On April 5, 2011, the Planning and Building Department of the City of Huntington Beach took
action on your application, and your application was conditionall a roved. Attached to this
letter are the conditions of approval for your application.
Please be advised that the Department of Planning and Building reviews the conceptual plan as
a basic request for entitlement of the use applied for and there may be additional requirements
prior to issuance of building permits. It is recommended that you immediately pursue
completion of the conditions of approval and address all requirements of the Huntington Beach
Zoning and Subdivision Ordinance in order to expedite the processing/completion of your
project. The conceptual plan should not be construed as a precise plan, reflecting conformance
to all Zoning and Subdivision Ordinance requirements.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Department of Planning and Building is final unless an appeal is filed to the
Planning Commission by you or by an interested party. A person desiring to appeal the

decision shall file a written notice of appeal to the Secretary of the Planning Commission within
ten (10) calendar days of the date of the Planning and Building Department's action. The notice

appeal must be in writing and must set forth in detail the action and grounds by which the
applicant or interested party deems himself aggrieved. The last day for filing an appeal and
paying the filing fee for the above noted application is Frida A rill 15 2011 at 5:00 m.

CONDITIONS OF APPROVAL -ADMINISTRATIVE PERMIT NO. 11-007:
1. The floor plan received and dated March 10, 2011, shall be the conceptually approved
layout.
2. The maximum number of students/patrons utilizing the facility at any time shall not exceed
the number of parking spaces allocated to the tenant space. Based on the occupied floor
area (approximately 5,137 sq. ft.) and the applicable parking standard of one parking space
per 500 square-feet, the number of parking spaces allocated is 10. Therefore, the number
of students shall not exceed 10 during any session.
3. The instructional area shall not exceed 75 percent of the total floor area occupied by the
personal enrichment use, or 3,852 square feet.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The applicant and/or applicant's representative shall be responsible for ensuring the
accuracy of all plans and information submitted to the City for review and approval.
2. Administrative Permit No. 11-007 shall not become effective until the ten-calendar day
appeal period has elapsed.
3. Administrative Permit No. 11-007 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the
Director pursuant to a written request submitted to the Planning and Building Department a
minimum 30 days prior to the expiration date.
4. The Planning and Building Department reserves the right to revoke Administrative Permit
No. 11-007, pursuant to a public hearing for revocation, if any violation of these conditions or
the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
5. The development shall comply with all applicable provisions of the Municipal Code, Building
Department, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.

Your application was acted upon by the Zoning Administrator of the City of Huntington Beach
on February 12, 1997, and your request was diti null r ved. Included ;n this letter are
the Conditions of Approval for this application.
Under the provisions of the Huntington B each Zoning and Subdivision Ordinance, the action
taken by the Zoning Administrator is final unless an appeal is filed to the Planning Commission
by you or by an interested party. Said appeal must be in writing and must set forth in detail the

appeal must be accompanied by a filing fee of Two Hundred Dollars ($200.00) if fne appeal is
filed by a single family dwelling property owner appealing the decision on his own property and

Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any
application becomes null and void one (1) year after the final approval, unless actual construction
has begun.
FINDINGS FOR APPROVAL - TI L U E NO 6-0 :
1. Conditional Use Permit No. 96-91 for the establishment, maintenance and operation of a rock
climbing school in an existing 2,600 sq. ft-suite will not be detrimental to the general welfare
of persons wrorldng or residing in the vicinity or detrimental to the value of the property and
improvements in the neighborhood. The industrial complex contains two buildings that have
a total square footage of 44,300, The complex was built under the parking standards for
manufacturing uses which was 1 space per 500 sq. ft. or 89 parking spaces required. The
subject site has 90 spaces provided. Based on that parking standard, the subject unit, Unit I,
requires 6 spaces. The proposed use, however, would require 23 spaces based on the parking
standard of I space per 100 sq. ft. of instruction area, where the proposed group instruction
area is 1,742 sq. ft.. All remaining areas (or 858 sq. ft.) wouldbe calculated at: 1 per 200 sq.
ft. (Policy .Memo CI-46)). The additional 17 spaces that Unit I is lacking would be provided
through the proposed joint use agreement.
Furthermore, based on the applicant's analysis on data obtained from existing rock climbing
schools, peak hours tend to occur on weekday evenings and on weekends, as opposed to 9 am
- 5 pm on weekdays. In addition, since the.r, rt of rock climbing tends to favor group
involvement rather than individual recreation, it is likely that some people will carpool to the
project site, thus minimizing the parking impacts even more. This information has been
helpful in supporting the Joint use parking agreement The proposed business hours are 11 am
to 10 pm Monday through Friday, 9 am to 3 pm on Saturday and 11 am- 6 pm on Sunday.
The anticipated weekly usage is 215 persons and a traffic impact fee will be required.
2. The conditional use permit will be compedble with surrounding uses because the rock
climbing school would be conducted wholly within the unit. Potential noise impacts would
be negligible since the unit is surrounded by industrial uses which usually generate greater
noise levels.
3. The proposed indoor rock climbing school will comply with the provisions of the base
district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and
Subdivision Ordinance and any specif . condition required Rr the proposed use in the district
in which it would be located. The IG (Industrial, General) zon° allows personal enrichment
uses with the approval of a conditional use permit,

4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of I-F2-d (Industrial, 0.5 floor area ratio,
design overlay) on the subject property. In addition, it is consistent with the following goals
and policies of the General Plan:
a. RCS I Enrich the quality of life for all citizens ofHuntington Beach by providing
constructive and creative leisure opportunities.
The applicant has stated that the sport of rock climbing is an activity that people of all
ages can enjoy. Since it favors group involvement, as opposed to individual
recreation, it could be an activity that other groups could benefit from, such as boys
and girls clubs, businesses interested in developing team building skills, or citizens
interested in hosting rock climbing parties.
b. RCS 1,1 Encourage recreational opportunities uni, -- to Huntington Beach which
will enhance visitation and economic development; an. RCS 13.4 Encourage and
facilitate the development of a wide variety of revenue generating recreational
activities such as "corporate " picnic facilities, wedding facilities, infant, child, or
senior day care, fishing facilities, golf courses, driving ranges, batting cages, roller
hockey, sportifieltls, etc.
This would be the first rock climbing school in-the City and one of the lew in Orange
County (the closest schools are in Costa Mesa and Anaheim Hills). There is a
potential that the success of this use could enhance visitation to the City, which could
positively affect the City's economic growth.
DI I OF A R V - CQND NAL U E PERMIT N . 6- :
1. The site plan, floor plans and elevations received and dated October 18, 1996 shall be the
conceptually approved layout,
2. The miscellaneous items stored on several of the parking spaces located in the southern
portion of the lot shall be removed within ten (10) days from the date of C- s approval.
3. .All code required parking spaces must remain h:ree of debris and inoperable vehicles and Gral1
be accessible to all tenants at all times.
4. The use shall comply with thu following:
a. Hours of operation shall be: 10 am-10 pm, Monday to Friday; 9 am- 8 pm on
Saturdays and 11 am-6 pm cn Sundays.

