the Neighborhood Notification process is required You may review the proposed plans at

Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the
action taken by the Director of Planning becomes final, unless appealed A person
desiring to appeal the decision shall file a written notice of appeal with the Planning
Department within ten calendar days of the date of the Planning Department's action The
notice of appeal shall include the name and address of the appellant,
the decision being appealed and the basis for the appeal A filing fee shall also
accompany the notice of appeal. The appeal fee is $494 00 The appeal period starts at the
end of the 10-day review period.

1. Project shall comply with the current state building codes adopted by the City at the time of
permit application submittal. Currently they are 2010 California Building Code (CBC), 2010
California Mechanical Code (CMC), 2010 California Plumbing Code (CPC), 2010 California
Electrical Code (CEC), 2010 California Energy Code, and The Huntington Beach Municipal
Code (HBMC). Compliance to all applicable state and local codes is required prior to
issuance of building permit.
2. Provide building code analysis showing the allowable Floor area per CBC Chapter S.
3. Provide compliance to disabled accessibility requirements of Chapter 11B of CBC.
a. Second floor/mezzanine must be accessible to disabled persons. Provide elevator/ramp
to the second floor/mezzanine.
b. The accessible parking stalls must comply with CBC Section 1129B.
• The number of accessible parking stalls must comply with Table 11B-6.
• The unloading zone must be located on the passenger side.
c. Provide accessible path of travel from public sidewalk to the building entrance(s). The
paths of travel must comply with CBC Section 1133B.
d. All restrooms must be accessible to disabled persons. CBC Section 1115B.
• The number of required plumbing fixtures must comply with CPC Table 4-1.
• Accessible toilet compartments - Show location of grab bars/18" clear space
between centerline of water closet and adjacent wall/32" clear space between
water closet and adjacent wall/48" clear space in front of water closet, etc..
4. Provide egress plans - CBC Chapter 10
a. Show the occupant load factors/occupant loads in each room/area.
b. Show exit paths of travel.
c. Provide panic hardware for all exit doors serving group A-2 occupancy.
d. Exit doors serving group A-2 must be swung in direction of travel.
e. Two exits are required from second floor/mezzanine.

1. Occupancy of any building is prohibited and a business license will not be issued until the building has been
inspected and a certificate of occupancy is issued.
2. No electrical service will be released for any existing building until the service has baen inspected and
certified safe. All applicants for occupancy In an existing building are required to schedule an electrical
'fuse up' inspection in the Department of Community Development at the time this application is filed.
3. Change of occupancy or use inspection fee. Whenever it is necessa ry to make inspection of a building or
premises in order to determine if a change maybe made in the characterofoccupancyor use of the building

5. Huntington Beach Fire Code Section 10.301 requires fire extinguisher selection and distribution per the

Use Permit No. 87-82 is a request to construct a 13,936 square foot multi -tenant
automotive center on a parr-c! with an existing ScKins Warehouse.
This request Is covered by Environmental Assessment No. 87-48.
Staff member, Kelly Main, reported that this is a requ-st to build an auto center within an
existing warehouse on Warner Avenue and Nicols Street . The proposed auto center will be
14,000 sq. ft. and shares the site with Bekins Warehouse, where goods that have not been
claimed by the owners are stored. Ms. Main reported that there are trucks stored on the
site which come In and out of Bekins everyday. The applicant has proposed I l tenants for
this center. Because of the residential property located across the street along with the
intense use anticipated on this site , staff is recommending a 25 ft. setback In front rather
then the 10 ft. required by code . The applicant was required to get a noise report because
the area is zoned for residential use. Staff Is also proposing that 15 feet be added to the
back of - t he rear portion of the building. The applicant is presently providing more than
adequate parking, however staff will have to reevaluate the parking situation because cc'
the 25 foot setback. Staff has also decided to allow the applicant to take out the
landscaping between the parking bays to make room for more parking. Staff Is requesting
25 feet of landscaping and a 6 foot retainer wall In the front of the property for screening
the noise fro m the activity.
The public hearing was opened and David Mendelsohn, ap,licant, was present . Staff and
the applicant discussed the purpose of the noise report and its conclusion. Mr. Strange
asked the applicant if the businesses would be automotive repair. The applicant stated
yes, adding that he s'ould be willing to put the auto body shop toward the back third of the
building, and the general tune up work in the front.
Mr. Strange expressed c' ,tern about work l:zi,ig dine in the parking lot and Inoperable
vehicles and cars being stored in the parking lot. Mr. Strange asked the applicant if he
would oppose the city conditioning that only six major automotive businesses be allowed
and the-remainder of the eleven be minor businesses . Applicant agreed. Stiff requested
one,tree per planter. Limit the hours of operation from 7:00 a.m. to 8:00 p.m. Monday
through Saturday and Sunday the business hours will be re< ulated by the Municipal Code.
Applicant agreed. Applicant will be required to ge to the 6sign Review Board for colors,
elevations , roof =lines and materials . Staff and applicant agreed that the wall will be four
feet high. Staff requested a parking management plan showing t e d-tall of the parking
area.
There was no one else present to speak for or against the project so the public hearing was
closed.
USE PERMIT NC 17-82 AND ENVIRONMENTAL ASSESSMENT NO. 87-48 WAS
APPROVED BY" ._ ACTING ZONING ADMINISTRATOR WITH THE FOLLOWING
FINDINGS AND CONDITIONS:

