The project is located within the Wesley Park district. LOCATION: 814 Main Street, 92648 (east side of Main Street, between Crest Ave. and 10th St.) DATE OF ACTION: March 6, 2012 On March 6, 2012, the Planning and Building Department of the City of Huntington Beach took action on your application, and your application was conditionail a roved . Attached to this letter are the findings and conditions of approval for your application. Please be advised that the Department of Planning and Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to the issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning and Building is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Planning and Building Department's action. The notice Administrative Permit No. 12 002 March 6, 2012 0 of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the filing fee for the above noted application is Frida March 16 2012 at 5:00 m. The alteration is necessary to secure added safety or reduce the fire hazard or to improve the aesthetic appearance of the structure's architecture by bringing the design into greater conformance with the surrounding neighborhood. No additions to the existing building are proposed. The exterior modifications will consist of painting the building exterior, replacing the wood siding, and replacing the windows. The project will comply with the Secretary of Interior Standards for the rehabilitation of a historic property, located within the Wesley Park District. 2. The alteration or addition will not increase the number of stories. No additions to the existing building are proposed. The building will remain single story in height. 3. The alterations will not cause the floor area to exceed more than ten (10%) percent of the floor area the structure contained at the time the use became nonconforming. No additions to the existing building are proposed. Exterior modifications will not affect the floor area. Patio (slab), as conditioned, shall not contain any patio/porch covers. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 12-003: 1. The site plan received and dated January 30, 2012, shall be the conceptually approved layout with the following modifications: a) Any existing windows to be replaced shall comply with the Secretary of Interior Standards for the rehabilitation of a historic structure. The replacement windows shall consist of wood-sash windows with Craftsman style detailing. b) Landscaping, including trees and shrubs, in the front yard shall not be removed in order to maintain the streetscape with the neighborhood. The proposed porch or patio shall not be constructed at the front of Unit No. 1. c) Any proposed water heater shall be setback a minimum of 30 inches from the property line. 2. Prior to the issuance of building permits for the exterior modifications, the following shall be completed: a) A plan shall be provided to the Planning Division documenting and identifying the windows to be replaced, including a "before" picture and the treatment that will be applied to the window. b) Any unpermitted structures shall be permitted and verified for compliance with the Huntington Beach Zoning and Subdivision Ordinance. c) Pictures of the interior design and architecture of the building shall be provided to the Planning Division for documentation of historical features within the building. Historical features characteristic of the building's age and time period shall be preserved. 3. Prior to the final of building permits, the following shall be completed: a) The exterior modifications shall comply in accordance with Condition No. 1. G:\PLANNING\Administrative Permits\2012WP 12-003 (814 Main) - Metzger Exterior Mods.docx b) The Planning Division shall verify compliance of the exterior modifications with the Secretary of Interior Standards including painting, replacement of windows, and replacement of siding. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 12-003 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 12-003 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning and Building Department a minimum 30 days prior to the expiration date. 4. The Planning and Building Department reserves the right to revoke Administrative Permit No. 12-003, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. INDEMNIFICATION AND HOLD HARMLIESS CONDITION The owner of the property which is the subject of this project and the project applicant, if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the city or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof.
