The VA has a "domi.ciliary home" in Los Angeles where entry is
permitted for veterans due to odd age, disability or an inability
to care for themselves.

The Office is not a "placement service" nor does it license any
person or home for the purposes of placement under a "care of
non-related" situation.
This office functions as an intermediary in that it"has record"
of persons receiving welfare who are in need of a place to live
and it "hears of " homes such as the Rader home who will take-in
such persons. There is. no formal placement.
Persons like Mrs. Rader are considered, by this office, as "free
.agents" offering a board and care type of operation and the
persons on welfare, also, are considered as "free agents" who are
free to move at any time.
In some cases there is a social worker assigned by an _gency to
a particular welfare receiver and in other cases it is, at this
time, unclear what type of review is maintained.
3. The following list offers additional information as to the types
of placements being requested under AR 71-55 and AR 71-56 (also,
an indication as to the variety of human situations that may be
expected under the "care of non-related" provisions of the
Huntington Brach Ordinance Code:

To whom it may concern;
Jeanne Rader operates two board and care homes for disabled
men with the full knowledge of the Orange County Welfare
Department.
Both homes, one at 1819 Lake Street and the other at 8151
Evelyn Circle in Huntington Beach, are well operated homes.
Mrs. Rader and her husband have cared for the handicapped
for many years. One gentleman has lived with them for
eighteen years.
It is not the policy of the State of California nor of
Orange County to license board and care homes caring for
people between the ages of sixteen and sixty-five. This
department, however, is in contact with Mr. and Mrs. Rader
and their guests on a continuing basis.

Our agency has at the present time one person placed in Mrs. has home. He is
a mildl y retarded young man on Leave of Absence frces Fairview State Hospital. He
cares for all of his needs and understands well when spoken to and has rather
good speech. Supervision by our agency includes >aathly visits to the home and
telephone contacts as needed. This young man is very well satisfied with place-
ment in Mrs. Chase's home. Two other young men were transferred when Mrs. Chase°s
permit and fire clearance were revoked. However, they also expressed satisfaction
and would like to return , if fire clearance is obtained.
Mrs. Chase a l so accepts guests referred by the County Welfare Department & Ad private
sources who are not supervised by our agency . We need homes for young men but are
concerned about Inspector Subia's findings as stated in his letter of August 25,
1971. Udless some of the conditions encountered could be alleviated, we would not
place additional patients in Mrs. Chase's horse.

5115. The Legislature hereby finds and declares:
(a) It is the policy of this state, as declared and established
in this act and in the Lanterman Mental R-etardation ,Act Of
1969, that mentally and physically handicapped pens ate`
entitled to live in normal residential surroundings andshould
not be ereluded therefrom because of their disability.
(b) In order to achieve uniform statewide inaplemensen,

Mrs. Jean Rader presently operates a Board and Care home at 1819 Lake,
Huntington Beach, and has five non-related boarders. The Huntington
Beach Fire Department has approved Mrs. Rader's Board and Care home
for three family members and five ambulatory boarders On October 20,
1971.
As the Department of Social Welfare does not issue a license for the
care of boarders between the ages of 16 and 64, and our boarders are
within this age range, no license has been issued . This agency
supervises the care of two mentally retarded adult males in Mrs.
Rader 's home . These men are James Eric Morgan and Ray Lewis Shanks.
James Eric Morgan is a Leave of Absence patient from Fairview State
Hospital . His diagnosis is Mental Retardation, other, due to uncertain
cause with the functional reaction alone manifest , IQ 79 , borderline.
(Functional mental retardation with psychotic overlay , simple chronic
schizophrenia.
Ray Lewis Shanks is also a Leave of Absence patient from Fairview
State Hospital, whose diagnosis iu Mental Retardation associated with
psychotic disorder (childhood ,schophrenic reaction), I 65, mild.
Both of these patients are financially supported by Social Security
benefits and a public a6sistancs grant known as "Aid to the Totally
Disabled".
I feel that Mrs. Rader provides not only a benefii.ial but essential
service to the community in the operation of her Board and Care home.

We are writing to you in connection with the hearing that you have
scheduled on the evening of December 21, 1971, pertaining to the
board and care home operated by Mrs. Jeanne Rader: at 1819 Lake
Street, Huntington Beach, California.
For your information in reaching your decision, we wish to advise
you that both Mr. James Barry and Mr. James Pay presently board
with Mrs. Rader and are wards of the Orange Coantg Public Guardian
following appointment by the Superior Court. In our capacity as
guardian of the person and estate, we have carried out our respon-
sibility for arranging an appropriate place of residence by obtaining
the assistance of social workers attached to the Guardianship Unit
of the Orange County Welfare Department.
It is our considered opinion that the present board and care home
is appr opriate and suitable for their needs in that neither gentleman
is able, on the one hand, to provide for himself in independent living
quarters, nor dcss either one , on the other hand. require confinement
in a convalescent hospital. Both of these cases will receive the
continuing supervision of the Public Guardian and the Welfare Depart
ment so that any necessary change in living arrangements may be
made in the future
It is our belief that Mrs. Rader`s home constitutes the optimum
balance between providing the necessary care and the maximum freedom
for Mr. Barry and Ir. Pay. In addition it is consistent with what
we derstand to be the prevailing poli cy in this State and in
thi s county to provi de for such care n the community a ..a a manner
which takes into consideration both the l arger costs of insti tutional
care and,.the interest s. of both the public in general and Mrs. Rader 's
neighbors in I untington Beach.

