A motion was made by Pattinson, seconded by Thomas, to approve Code Amendment Ho. 73-7,
and waive further reading of Ordinance No. 2313, which carried by the following
roll call vote:
AYES: Pattinson, Thomas, MacAllister, Bailey, Mandic, Siebert, Shenkman
NOES: None

PUBLIC HEARING - ZONE CASE 78-8 AND SID 78-58 - APPROVED - ORD NO 2314 - FIRST
READING
Mayor Shenkman announced that this was the day and hour set for a public hearing
to consider a petition for a change of zone from Residential Agricultural District
(RA) to a Highway Commercial District (C4). The subject property is located on
the northeast corner of the intersection of Springdale Street and Warner Avenue.
The City Council will also be considering granting of Negative Declaration No. 78-53.
The Clerk informed Council that all legal requirements for publication, notification
and posting had been met and that no communications or written protests to the matter
had been received.
An aerial slide of the property was displayed by the Planning Director.
Mayor Shenkman declared the hearing open.
There being no one present to speak on the matter and there being no protests filed,
either oral or written, the hearing was closed by the Mayor.
Councilwoman Bailey gave reasons why she was opposed to rezoning the property to
highway commercial. Discussion was held between Council on the matter.
A motion was made by Pattinson, seconded by Thomas, to approve Negative Declaration
.do. 78-53 and Zone Case 78-8, which carried by the following roll call vote:
AYFS: Pattinson, Thomas, MacAllister, Mandic, Siebert, Shenkman
NOES: Bailey

The Clerk was directed to give Ordinance No. 2.314 a first reading by title - "AN
ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE
CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM RESIDENTIAL
AGRICULTURAL TO HIGHWAY COMMERCIAL ON REAL PROPERTY LOCATED AT SPRINGDALE STREET
AND WARNER AVENUE (ZOIE CASE NO 78-8)."
On motion by Pattinson, second Thomas, Council waived further reading of. Ordinance
No. 2314 ananimously.
PUBLIC HEARING - RE UEST FOR RATE INCREASE - SEAL'S.AMBULAIJCE SERVICE - APPROVED -
NO 4659 - ADOPTED
Mayor Shenkman announced that this was the day and hour set for a public hearing,
to consider a request from Seal's Ambulance Service for permission to increase their
service rates pursuant to S. 5.20.90 of the Huntington Beach Municipal Code.
Councilman Pattinson requested the City Attorney to check into the validity of
six votes being required in order to approve the resolution, as specified on the
agenda.

The Clerk was directed to give Resolution No. 4659 a'first reading by title - "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH COVERING PROCEDURES,
RULES AND RATES PERTAINING TO AMBULANCE SERVICE WITHIN THE CITY OF HUNTINGTON BEACH,
AND REPEALING RESOLUTION NO 4261."
On motion by Pattinson, second MacAllister, Council waived further reading of Reso-
lution No. 4659 unanimously.
A motion was made by Pattinson, seconded by MacAllister to adopt Resolution No. 4659.
Captain Baker, head of the Paramedics' Unit,, addressed Council and spoke on the
matter, stating that the revised fees proposed are in line with those of the County.
Councilwoman Bailey believed the proposed increases for service were high and suggested
that a financial recommendation be made by an auditor. Councilman Thomas inquired
whether any other ambulance service was provided within the City. Councilman Thomas
inquired why the service was not sent out for bids and the opportunity be given to
oth::r-ambulance services in the City. Councilman Siebert stated that he was not
in favor of the motion since he believed,the increases to be excessive for a firm
which had a monopoly on emergency services for the City. Discussion was held by
Council on the matter, following which, the Director of Harbors and Beaches informed
Council that one of the problems in providing emergency services is that ambulance
services have difficulty in meeting the high standard set for employees in the
E.M.T. classification and he believed that Seal's Ambulance Service meets the neces-
sary criteria.
The City Attorney determined that only four votes would be necessary to adopt the
resolution.
The motion made earlier by Pattinson, seconded by MacAllister to adopt Resolution No.
4659 carried by the following roil call vote:
AYES: Pattinson, MacAllister, Mandic, Shen,kman
NOES: Thomas, Bailey, Siebert

Mayor Shenkman called a re cess of Council at 9:50t M. The meeting was reconvened at
10:05 P .M. by the Mayor.
STEVERSON BROS MUD DUMP
Mayor Shenkman directed the City Attorney and the City \Administrator to bring back
recommendations on the two areas of concern at the Steverson Mud Dump.

Thomas Welch, applicant, addressed the Commission and requested ,
the approval of this change of zone which, would aid him in selling
the property.
Jerry Matney addressed the Commission and urged its approval of the
zone change.
The public hearing was closed.

Background
Based on the Staff's initial study of this project a Tentative
Negative Declaration was published in the local newspaper and posted
in the Office of the City Clerk for a 10-day public review period
ending June 5, 1978 and iX no comments, the attached
comments, were received.
Recommendation
The Environmental Resources Section recommends that the planning Commission and
City Council approve Negative Declaration No.78-53 finding that the
proposed project will not have a significant adverse effect on the
environment.
Mitigation Measures
X-The attached mitigating measures will reduce potential environmental
effects resulting from the project and are recommended as conditions
of approval.

AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 THEREOF TO PROVIDE

TURAL TO HIGHWAY COMMERCIAL ON REAL PROPERTY

WHEREAS, pursuant to the state Planning and Zoning Law,
the Huntington Beach Planning Commission and Huntington Beach
City Council have had separate public hearings relative to Zone
Case No. 78-8 wherein both bodies have carefully considered
all information presented at said h.aarings, and after due con-
sideration of the findings and recommendations of the Planning
Commission and all evidence presented to said City Council, the
City Council finds that such zone change is proper, and consis-'
tent with the general plan,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does ordain as follows:
SECTION 1. The following described real property located
on the norther ` corner of the intersection of Springdale Street
and Warner Ave is hereby changed from RA, "Residential Agri-
cultural" to G "Highway Commercial":
Beginning at a point in the West line of the South
West quarter of Section 22, Township 5 South, Range
11 West, S.B.B. & M., 180 feet North of the Southwest
corner of said Section, said point being the inter-
section of said west line with the westerly prolonga-
tion of the north line of the land conveyed to THE
SPRINGDALE SCHOOL DISTRICT of Orange County, by deed
recorded August 23, 1905, in Book 121, page 133 of
Deeds, and running thence North along the West line
of the Southwest quarter of said section 22, 101.06
feet; thence East parallel to the South line of Sec-
tion 22, 281,00 feet; thence South parallel to +-.e
West line of said Section, 281,06 feet; thence West
parallel to the South line of Section 22, 281.00 feet;
thence Worth 180.00 feet to the point of beginning.

SECTION 2. The Planning Director of the City of Huntington
Beach is hereby directed to change District Map 25 (Sectional
District Map 22-5-11) to incorporate the zone change described in
Section 1 hereof, and as said district map shall have been
amended, the same shall be in full force and effect and be a
part of the Huntington Beach Ordinance Code. A copy of said
district map, as amended hereby, is available for inspection
in the office of the City Clerk.
SECTION 3. Section 9061, District Map 25 thereof, is hereby
amended by Zone Case No. 78-8.
SECTION 4. This ordinance shall take effect thirty days
after its adoption. The City Jerk shall certify to the pas-
sage of this ordinance and cause same to be published within
fifteen days after adoption in the Huntington Beach News, a
weekly newspaper of general circulation, printed and published
in Huntington Beach, California.

Huntington Beach at a regular meeting thereof held on the 5th
day of September , 1978.
