Approve Administrative Act?.on No. 84«-4 based on the f ndirgs and
conditions of approval outlined in Section GA.
2.0, GENERAL INFORMATI Ole
Administrative Action No. 54.4 is a request. to change sign copy in two
existing freestanding signs. The signs are 24.5 feet high and exceed
the 20 foot maximum 'ieight allowed in their present location;
therefore,, the signs are nonconforming. Section 9160.47 allows the
continued use of a ,nonconforming sign upon approval by the Planning
Cnmmiss.on.

4.0 ENVIRONMENTAL, STATUS:
Pursuant to section 15101(q )of the California Environmental Quality
Act, no environmental assess"^ent is required.
5,0 ISSUES AND ANALYSIS.
The two existing nonconforming signs are 24.58 f-,t in height and
located within a landscaped planter one foot of the property line.

that is required to be removed, altered or replaced pursuant to the
provisions thereof, may make application to the Planning Commission for
the permission to extend the use of such sign. The Planning Commission
may grant permission to extend the time for alteration, removal or
replacement of such sign or sign structure for a period determined by
the Planning Commission".
6.0 RECOMMENDATION :
Staff recommends that if the applicant and proper ty owner concur
Planning Commission allow the continued use of the nonconforming
for a period not to exceed two years from the date of approval,
end of the two year period, the sign shall be made to conform viprovisions of the Huntington Beach Ordinance Code;
If the applicant and property owner do not concur with th e above
recommendation, then, staff recommends that the Planning Commission deny
Administrative Action No. 84-4 and require the applicant to bring the
existing nonconforming sign into conformance with all provision of
Article 976 of the Ordinance Code.
SUGGESTED PINIINGS FOR APPROVAL:
The signs will not adversely affect other lawfully erected
signs in the same area.
The signs will not be detrimental to the property located in
the vicinity of the property on which said signs are located.
The signs will he in keeping with the character of thesurrounding neighborhood.
5a The signs will not obstruct the vision of vehicularor
pedestrian traffic.
SC]GGHSTED CONDITIONS OF APPROVAL:
lPrior to issuance of building permits, the applicant shall
file a cash bond in the amount of $1500 or its equivalent as
approved by the City Attorney, with the City for the purpose
of indemnifying the City for any and all c<*.ts incurred in the
removal of each sign structure. If the sign is not made to
conform with the applicable provisions of the sign code after
two years from the date of approval, the City of Huntington
Beach or its agents or employees may enter on the property
where said sign is located and remove said sign, and the cost
of. removal shall be deducted from the bond and summarily
forfeited and said over to the. City of Huntington Beach, and
the remainder, if any, returned to the person depositing the
bond.
The property owner shall obtain a separate permit for each
sign.
