In order for your department to act on Mrs. Ann Fisher's
application for a zoning variance, we would like you to know
that she is caring for mentally retarded adult women in her
home at 16820 Lynn Street. Two of the girls in her home were
placed by our agency and are visited monthly by a social
worker. If she is grantee a variance for her home on Meadow-
lark, we would consider her home for placement of similar
clients, since she has given competent care and supervision
to such persons.

The people of the State of California do enact as foldowar
SECTION 1. Section 5115 is added to the W elfare and In-
stitutions Code, to read :
5115. The Legislature hereby finds and declares:
(a) It is the policy A this state, as declared and established
in this act and in the Lanterman Mental Retardation Act of
1969, that mentally and physically handicapped persons are
entitled to live in normal residential surroundings and should
not be excluded therefrom because of their disability
(b) In order to achieve uniform statewide implenltation
of the policies of this net and those of the Lanterman Mental
Retardation Act of 1969, it is necessary to establish the state-
wide policy that the use of property for the care of six or
fewer mentally disordered or otherwise handicapped persons
qis a residential use of such property fbr the purposes of zoning._Sac. 9. Section 5116 is added to the Welfare and Institu-
tions Code, to read :
5116. Pursuant to the policy stated in Section 5115, a
state-authorized, certified, or licensed family care, foster home,
or group home serving six or fewer mentally disordered or
otherwise handicapped persons, shall be considered a residen-
tial use of pro rtLfor the purposes o _znn-m •
SEC. 3. Section 51TIT-Is added'tto the Welfare and Institu-
tions Code, to read:
5117. In order to further facilitate achieving the purposes
of this act and the Lanterman Mental Retardation Act of
1969, it is desirable that there be a consolidation of the fa-
cilities standard setting , licensure and ratesetting functions
of the various state departments under the jurisdiction of the
Human Relations Agency. The Secretary of the Human Rela-
tions Agency shall present to the Assembly and Senate Rules
Committees not later than March 1, 1971, a specific plan to
accomplish this goal. In dovdloping this plan, the secretary
shall consult with and seek the advice of the public and pri-
vate agencies, the conaiuner groups, and the facilities atTected
thereby.u

This application was originally heard by the Planning Commission
at the December 21, 1971 meeting and continued to the
January 18th meeting to allow the staff time to research the
problems within S.9730 .26 (Care of Non-Related Person) and
to report back at the January 11, 1972 Study Session.
At the January 11th meeting, the Commission was informed of
pending State Legislation that may effect the Planning Com-
mission 's decision on Administrative Review No . 71-76. It was
the consensus of the Commission to have the staff research
the matter and to prepare a code amendment for public hearing
to avoid the present problems.
The applicant has been contacted and has requested withdrawal
of this application.
The staff recommends approval of the applicant 's request to
withdraw.
