HomeMy WebLinkAboutAdministrative Reviews ARX1971076 - Staff Report/Executive SummarySTAFF REPORT ADMINISTRATIVE REVIEW NO. 71-76 Applicant: Anne Herring Fisher Date: December 21, 1971 The staff has reviewed Administrative Review No. 71-76 and offers the following information for your consideration: 1. This application is before the Planning Commission because the Board of Zoning Adjustments referred it up for final action, 2. The applicant has requested permission to conduct a home ilr the case of four (4) mentally retarded adults between the ages of 19 and 36 at 5383_ Meadowlark Dr. in the R1 Single Family Residence District, 3. This request was filed pursuant to Section 9730.26 of the Huntington Beach Ordinance Code. A copy of this section has been attached for your review. 4. This request was heard by the Board of Zoning Adjustments at their December 1, 1971 meeting. The Board was advised that Mrs. Fisher conducts a simi.l; _• o7,-ration at 16820 Lynn St., Huntington Beach. Because of this the Board felt that Mrs. Fisher would be unable to provide a home environment for these charges and therefore, did not meet the intent of Section 9730.26. The Board was also advised that the State will not license or certify a home for the care of non-related persons :regardless of the type of placements for persons between ..he ages of 16 to 65. This caused concern because the staff was of the understanding, from all the representatives of the governmental a,-envies at the public hearing on the ordinance permitting the care of non-related persons, that every home would Page 2 Administrative Review No. 71-76 be licensed and/or certified by a governmental agency. 50 The staff discussed Code Amendment No. 71-33 (Care of Non-Related Persons) with the Commission at the December 14, 1971 Study Session and pointed out several problems presented by the code as it now exists. It was the consensus of the Planning Commission that the staff should prepare a detailed report reviewing these problems and to offer solutions. 6. In view of the above information, the staff recommends a continuance of Administrative Review No. 71-76 to the January 18, 1972 Planning Commission meeting to allow the staff time to research this matter and report at the January 11, 1972 Study Session.
