Hi Rosemary, we're not adding to the existing trailer or altering it, just adding another separate trailer.
Jennifer Villasenor looked at the trailer addition request in our attached letter from February (HB
Zoning Request Letter), then she sent the response (City of HB Letter) indicating it can be done
under non-conforming regs with an Administrative Permit. We were following the permit process
indicated in her letter. We discussed the project details thoroughly so I assumed her letter was
accurate. Please let me know if this determination has changed. Thanks, I'm happy to discuss via
phone if you like.

Well, then that is a problem. The use is nonconforming. Therefore, only 10% can be
added to a structure. So based on 374 sf of existing 37.4 can be added with an
Administrative Permit. Please clarify.

Hi Rosemary, the existing trailer stays and the new 240 sf trailer is added to the existing facility. I
have not heard back from DCOR yet but if the certificate of occupancy says the existing trailer is 374
then I have to assume that is the actual size. If DCOR tells me differently then I will let you know

Hi Rosemary, I spoke with DCOR and there is no contamination currently at the site, and they are
also unaware of any historical contamination. Also, I have not seen anything for this address on State
WRCB lists for underground storage tanks, brownfields, etc., so to my knowledge there was never
any documented contamination at the site. If for some reason anything comes up in the owner's
internal records research we'll let you know. I hope this helps -- let me know if you need more
information, thanks.

is still contaminated? Has that been an issue in the past? I explained project was merely for the

SURFACE LEASE
This Surface Lease is made and entered into this 20`x' day of December, 2004, by and
between PLAINS EXPLORATION & PRODUCTION COMPANY, a Delaware corporation
("Lessor"), and DOS CUADRAS OFFSHORE RESOURCES, LLC, a Texas limited liability
company ("Lessee").
WITNESSETH:
WHEREAS, Lessor owns or claims all right, title and intcrest in and to the surface of
the following described real estate, to-wit:
Fort Apache Fee Simple, set forth in that certain Corporation Grant Deed dated
12/20/63 between Lilly Realty Corporation, as Grantor, and Union Oil Company of
California, as Grantee, recorded 1/13/94 in Book 6990 at Page 192 in the Official
Records of the County of Orange, State of California which lands are hereinafter
referred to as the "Leased Lands"; and
WHEREAS, Lessee owns the oil and gas processing plant ("Plant")located on the
Leased Lands pursuant to the Purchase and Sale Agreement entered into on September 29,
2004 between the Lessor and Lessee ("Purchase Agreement") and Lessee desires to lease the
Leased Lands from Lessor for the purpose of utilizing the lands in conjunction with its
operation of the said oil processing plant located thereon.

