Emergency medical facility 1.0 SUGGESTED ACTION; 'Staff recommends approval of Administrative Action No, 84-2 with thesuggested conditions of approval contained in'Section 3.o 2.0 GENERAL INS ORMrATION z Administrative Action No. 84-2 is a request by the applicant and the property owner to insert anew sign face into an existing nonconforming rooftop sign located on the subject property. An administrative action application is intended to perwit the continued use of any sign made nonconforming by Article 974 of the Huntington Beach Ordinance Code. 3 a C3 ENVIRONMENTAL STATUS Pursuant to Section 15101 (q) o f the CE QA GUidel nes , the proposed project is categorically exempt 2JA 4.0 ISSUES AND ANALYSIS: The existing nonconfozming rooftop sign is approximately 4 feet 6 inches high by 50 feet in length. Rooftop signs are now prohibited by Article 976,Sign Code, of the Huntington Beach Ordinance Code. Records on file in the Department of Development Services indicate that a building permit was issued for this rooftop sign on May 1, 1968. The applicant 'intends to utilize approximately one-half of the existing sign to identify an existing business. The remaining sign area will be utilized by an additional tenant at a later date. Section 9760.47, Application to Extend Use of Nonconformin Si n; states that , „the owner of any nonconforming sign or sign structure, that ,is required to be removed, altered or replaced pursuant to the provisions thereof, may make app lication to the Planning Commission for the permission to extend the use o f such sign. The Planning Cormission may grant n?er°iisson to extend the time for alteration, removal or replacement of such sign or sign structure for a period determi:'ed by the planning Commissi on". 5.0 RECOMMENDATION., Staff reaomnends that if the applicant and property owner concur, the Planning Commission allow the continuer) use of the nonconforming sign for a period not to exceed twee years from the date of approval. AtLhe end of the two year per iod, th e sign shall be made to confer with all provisions of the Huntington Beach Ordinance Code. If the applicant and property owner do not concur with the above recomm5ndation, then staff. recommends that th=, Planning Commission deny Administrative Aoti.on No. S4-2 and require the applicant to bring the existing nonc :nforming sign into conformance ,with all provisions of Article f76 of the Ordinance Code. SUGGESTED FINDI NGS FOR APPROVAL: 1. Due to unique circumstances applicable to the sign, immediate alteration, removal or replacement of, t;e sign will result in an economic hardship. 2. The sign wi ll not adversely affect other lawfully erected signs in the same area. 3. The sign will not be dct¢ mental to the property located in the vicinity of the property on which said sign is located. The sign will be i,r, tceeping with the character of the surrounding neighborhood. The sign will not obstruct the vision of . vehicular or pedestrian traffic. 4.3-64 - P.C. SUGGESTED CONDITIONS OF APPROVAL 1. Prior to issuance of building permits, the applicant shall file an insurance bond in the amount of $1500 with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the sign structure. If the sign is not made to conform with the applicable provisions 7f the sign code after two years from the date of approval, the City of Huntington Beach or its agents or employees may enter on the property where said sign is located and remove said sign, and the cont of removal shall L. deducted from the bond and summarily forfeited and paid over to the City of Huntington Beach, and the remainder, if any, returned to the Verson depositing he bond. 2 Future sign faces to be placed in the unused port;.on of the existing rooftop sign shall be subject to the rev_.ew and approval of the Department of Development Services and subject to the conditions contained herein. 3. The site plan and elevations received and dated March 8, 19€4, shall be the approved layout.
