
square foot freestanding sign's immediate removal will not
result in a substantial economic hardship for the applicant.
2. The 25 foot high, 96 square foot freestanding sign will
adversely affect other lawfully erected sirens in the area.
3. The 25 foot high, 96 square foot freestanding sign will be a
hazardous distraction.
11.0 ALTERNATIVE ACTION:
Approve Limited Sign Permit No. 87-1 based on findings and
conditions of approval.