NOW, THEREFORE, for and in consideration of the mutual promises and covenants
contained herein, the parties agree as follows:
1. Lessor does hereby grant, demise, lease and let unto Lessee the Leased
Lands, and the rights and privileges hereunder provided and hereinafter
described and set forth.
2. This lease shall remain in full force and effect until one year after Lessor has
received notice of completion. ofLessee's wellbore abandonment obligations
under Section 10.02 ofthe Purchase Agreement with regard to Platform Eva.
3. As part ofthe consideration for this lease, Lessee agrees to indemnify, defend
and hold Lessor, and its employees, officers, directors, agents,
representatives, affiliates and parent ("Lessor Group) harmless from any and
all claims, damages, suits or obligations, claimed or asserted against Lessor
Group by reason of Lessee's operations orbusiness on the Leased Lands and
against any and all parties asserting such claims, and to defend the Lessor
Group in any and all suits or claims brought against the Lessor Group arising
from Lessee's operations on the Leased Lands, all at Lessee's expense,
including but not limited to reasonable attorney's fees and court costs.
4. Lessee covenants and agrees to pay any taxes which gray be levied upon or
assessed against structures, fixtures or other equipment which maybe located
on the Leased Lands.
5. Lessee agrees that all of its uses ofthe Leased Lands shall comply fully with
all applicable federal, state and local laws, ordinances, rules and regulations,
and shall furnish Lessor with evidence of such compliance as Lessor may
require at any time during the term of this lease.
6. This Agreement may not be assigned by Lessee without the prior written
consent of Lessor. Lessor may freely assign this Agreement, but agrees to
give Lessee notice of such assignment within ninety (90) days after such
assignment has been made.
7. At all times during the term ofthis Agreement, the Lessee agrees to carry and
maintain, with financially sound and reputable insurers and on terms
satisfactory to Lessor, statutory Worker's Compensation and comprehensive
general liability insurance of Five Million Dollars ($5,000,000) concerning
the liabilities assumed hereunder. Such insurance shall name the Lessor and
its agents and representatives as additional insureds and any right of
subrogation against the Lessor and its agents and representatives shall be
expressly waived. In addition, in the event ofcancellation of such insurance,
thirty (30) days' prior written notice will be given to Lessor. No later than
the execution of this lease, Lessee will provide Lessor with Certificates of
Insurance certifying the above-referenced insurance coverage.
S. Subject to the Lessor's prior written approval, which will not be
unreasonably withheld, Lessee may and add fixtures and install equipment on
that portion of the Leased Lands currently occupied by the Plant, but not
otherwise; provided, however, that Lessee shall be solely responsible for all
costs or expenses attributable to such installation, or any other costs
attributable to its use of the Leased Lands.
10. This instrument sets forth the entire agreement and understanding of the
parties in respect to the transaction contemplated herein and supersedes all
prior agreements, arrangements and understandings related to the subject
matter hereof. No representation, promise, inducement or statement of
intention has been made by the parties which is not embodied herein, and
neither party shall be bound by or liable for any alleged representation,
promise, inducement or statement of intention not so set forth herein.
IN WITNESS WHEREOF, Lessor and Lessee have caused these presents to be
executed on the date first mentioned above by its duly authorized employees or agents.

As you know, the subject property has a zoning designation of RM (Residential Medium
Density) and a General Plan Land Use Designation of RM-15 (Residential Medium Density - 15
dwelling units per acre).
Addition of an office trailer at the existing oil separation facility would be subject to approval of
an Administrative Permit (AP) pursuant to the Huntington Beach Zoning and Subdivision
Ordinance (HBZSO) Section 236.06, Alterations to a Nonconforming Structure or Use.
Pursuant to Section 236.06B.2.a. - c., you may add up to 10% of the existing area of the
structures on the property provided the addition complies with the applicable development
standards of the RM zoning district. The development standards are contained within the
HBZSO, which can be viewed and downloaded from the City website at
http://www.huntingtonbeachca.gov/files/users/city_clerk/chp210.pdf. Additionally, the
Administrative Permit process requires Neighborhood Notification, which entails a 10-day
notification period to all property owners and occupants within a 300-foot radius of the property.
It should be noted that the Administrative Permit process generally takes four to six weeks to
complete. For your convenience, I have enclosed a copy of Chapter 236 of the HBZSO along
with an application for an Administrative Permit including fee and neighborhood notification
information.

236.02 General Provisions
A. A nonconforming structure or use shall not be enlarged, increased or intensified
except as provided in this chapter. If any such use ceases, the subsequent use of
such land, structure or building site shall be in conformance with the regulations
specified by this code. (3254-10/94)
B. A nonconforming use shall not be resumed, reestablished, or reopened after it has
been abandoned, discontinued or changed to a conforming use. (3254-10/94)
C. A nonconforming use shall be deemed to be discontinued or abandoned when
such use has ceased to operate or to exist for a period of six (6) months. (3254-10/94)
D. A nonconforming use which is not housed in any structure, but occupies a lot or
portion of a lot, shall not be enlarged or extended to any other portion of the lot or
any other lot not so occupied at the time the use became classified as
nonconforming. (3254-10194)
E. A nonconforming use occupying either a conforming structure or nonconforming
structure or portion thereof shall not be extended to any portion of the structure
not so occupied at the time the use became nonconforming. (3254-10194)
236.04 Destruction of a Nonconforming Structure or Use
These provisions shall govern reconstruction of the nonconforming structures and/or uses listed
below after such structure or use is destroyed by fire, explosion, act of nature or act of the public
enemy by the percentage of value specified . (3254-10194)
A. Nonconforming structures and nonconforming uses destroyed 50% or less of the
value prior to damage may be completely rebuilt. (3254-10194)
B. Nonconforming residential uses consisting of 10 or less units destroyed more than
50% of the value may be completely rebuilt. (3254-10/94)

