The Acting Secretary outlined background information pertaining
to the initial construction of the shopping center. He further
reiterated that the subject sign had been proposed at an earlier
date and approved by the Board of Zoning Adjustments under the
application for a building permit. The Board of Zoning Adjustments
action was subseg4ently appealed and denied by .the Planning
Commission. Pha subject Use Permit was presently before the
Board to amend Use Permit No. 73-33 by adding the sign in question.

Review Board granted Exemption Declaration No. 73-219 December
26, 1973. Exemption Declaration No. 73-219 refers to both
conditional Exception No. 73-68 and Administrative Review No.
73-208 .
Tire c.iiairman opened the public hearing on-Conditional Exception
No. 73--i8.
Tie Acting Secretary outlined the applications to the Board.
Mr. !.colt pointed out that he wished to maintain trees a, zd to
allow sufficient parking, which would necessitate the present
wall to remain. Mr. Logan added that the treatment of the wall
has been changed from the original plan and that the wall will
act as.a barrier between residents and commercial property.
Mr. Jim Stead and Mr. Lyman McCray, neighbors expressed their
concern of a proposed driveway and of the added amount of traffic
that would be generated. They both felt that any additional
commercial traffic would be unfaix to their residential area.
The neighbors further felt that additional road traffic should
not enter the proposed driveway.
T.,e Vice- hairman explained the Department of'Public Works'
position on ingress and egress of of Goldenwest onto the
proposed development site to the concerned neighbors.

real estate office and assured the neighbors of little traffic
that would be generated off this type of business.
The Chairman stated that the driveway in question met code require-
ments and further explained the proposal before the Board.
The neighbors were in agreement that the block wall should remain.

opposition to Conditional Exception No. 73-68, the Chairman closed
the public hearing.

1. The granting of the Conditional Exception meets the intent
of the ordinance code provision to provide separation between
commercial and residential land uses.
A 6 ft. wall is required on a commerci al site when abutting
a residential district. The existing 6 ft. wall on the north
property line abuts a ,street and not specifically the resi-
dential use, however, in this instance it would be advantageous
to leave the existing wall on the "O" property line as the
residential character of the neighborhood, and the entrance
to the tract would be preserved in lieu of the normal commercial
setbacks,
The granting of the Conditional Ex ception is necessary to
maintain and preserve the enjoyment of one or more substantial
property rights in the i mmediate vicinity.

3. The sign submitted to the Board of Zoning Adjustments
December 26, 1973 shall be the approved sign in concept
and shall comply with Article 976.
4. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifi-
cations provided by the Fire Department.
5. Parking compounds shall be screened with a combination
of fencing and landscaping. Said plan shall be submitted
to the Planning Department for review and approval.
Fencing and landscape plans shall include the following
information:
a. A list including quantities and sizes for each
species of plants and all ground cover material.
b. irrigation layout to include meter location, pipe
sizes, sprinkler head types, etc.
C. Fencing materials and detail drawing.
C. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. 'Goldenwest Street and Breeland Street shall be fully
improved including street trees, street signs, street
lights, fire hydrants, sewer and water main extensions.
2. All utilities shall be installed underground.
3. Off-street parking facilities shall conform to Article 979.
4. A masonry wall shall be constructed along the west property
line. The height of said wall shall be such that the top
will be six (6) feet above the highest ground surface
within twenty (20) feet of the common property line.
Except within the exterior side yard setback in which
case the height of said wall shall be reduced to 42 inches.
6. There shall be no fence , structure or landscaping
constructed or maintained over 3 1/2 feet high within
a 10 ft. by 10 ft. triangular area at the intersection
on driveways and streets or within a 25 ft, by 25 ft.
