Due to a change in management, the appli- cant is requesting to alter the sign fascia, and maintain its extended use, Administrative Action No. 83-2 is a request to permit the extended use of a nonconforming pole sign o- an existing restaurant site. The maximum permitted height for this pole sign is 20 feet with a maximum permitted area of 100 square feet- The existing sign is 25 feet in height, with a total area of 110 square feet. Coupled with this is the fact that the sign overhangs the public riciht:-©f way by approximately 3 feet all occupancy. That the sign will not adversely affect other lawfully erected signs in the same area; c. That the sign will not be detrimental to the property located in the vicinity of the property on which said sign is located; That the sign will be in kce'_zth the character of the surround - ing neighborhood; and That the s lgn shall not obstruct the vision of vehicular or pedes- trian traffic, will not adversely affect other signs in the area, is not detrimental to the surrounding properties; and will not obstruct pedestrial or ve- hicular traffic vision; The staff has reviewed Administrative Action to, 83-2 and made the fol- lowing determination: The applicant has demonstrated that strict cost- pliance with the ordinance code will result in a'substantial economic hardship. The applicant has also demonstrated that the existing sign to all provisions of the Huntington Beach ordinance Code. If the applicant does not ^oncur with the above recommendation, then the staff recommends that ,,he Planning Commission deny Administrative Action No. 83-2 and require the applicant to bring the existing non_ conformning sign into conformance with all provisions of Article 976 in view of the above information, the staff racor:ncnas that if the ap- plicant concurs, the Planning Commission allow the continued use of the nonconforming sign for a period not to exceed two (2)years, At the conclusion of this two-year period, the sign shall be made to conform. AA 83-2 May 17, 1983 Page 3 SUGGESTED CONDITIONS OF APPROVAL: Prior to issuance of building pe. ,nits, the applicant shall file a cash bond in the amount of $1,50'.00 dollars with the City for purpose of indemnifying the City for any ana all costs incurred in the removal of the sign structure. If the sign is not made to form with the applicable provisions of the sign ordinance after two (2) years from the date of approval, the City of huntingtoa Beach or its agents or employees may enter an the property where said sign is located and remove such sign, and the cost of removal shall be delucted from the cash bond and summarily forfeited and paid over to the City of EHuntington Beach and the remainder, if any, re- turned to the person depositing the bond.