I.- The establishment , maintenance and operation of the use will not be detrimental to:
-a. The general wel!are of persons residing or working In the vicinity;
b. Pro perty and iraprovements in the vicinity of such use or building.

2. The granting of tht use permit will not adversely affect the General Plan of the
' City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
4. The location, site layout, and design of the proposed use properly adapts the
proposed structures to streets, driveways, and other adjacent structures and uses In
a harmonious manner.
5. The access to and parking for the proposed use does not create an undue traffic
problem.
SPECIAL CONDITIONS OF t PPROVAL:
1. A revised site plan shall be submitted depicting the modifications described herein:
a. A 15 foot front setback for the auto center which extends to the driveway
entrance and is fully landscaped.
b. ' A 4 foot wall which extends from the auto center to the driveway entrance
along the front setback.
c. Two interior planters among the parking spaces which line the auto center. One
of the planters shall be located at the front end (Warner side) of the parking
bay. Each of the two planters shall contair at least one tree.
d. An extension to the rear of the auto center to compensate for the Increased
setback requirement. The extension snail not Impede into required drive aisle
width or fire lane area.
e. A trash area sufficient for the number of auto center tenants and the Bekins
Warehouse and centrally located. The sails of the trash area should be
compatible with the building and the screening wall in the front of the
property. The trash enclosure shall meet all applicable codes and standards.
Corrected measurements from property line to the center line of Warner
Avenue (from 45.5 feet to 60.5 feet).
2. Prior to issuance of building permits, the applicant shall file a pa-cell map or parcel
map waiver request to legalize the existing parcel. The parcel map or plat mar) and
notice shat. be recorded with the Orange County Recorder and a copy of the
recorded map or plat filed with the Department of Community Development prior to
final inspection or occupancy or provide proof of legal lot.
3. Prior to issuance of building permits, the applicant shall submit the folio-zing plans:
a. Landscape and irrigation plan to the Department of Community Development
and Public Works for review and approval Including revised landscape plans for
the 10 foot front setback of Bekins. Trees on site shall be minimum of 24 Inch
box or greater per landscaping code.
b. Rooftop Mechanical Equipment Plan. Said plan shall Indicate screening of all
rooftop mechanical equipment and shall delineate the type of material proposed
to screen said equipment.

c. Grading plan to the Department of Public Works fcr review and approval. A
plan for slit control for all water run off from the property d•"ring construction
and during initial operation of the project may be required by the Director of
Public Works if deemed necessary.
4. Installation of required landscaping and irrigation systems shall be completed prior
to final inspection.
5. Prior to issuance of building permits:
a. The noise report submitted by the applicant must be approved by the Orange
County Health Care Agency /Environmental Health.

