LOCATION: 7572 Warner Avenue, 92647 (south of Warner Avenue, west of Nichols Lane) DATE OF ACTION: April 3, 2012 On April 3, 2012, the Planning and Building Department of the City of Huntington Beach took action on your application, and your application was conditionall a roved. Attached to this letter are the conditions of approval for your application. Please be advised that the Department of Planning and Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning and Building is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within Administrative Permit No. 11-I April 3, 2012 Page 2 of 2 • ten (10) calendar days of the date of the Planning and Building Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the filing fee for the above noted application is Frida A rill 13 2012 at 5:00 m. I CONDITIONS OF APPROVAL -ADMINISTRATIVE PERMIT NO. 11-026: 1. The site plan, floor plans, and floor sections received and dated December 16, 2011, and the revised parking lot stripping plan received and dated March 28, 2012, shall be the conceptually approved layout with the following modifications: a. On Sheet A-1, the "Project Data" section shall be modified so that the project square footage noted is 21,399 sq. ft. b. On the revised parking lot stripping plan, depict the parallel parking stalls with an 8 ft. stripped maneuvering area between every two spaces. c. On the revised parking lot stripping plan, a vehicle turnaround space shall be provided at the end of the new dead-end parking aisle. d. On Sheet A-1, the parking layout depicted shall be consistent with the parking layout of the revised parking lot stripping plan. e. On Sheet A-2, the floor plans shall delineate and provide the square footage of all areas allocated for instructional and non-instruction area. The total instructional and non- instructional area shall be noted and adhere to the area maximum specified by Condition No. 3. 2. Prior to the issuance of building permits, one set of plans revised in accordance with Condition No. 1 shall be submitted to the Planning Division for review and approval and inclusion in the entitlement file. 3. Prior to the issuance of a Certificate of Occupancy, the following shall be completed: a. The parking lot shall be restriped in accordance with the approved parking lot stripping plan. b. A parking management plan shall be submitted to the Planning Division for review and approval in order to indicate where the training parking spaces are provided versus the other onsite uses. 4. The maximum number of students/patrons, utilizing personal training sessions shall not exceed the number of parking spaces allocated to the tenant space. Based upon the occupied floor area (approximately 21,399 sq. ft.) and the applicable parking standard of one parking space per 1,000 square feet, the number of parking spaces allocated is 21. Additional parking stalls provided above the existing 91 onsite parking stalls shall be allocated to the personal training facility. The total number of students at the facility shall not exceed the additional students gained by restriping the parking lot for approximately 6-9 spaces or 6-9 students. 5. The instructional area shall not exceed 75 percent of the total floor area occupied by the personal enrichment use, or 16,049 square feet. Only the uses described in the narrative dated received on January 23, 2012 and January 26, 2012, shall be permitted. No special sporting events may be held at the facility b. All exterior doors shall remain closed during the hours of personal training. c. Personal training sessions shall be prohibited a minimum of 15 minutes between the conclusion and commencement of each session. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 11-026 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 11-026 shall become null and void unless exercised within two (2) years of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning and Building Department a minimum 30 days prior to the expiration date. 4. The Planning and Building Department reserves the right to revoke Administrative Permit No. 11-026, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
