Westland LLC, 24901 Camino Villa, Lake Forest, CA 92630 REQUEST: To adjust the lot lines between two contiguous industrial lots resulting in the transfer of 3,572 sq. ft. of land from parcel "B" to parcel "A" of Parcel Map No. 83-563. LOCATION: 16491 Gothard Street, 92647 (northwest corner of Heil Ave. and Gothard St.) DATE OF ACTION: September 29, 2009 Dear Mr. Rezai: Your application was acted upon by the Planning Department of the City of Huntington Beach on September 29, 2009, and your request was approved. Included in this letter are the findings and conditions of approval for this application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department is final unless an appeal is filed to the Planning Commission by you or by an interested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Four Hundred Ninety Four Dollars ($494.00). The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Planning Department's action. The last day for filing an appeal and paying the filing fee for the above noted application is October 9, 2009. It is recommended that you immediately pursue completion of the Conditions of Approval and address all requirements of the Huntington Beach Municipal Code and Subdivision and Zoning Ordinance in order to expedite the processing of your total application. I hereby certify that Lot Line Adjustment No. 2009-004 was conditionally approved by the Planning Department of the City of Huntington Beach, California, on September 29, 2009 upon the foregoing conditions and citations. FINDINGS FOR APPROVAL - LOT LINE ADJUSTMENT NO. 2009-004: 1. The granting of Lot Line Adjustment No. 2009-004 for the adjustment of a lot line to accommodate the development of a satellite industrial building will not create any additional parcels or building sites. The parcel was originally approved for the construction of one industrial building. The lot line adjustment will continue to provide for one industrial building. 2. The resulting parcel alignment will conform to Titles 20-24 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) because it will comply with the requirements for minimum area, width, frontage, setbacks, and site coverage. 3. The lot line adjustment will not sever any existing structure on the resulting parcel. There are no existing structures on the subject parcel. Future development of the parcel will comply with Titles 21-25 of the HBZSO. 4. The lot line adjustment will not allow a greater number of dwelling units than allowed prior to the adjustment. The subject property is zoned and designated by the General Plan for industrial uses. Residential uses are prohibited. 5. A plat map showing the lot line adjustment has been prepared and approved and will be filed in accord with the provisions of Section 253.24 of the HBZSO. CONDITIONS OF APPROVAL - LOT LINE ADJUSTMENT NO. 2009-004: 1. The plat map received on August 25, 2009, and maintained in Planning Department case file LLA No. 2009-004 shall be the approved layout. 2. The lot line adjustment form shall be submitted to the Public Works Department for final review and modified as necessary pursuant to the requirements of the Public Works Department prior to recordation. 3. Prior to recordation of LLA No. 2009-004, a reciprocal parking agreement shall be submitted for review and approval. Lot Line Adjustment No. 2009-004 shall not become effective until the ten-calendar day appeal period has elapsed. 2. Lot Line Adjustment No. 2009-004 shall become null and void unless exercised within two years of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The lot line adjustment shall comply with all applicable provisions of the Municipal Code, Building and Safety Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