b. The revised plans must be reviewed and approved by the Design Review Board
with respect to colors , elevations , roe-Vine, blockstyle and materials.
6. No special event or public auction shall take i'ace on the premises without obtaining
a special events permit from the Department of Community Development.
7. Prior to issuance of building permits all street de.4ications and improvements must
be made or cleared to the satisfaction of the Public Works Department.
8. Remove and replace deteriorated public improvements to Public Works
specifications.
9. On-s:te water facilities (i.e. Fire Hydrant) shalt be dedicated to the City in a 10 foot
easement in a vehicular accessway to Public Works specifications.
10. Dedicate Warner Avenue right-of-way to ultimate (30 foot existing to 60 foot
ultimate).
I[. The site shall be limited to 6 or fewer tenants doing major auto repair pursuant to
the definition of "major auto repair" in Article 908.13. The balance of tenants may
be, but are not limited to, businesses doing minor auto repair.
12. The roll-up door located on the east side of the Bekins building shall not be used for
loading or unloading.
13. A planned sign program shall be approved for all signing. Said program shall be
approved prior to the first sign request.
14. On-site fire hydrants shall be provided In number and at locations specified by the
Fire Department.

15. Fire accessanes shall be maintained . If fire lane violations occur and the services
of the Fir Department are required, the applicant will be liable for expenses
incurred.
16. Maximum separation between building wall and property line shall not exceed two
Inches (2").
17. Driveway approaches shall be a minimum of twenty -seven feet (27') in width and
shall be of radius type construction.

21. Automatic sprinkler systems will be Installed throughout to comply with Huntington
Beach Fire Department and Uniform Building Code Standards . Shop drawings will be
submitted to and approved by the Fire Department prior to installation.
22. Fire extinguishers will be installed and located in areas to comply with Huntington
Beach Fire Code Standards.
23. One (1) fire hydrants will be Installed prior to combustible construction. Shop
drawings will be submitted to the Public Works Department and approved by the
Fire Department prior to Installation.
24. Fire lanes will be designated and posted to comply with Huntington Beach Fire
Department Standard No. 415.
25. Address numbers will be Installed to comply with Huntington Beach Fire Cede
Standards. The size of the numbers will be the following:
a. The number for the building will be sized a minimum of ten (10) Inches with a
brush stroke of one and one-half (1-1/2) Inches.
b. Individual units will be sized a minimum of four (4) Inches with a brush stroke of
one-half (1/2) inch.
26. A needed fire flow shall be not less than 4006 GPM.
27. West perimeter of fire lane and "hammerhead" turnaround shall be painted on the
asphalt and be kept clear at all times. '
28. Natural gas shall be stubbed in at the locations of water heaters , and central heating
units.
29. Low-volume heads shall be used on all spigots and water faucets.
30. If lighting Is included in the parking lot, high-pressure sodium vapor lamps shall be
used for energy savings . All outside lighting shall be directed to prevent "spillage"
onto adjacent properties.
31. All applicable Public Works fees shall be paid prior to Issuance of building permits.
INFORMATION ON SPECIFIC CODE RE UIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division , and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances , and standards.
3. The applicant shall comply with no standards pursuant to the Municipal Code,
Section 8.40

If any Hazardous materials are to be used on site , the business must comply with
Chapter 1758 of the City's Municipal Code which requires any business that handles
or stores hazardous materials , including waste , to Inventory the hazardous materials
on site and prepare a business emergency plan In case of an accidental release of
toxic material. Additionally , all hazardous materials, Including waste , must be
handled and stored In accordance with the Uniform Fire Code. Waste oil Is
considered a hazardous waste.
A detailed soils analysis shall be prepared by a registered Soils Engineer. This
analysis shall Include on-site soil sampling and laborato ry testing of materials to
provide detailed recommendations regarding grading, chemical and fill properties,
foundations , retainh G walls, streets , and utilities.
Landscaping shall comply with Articles 960 and 953 of the Huntington Beach
Ordinance Code.
Prior to issuance of building permits the applicant shall submit a parking
management plan.
The Zoning Administrator reserves the right to revoke this use permit If any
violation of these conditions of the Huntington Beach Ordinance Code occurs.