b. There shall be no group instruction between 10 am- 4 pm, Monday to Friday.
c. Group classes are limited to 10 students per class.
5. Prior to submittal for building permits, the following shall be completed:
a.Zoning entitlement conditions of approval shall be printed verbatim on the cover page of
all the working drawing sets used for issuance of building permits (architectural,
structural, electrical, mechanical and plumbing).
6. Prior to issuance of building permits, the following shall be completed.
a. Joint use parking shall require a Joint Use Parking Agreement be recorded prior to
issuance of permits or occupancy. The legal instrument shall be submitted to the
Department of Community Development a minimum of 30 days prior to building permit
issuance. A copy of the legal instrument shall be approved by the City Attorney as to
form and content and, when approved, shall be recorded in the Office of the County
Recorder. A copy of the recorded agreement sl it be filed with the Department of
Community Development.
7. Prior to final building permit inspection and approval or issuance of a Certificate of
Occupancy,-the following shall be completed:
a. The property owner shall submit a letter to the Community Development Department for
inclusion in the project file stating that all of the existing tenants are aware of the
restrictions of the Joint Use Parking Agreement which affects their hours of operation at
the subject site. The letter shall also state that all future tenants will be made aware of the
restrictions of the Joint Use Parking Agreement which might impact their hours of
operation.
b. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off-site facility equipped to handle them.
S. The Community Development Director ensures that all conditions of approval herein are
complied with. The Community Developmer t `lirector shall be notified in writing if any
changes to the site plan, elevations and floor.;. s are proposed as a result of the plan check
process. Building permits shall not be issued until the Community Development Director has
reviewed and approved the proposed changes for conformance with the intent of the Zoning
Administrator's action and the conditions herein. if the proposed changes are of a substantial
nature, an ar-iendment to the original entitlement reviewed by the Zoning Administrator may
be required pursuantto the HBZSO.

7. All signs shall conform to the HBZSO. Prior to installing any new signs, or changing sign
faces, a building permit shall be obtained from the Department of Community
Development.
8. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice
of-Exemption at the County of Orange Clerk's Office. The check shall be made out to
the ra a and submitted to the Department of Community Development
within two (2) days of the Zoning Administrator's action.
The Department of Community Development will perform a comprehensive plan check relating
to all Municipal Code requirements upon submittal of your completed structural drawings.
Please be advised that the Zoning Administrator reviews the conceptual plan as a basic request
for entitlement of the use applied for in relation to the vicinity in which it is proposed. The
conceptual plan should not be construed as a precise p ion reflecting conformance to all Code
requirements.

DEFINITIONS
Association . "Association" means the Gothard Street Industrial Owners Association, a
nonprofit mutual benefit corporation, and its successors in interest. The Association is an
"association" as defined in Section 1351(a) of the California Civil Code.
Association Pro er . "Association Property" means all the real property and personal
property designated by the Declarant as Association Property and made subject to the restrictions
on Association Property established in the Governing Documents. Any references in the
Declaration to Association Property are references to the Association as a whole and to portions
thereof. Association Property specifically includes that portion of the Project as Association
Property in this Condominium Plan. The Association Property includes, but shall not be limited
to, landscaped areas, planters, trash enclosures, the electrical room(s), walkways, driveways,
parking areas, ramps, passageways, pedestrian areas, the Buildings (excluding the Units
contained therein) and their bearing walls, including roofs, foundations, central heating, central
air conditioning equipment (except related duct work within a Unit which exclusively serve that
Unit), flues, chutes conduits, gas, water and waste pipes, plumbing, wires and other utility
installations (except those portions designed to serve a single Unit or the outlets thereof located
within the Unit) that are required to provide power, light, telephone, gas, water, sewerage, and
drainage, together with sprinklers, sprinkler pipes and sprinkler heads that protrude into the
airspace of the Unit.
Building . "Building" means any building or enclosed structure which contains one (1) or more
Units.
Cam. "City" means the City of Huntington Beach, County of Orange, State of California, and
its various departments, divisions, employees and representatives.
Common Area. "Common Area" means those the volumes of airspace in this Condominium
Plan, which shall be owned by the Owners in the Project as tenants-in-common. Any references
in the Declaration to Common Area are references to the Common Area as a whole and to
portions thereof.
Common Pro er . "Common Property" means the Common Area, the Association
Property and the Improvements constructed therein. Any references in the Declaration to the
Common Property are references to the Common Property as a whole and to portions thereof.
Condominium. "Condominium" means an estate in real property as defined in California
Civil Code Section 1351(f). A Condominium consists of an undivided fee simple ownership
interest in fee in the Common Area in the Project, together with a separate ownership interest fee
in a Unit and all easements appurtenant thereto. The undivided fee simple interest in the
Common Area in the Project is appurtenant to each Unit and is a fraction having one (1) as its
numerator and the number of Units in the Project as its denominator and shall be held by the
Owners of Condominiums as tenants-in-common.

