At the July 20, 198.1 meeting of the City Council, Ordinance No. 2501
referenced above was considered, and a vote of three yes, one abstention
and onn no was tallied. My initial advice given at the City Council
meeting was to consider the abstention as voting with the majority,
equaling the requisite number of four votes to adopt an ordinance pur-
suant to the Huntington Beach City Charter,
On full consideration of the issue, it is my firm opinion that the
ordinance was not adopted. The specific requirement of the Huntington
Beach Charter is that all ordinance+s must be adopted by a vote of four
affirmative votes. Since the rule contained in Robert's Rules of Order
adopted by the City Council provides for counting an abstaining vote as
coinciding with the majority (see Robert's Rules of Order No. 46) and
is a procedural rule, it is my firm opinion that substantive vote of
four affirmative votes contained in the City Charter overrides the
procedural rule established by Robert's Rules of order, Therefore,
Ordinance No. 2501 was not adopted.
If the Council wishes to reconsider this ordinance, it will be necessary
to ' rodtl e t e ordinance and vote upon it five days or longer thereafter.

GARFIELD/MAIN/HOLLY CROSSING
Councilman Thomas asked the Public Works Directo, if he had any information
regarding automobiles crossing the divider at Holly Street, Main Street and
Garfield Avenue to enter;Pierpoint Drive.
The Public Works Dirrctor'stated that Council would receive a report. He
stated that a ditch would be cut through to make it extremely difficult to
cross the ditch and jump the curb at the same t=mei
PACIFIC COAST HIGHWAY - REPORT
Councilman Thomas reported on efforts made by the comet-ttee composed of
Councilmen MacAllister, Pattinson and himself>regarding the traffic problem
on Pacific Coast Highway. He stated that the State would place "No Parking"
signs from Warner Avenue to the bluff, south, block off entrances to State
beach and allow the city ticketing power, d that possibly the same thing
would be done from Beach Boulevard to the Santa Ana River. He spoke regard-
ing the possibility of installing temporary dividers from Beach Boulevard to
the Santa Ana River, and stated that staff would also work toward having
Cal-Trans prohibit parking on their property along the north side of Pacific
Coast Highway.

The Mayor announced that this was the day and hour set for a public hearing
to considr Zone Case No. 81-7, a request to change the zoning on 2.50 acres
of property from R-2 (Medium Density Residential) to R3-22 (Medium-High
Density Residential) allowing twenty-two units per gross acre. The subject
property is located on the north side of Newman Avenue, approximately 630
feet east of Beach Boulevard.
The City Clerk announced that all legal requirements for notification, publica-
tion and posting had been met and that she had received no communications or
written protests to the matter.
Councilman Pattinson left the room.
The Mayor declared the hearing open.
Richard Harlow addressed Council and stated that he represented the appellant
who was ill, and that the appellant agreed with the staff recommendation.

SUPERVISOR HARRIETT WIEDER COMMENTS
Supervisor 1tieder spoke regarding her trip to Washington 0. C. and conference
with the President. She stated that she saw control returning to local govern-
merit and, the possibility of a percentage of income tax monies being returned
to the State. She then commented on the Boucher land fill, debris in the chan-
nels in Huntington Harbnur, the Bolsa Chico Linear Park and Pacific Coast Highway.

The Mayor announced that this was the day and hour set for the continuance of
a public hearing opened c;t May 18, 1981 to consider the denial of the applica-
tion for a noise variance to Van/De Publishing Company dba Pennysaver pursuant
to S. 8,40.150 of the Huntington Beach Municipal Code The property was located
at 7601 Murdy Circle.
The City Clerk stated that she had received a letter form the appellant request-
ing that the hearing be discontinued due to the relocation of the facility to
Brea.

Staff pointed out that this is a new approach in processing a zone
charge coi . tirrently with the requested General Plan redesignation
(this request had been addressed as Area of Concern 2.2 in the Land

Ths public bearing was opened.
Dan Salceda; representing the applicant, spoke in support of the
zone change. In response to the Commission's concern about the den-
sity bonus when the General Plan bad been discussed, Mr.. Sa,lced.a
indicated that they would not ask later for the density bonus, as it
is their intention to build only 54 units on the site. This type
of development, he said, would be the most compatible with the sur-
rounding residential areas.
There were no other persons to speak for or against the proposed
change of zone, and the public hearing was closed.

Robert Nickelson addressed the C=nissio to ask for approbate of
his project, explaining why the request had been filed ahead of
th, s condominium conversion ordinance, which he said was due to,
a financial &ittiation which allows him to make coup tmdsts 7aowc
thsat be might not be able to make later on. He pointed out that
it is planned to provide 25 percent of the units as afrordeble
housing within a $40, 00'0 to $60,000 price range, and that although
the project cannot meet the development standards of the current
PRD ordinance the quality of the project is high, particularly
in the type of open space provided. In response to questioning
from the Commission, Mr.Mickelson said that he had personally
hand-delivered the required notices to his tenants on May 12, 1981.

In the following Commission discussion the Commission considered
whether or not such a project would really be able to provide afford-
able housing and whether or not retaining the rental stock might
not be a more effective way of providing that lower cost housing.
It was the consensus of the Commission that the request is premature
and should be delayed until after processing of the condominium
ordina,ce . Jim Georges , legal counsel, estimated that the ord i n-
ance will take from four to seven weeks to prepare for Co,mission's
cons i deration . Mr. Mickelson then requested a two month's continuz-
anc:e of his request.

change on the 2.5 acre parcel located on the north side of
Newman Street east of Beach Boulevard, I hereby request your
department to process a zone change to R3-22 concurrently with

the Huntin g ton Reich 'ta nnin Commission and Huni-initon Beach
City Council have h ad aoparate public h earings relative to Zone
Case No. 81-7 wherein bot h bodies ha v e 'efully considered
all infor mation prQsented a t Said hearth s, and after K e con-
sideration of the Kadi n s and re C?1x;i1GYlEf J75 of the Pla n ning
Commission and all evidence presented to said City Council, the
City Council finds that such zone chan g e is proper, and consis-
tent 'vTtt h the general plan,
NOW, THEREFORE, the City Council of the City of Huntin gton
Beach does ordain as follows:
SECTION 1. The followin g described real pr operty , located
north of Newman Avenue approx i mately 630 feet east of Beach
Boulevard, is here by chan;e1 Crom R2, "Median Density Residential
District" to R3-22 , "Meditrn-high Density Residential District:'"

Section ,l hereof . A copy of said district map, as amended hereby

SECTION 3. This ordinance shall take eff eet thirty days
after its adoption.
