Presently, the site has six freestanding signs. Heights, of the signs
vary from six (6) feet to twenty-five (25 feet.All signs are lo-
cated within a landscaped planter area within 1-5 feet of the front
property line. Current sign code previsions only allow one freestand-
ing sign along Edinger Avenue, on this site.
The sign structure for which copy is being changed is nine (9) feet in
height and has an area of thirty-four (34) square feet. This adver-
L..sing area is divided into two parts; one identifies the business and
the other identifies a special feature of the business.
To require the entire site to conform to the current code would neces-
sitate the removal of at least five signs including the subject signs.
Section 9760.47 Application to Extend Use of Nonconforming Sign states
that ", . . natw.;.thst-ndxng the provisions of Section 760.47, the
owner of any nonconfoiaing sign or sign structure that is required to
be removed, altered, replaced pursuant to the provisions hereof,
may take application the form provided for such purpose to the
Planning Commission fo,. permission to extend the use of such sign.
Said written application shall be filed not less than 15 days preceed-
ing the date set out in Section 9760.46 for the alteration, removal,
or replacement of said sign or sign structure. After a hearing, the
Planning Commission may grant permission to extend the time for alter-
ation, removal, or replacement of such signor sign structure for a
period determined by the Planning Commission".
Section 9760.48, Nonconforming Sign. Act i on of the Planning Commis-
sion, states that "`fore :eran xng ally extension under this section
the Planning Commission must find and determine the following,
a. That because of unique circumstances applicable to the sign al-
teration; removal or replacement within the time specified in
Section 9760 .46 will result in a substant ial economic hardship
or that the applicant will suffer great financial l oss thereby;
That the sign will not adversely affect other lawfully erected
signs in the same area;
C. That the sign will not be detrimental to the property located in
the vicinity of the property on which said sign is located;
That the sign will be in keeping with the character of the sur-
rounding neighborhood; and
That the sign shall not obstruct

The app. ja nt in the attached letter received July 14, !V3 indicates
that be,..<L;C the new business owner was not aware the sign was under
abatement , strict compliance With the Ordinance Code may result in a
substantial economic hardship. The existing sign currently does not
adversely affect other signs in t he area ; i s not detrimental to the
surrounding prope rti es; and does not obstruct pedestrian or vehicular
traffic vision.
In view of the above information, the staff recommends that if the
applicant and property owner concur, the Planning Commission allow the
continued use of the nonconforming sign for a period of two (2) years,
During the two (2) year period, the property owner shall pursue a planned
sign program for the entire site. in the event a planned sign program
is not filed or approved, at the conclusion of this two (2) year period,
the sign shall be made to conform to all provisions of the Huntington
Beach Ordinance Code,
If the applicant and property owner do not concur with the above recom-
mendation, then the staff recommends that the Planning Commission deny
Administrative Action No. 83-4 and require the applicant to bring the
existing nonr:onform..r X sign into conformance with all provisions of
Article 976 cf the Huntington Beach Ordinance Code,
SUGGESTED CONDITIONS OF APPROVAL:
1. Prior to issuance of building permits, the applicant shall filea
cash bond in the amount of $1500 with the City for the purpose of
indemnifying the City for any and all costs incurred in the removal
of the sign. structure. If the sgn is not made to conform with the
applicable provisions of the sign ordinance after two years from
the date of approval, the City of Huntington Beach or its agents
or employees may enter on the property where said sign is located
and remove such sign, and the cost of removal shall be deducted
from the cash bond and summarily forfeited and paid over to the
City of Huntington Beach and the remainder; if any,returned to
the person depositing the bond,

Justification
1. Allstate Savings purchased the 7552 Edinger location from roast
Federal Savings. This purchase included the existing monument
aign structure. No records were shown to Allstate Savings indi-
cating that this sign was under abatement. An added feature of
this sign is that it directs the motoring public to the Automatic
Teller Machine facility at the rear of this branch.
There are four other low pro W e monument signs along he frontage
of this major shopping complex. The existing signs are in good
taste and are located near the buildings that they identify thus
providing considerable open space between them,
This sign has been in use for several years and it is our under-
standing that no complaints have been lodged with the City.
Surrounding properties themselves contain signs of this type.
4. The sign is located in a large lawn strip and is away from
pedestrian traffic. It is not located within any "traffic
rislblll'ty triangle" so vehicular traffic vision is not
effected.
The sign was in keeping with the character of the surrounding
neighborhood prior to the purchase of this facility by Allstate
Savings. The proposed sign meets all the criteria of this
center and has been approved by the property manager.

Administrative Action No, 82•-1 is a request to change copy on an
