Attached to this letter are the findings and conditions of approval of your application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department becomes final at the expiration of the ten-day appeal period unless appealed by the property owner. To appeal the decision, the property owner shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. Due to unique circumstances, the sign's immediate removal will result in a substantial hardship for the applicant. As a restaurant use, adequate signage is imperative to support business activity. Since the subject building is setback 47 feet from the front property line, the applicant is requesting permission to allow the existing pole sign to remain so that its removal and replacement can be budgeted, and superior advertisement for the new restaurant business location is provided to high volume traffic along Warner Avenue. 2. The sign will not adversely affect other lawfully erected signs in the area. The subject sign has been maintained in its current location since original installation without having created an adverse impact on signs upon adjacent properties, and is not located in a manner that creates visual clutter along Warner Avenue. 3. The sign will not be detrimental to properties located in the vicinity because the current non- conforming sign does not conflict with traffic visibility on Warner Avenue. The sign will identify the building correctly and will allow visitors in the general area to easily locate the property. 4. The sign will be in keeping with the character of the surrounding area because the subject sign is proposed to be refaced in a manner to complement the building's colors and design as well as adequately represent the new restaurant business location. There are no proposed changes that would alter the height or size of the existing pole sign. 5. The sign will not obstruct vehicular or pedestrian traffic visibility and will not be a hazardous distraction. The sign is located beyond the traffic sight angle visibility triangle and does not conflict with or impede pedestrian traffic on Warner Avenue. The proposed changes to the existing sign would provide simple and easy to read information from a distance, increasing visibility without creating a hazardous distraction. CONDITIONS OF APPROVAL - LIMITED SIGN PERMIT NO. 2007-002: 1. Limited Sign Permit No. 12-01 shall be valid for up to two years, (retroactive from May 2, 2012 to May 2, 2014). At that time the existing 20-foot high, 42-square foot freestanding pole sign fronting Warner Avenue shall be removed. 2. Within 30 days of the date of action, the applicant shall file a cash bond in the amount of $1,000.00 with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the existing 20-foot high, 42-square foot freestanding pole sign fronting Warner Avenue. If the sign is not made to conform with the applicable provisions of the sign ordinance after two (2) years from May 2, 2012, the city of Huntington Beach or its agents or employees may enter on the property where said signs are located and remove said signs and the cost of removal shall be deducted from the cash bond and summarily forfeited and paid over to the City of Huntington Beach, and the remainder, if any, returned to the person depositing the bond. 3. The Planning and Building Department reserves the right to rescind this limited sign permit approval in the event of any violation of the terms of the applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing and shall be based on specific findings. LSP 12-01 May 22, 2012 Page 3 of 3 INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should coo- perate fully in the defense thereof.