Dear Mr. Palin:
Administrative Review No. 71-55 appeared, I believe for the
first time, before the Huntington Beach Planning Commission
on December 21, 1971. At said meeting it was continued to
the meeting of January 18, 1972. After appearing at the
Planning Commission's work session on January 11, 1972 during
which there was brought out that the City's Ordinance 5.9730.26
entitled, "Care of non-related persons" should be amended and
appatently assembly bill No. 344 has very recently been signed
by the Governor reportedly covering the care of persons in the
age group of over 16 and under 65, 1 feel that Administrative
Review No. 71-55 should not be heard by the Planning Commission
until the aforementioned assembly bill 344 has been read and
studied and the aforementioned city ordinance has been amended.
Therefore on behalf of applicant Mr. and Mrs. William Rader,
I request the Planning Commission at its meeting on January 18,
1972 to continue Administrative Review No. 71-55 for probably
at least one month or whatever time the Planning Commission
deems best. I will telephone either you or Mr. Vasquez on
Friday, January 14, 1972 to see if an appearance on January 18,
1972 will be necessary. I would rather not make an appearance
unless absolutely necessary in order to save time and the
necessary costs to my client.
I would like to take this opportunity in advance to thank the
Planning Commission for considering this request.

This application was originally heard by the Planning
Commission at the December 21, 1971 meeting and continued
to the .anuary 18th meeting to allow the Staff time to
research the problems within S.9730.26 (Care of Non-
Related Persons) and to r eport back at the January 11,
1972 Study Session.
At the 3anuary 11th meeting, the Commission was informed
of pending State Legislation that may effect the Planning
Commission 's decision on Administrative Review No . 71-55.
It was the consensus of the Commissw-n to have the Staff
research the matter and to prepare a code amendment for
public hearing on March 7, 1972 to avoid the present
problems . The applicant was contacted and agreed with
this direction. At this time, the Staff recommends
application of the provisions of proposed Code Amendment
No. 71-33 and the existing Care of Non-Related provisions
of the Huntington Beach Ordinance Code.
In view of the above, the Staff recommends approval.

This letter confirms our telephone conversation
today during which it was mutually agreed that A. R. No.71-55
would not be heard. by the Planning Commission on Tuesday,
March 7, 1972, but would be continued to Tuesday, May 16, 1972.
I am therefore requesting on behalf of my client that
the Planning Commission continue A. R. No. 71-55 to May 16,
1972. Neither my client nor I will appear tomor.°ow night,
March 7, 1972, unless you contact me to the contrary.
Please notify me with respect to the hearing dates
on the proposed amendments to the City's ordinance regarding
the "care of non-related persons" so that my client could be
represented at the hearing if he wished. Please send me a copy
of the proposed amendments.
In the meantime, my client will be checking with the
California Department of Social Welfare to ascertain v-_Iat State
agency is going to issue licenses required under Welfar:. &
Institutions Code Section 16200 as amended in 1971, effective

This application was originally heard by the Planning

research the problems within S.9730.26 (Care of Non-
Related Persons)and to report back at the January 11,
1972 Study Session.
At the January 11th meeting, the Commission was informed
of pending State Legislation that may effect the Planning
Commission's decision on Administrative Review No. 71-55.
It was the consensus of the Commission to have the staff
research the matter and to prepare a code amendment for
public hearing on March 7, 1972 to avoid the present
problems.
The State legislation became effective in March and it
requires that a license be obtained by the applicant.
Such license is issued by the placing agency'.
Said code amendment (CA 71-33) was approved at public
hearings before the Commission on March 7, 1972 and before
the Council on April 3, 1972. Code amendment 71-33 is
currently in the City Attorney's office for legal prepara-
tion and will possibly be introduced before the Council
on June 5, 1972. If such is the case, then, CA No. 71-33
should be effective July 20, 1972.
In view of the ayove information, the staff recommends
approval based on the provisions of S.9730.26 and Code
Amendment No. 71-33 and that this matter be referred to
the Board of Zoning Adjustments to determine that all
such provisions are met.

The latest directive from Sacramento indicates the County
Welfare Department will.: administer the licensing for care
of non-related homes having from one to fifteen charges.
For charges exceeding fifteen the State Department of Social
Welfare: will administer the licensing.
An exception to the above is made when the care of non-related
home incl»des MR group II patients (mentally retarded) in this
case thy, State Department of Mental Hygiene will administer
the iicensiing.
The licensing procedures for "board and care" homes is, at
the date of this memo, in a state of chaos. All of the
persons contacted (below) are in agreement that it will be
some time before licensing of such homes will be a reality.