Condominium Plan. "Condominium Plan" means this Recorded Condominium Plan for the
Project, as currently in effect, for the Project consisting of (a) a description or survey map of the
Project which shall refer to or show monumentation on the ground, (b) a three-dimensional
description of the Project, one or more dimensions of which may extend for an indefinite
distance upwards or downwards in sufficient detail to identify the Association Property,
Common Area and each Unit, and (c) a certificate consenting to the Recordation thereof signed
and acknowledged by the record owner of fee title to the Project or portion thereof and by either
the trustee or the Mortgagee of each Recorded Mortgage encumbering such Project.
Declarant. "Declarant' 'means Gothard Street Industrial, L.P., a California limited partnership,
its successors and any Person to whom it assigns any of its rights and powers under this
Declarations by express written assignment. Any such assignment may included some or all of
the rights of the Declarant and may be subject to such conditions or limitations as Declarant may
impose in its sole and absolute discretion. As used in this section, successor means a Person who
acquires Declarant or substantially all of its assets, or who merges with Declarant, by sale,
merger, reverse merger, consolidations, sale of stock, membership interests or assets, operation
of law or otherwise. Declarant is a builder as described in California Civil Code Section 1375.
Declaration. "Declaration" means the recorded "Declaration of Covenants Conditions and
Restrictions and Reservation of Easements for Gothard Street Industrial Owners Association", as
amended and restated from time to time.
Exclusive Use Area. "Exclusive Use Area" is that portion of Association Property subject to
an exclusive use easement granted to the Owner of one or more (but not all) of the Units. The
Association shall have the right to create Exclusive Use Areas in the future as reasonably
necessary for the development of the Project.
Improvement . "Improvement" means any improvement constructed or installed above or
below ground, including without limitation all Buildings, parking areas, roadways, walkways,
curbs, gutters, sewer laterals, walls, poles, signs, exterior lighting and lighting standards, exterior
air conditioning equipment, antennae, hedges, berms, windbreaks, trash enclosures, the paint on
all Buildings, landscaping, irrigation facilities, trees, shrubs, plazas, planters, stairways, railings,
ramps, utility lines, pipes and conduits and any replacements, additions, repairs or alterations
thereto of any kind whatsoever. Improvements within the Association Property may include,
without limitation, directory or monument signs, directional signs, trash enclosures, parking
areas, pedestrian and vehicular accessways and landscaped areas.
Project. "Project" means all of the real property shown in this Condominium Plan. The
Project is a "common interest development," and a "condominium project" as defined in
Sections 1351(c) and 1351(f) of the California Civil Code. References to the Project includes
references to all or any portion of the Project.

Unit . "Unit" means a separate interest in a volume of space as defined in Section 1351(f) of the
California Civil Code. Each Unit is a separate freehold estate, as separately shown, numbered
and designated in this Condominium Plan. In interpreting deeds, the Declaration and this
Condominium Plan, the actual boundaries of each Unit shall be deemed to extend to (i) nineteen
(19) feet above the unfinished surface of the top of the floor slab, (ii) the unfinished surface of
the top of the floor slab and (iii) the unfinished interior surfaces of the walls which establish the
perimeter walls of the Unit. Each Unit shall include related duct work for central heating and
central air conditioning and windows, doors, flues, chutes conduits, gas, water and waste pipes,
plumbing, wires and other utility installations designed to exclusively serve the Unit or any
outlets thereof located within the Unit. The foregoing interpretation shall apply notwithstanding
any other description expressed in the deed, this Condominium Plan or the Declaration,
regardless of settling or lateral movements of Improvements, and regardless of variances
between Unit boundaries shown in this Condominium Plan or and/or grant deed and those of the
Improvements.