C. Nonconforming residential uses consisting of more than 10 units destroyed more
than 50% of the value may be completely rebuilt subject to conditional use permit
approval by the Planning Commission provided current requirements for setback

236.06 Alterations to a Nonconforming Structure or Use
A. Interior alterations and/or repairs may be made which do not enlarge the square
footage or increase the height of a nonconforming use. Reroofing for health and
safety purposes may also be permitted. (3254-10/94)
B. A structure for a nonconforming use shall not be enlarged or altered on the
exterior in any manner unless: (3254-10/94)
1. All aspects of the existing structure and the proposed addition are made to
conform to applicable provisions of this Code, or (3254-10/94)
2. The Director permits such alteration subject to Neighborhood Notification
pursuant to Chapter 241 and the following findings: (3254-10/94,3528A-2102,
3679-12/04)
a. That the alteration is necessary to secure added safety or reduce the
fire hazard or to improve the aesthetic appearance of the structure's
architecture by bringing the design into greater conformance with
the surrounding neighborhood. (3254-10/94)
b. That the alteration or addition will not increase the number of
stories. (325410 194)
c. That the alterations will not cause the floor area to exceed more
than ten (10%) percent of the floor area the structure contained at
the time the use became nonconforming. (3254-10/94)
C. Nonconforming structures may be altered or enlarged provided that the alteration
or enlargement is in conformance with applicable provisions of Titles 21 and 22.

D. Additions to nonconforming structures proposed to be constructed at the existing
nonconforming yard setbacks shall be subject to Director approval and
Neighborhood Notification pursuant to Chapter 241. (3254-10/94,3679-12/04)
E. The area of enlargement to a nonconforming structure in any five year period
shall not exceed 50% of the area of the structure as it exists on the effective date
of this ordinance. (3254-10/94)

236.08 Sex Oriented Businesses
A. Any sex oriented business lawfully operating on the effective date of the
Ordinance No. 3378 that is in violation of Section 212.04 of this Code shall be
deemed a nonconforming use. A nonconforming use will be permitted to
continue for a period of three years with possible one year extensions (maximum
extensions of five (5) years) to be granted by the Planning Commission only upon
a convincing showing by the applicant of extreme financial hardship which is
defined as the recovery of the initial financial investment in the nonconforming
use, unless sooner terminated for any reason or voluntarily discontinued for a
period of thirty (30) days or more. Such nonconforming uses shall not be
increased, enlarged, extended or altered except that the use may be changed to a
conforming use. If two (2) or more sex oriented businesses are within 750 feet of
one another and otherwise in a permissible location, the sex oriented business
which was first established and continually operating at the particular location is
the conforming use and the later established business(es) is nonconforming. (3378-

B. A sex oriented business lawfully operating as conforming use is not rendered a
nonconforming use by the location, subsequent to the grant of a sex oriented
business zoning permit, of a building used for religious assembly, school, park
and recreational facility or any property zoned RL, RM, RMH, RH, RMP, and
any properties with equivalent designations under any specific plan within five
hundred feet (500) of the sex oriented business. (3378-2/98)
C. Any application for a building permit to operate a sex oriented business in a
location that is in violation of Section 212.04 that is filed prior to, but approved
after the effective date of Ordinance No. 3378 shall be deemed a nonconforming
use pursuant to Section A. Any such building permit shall be in effect subject to
the applicable zoning regulations in effect prior to the effective date of Ordinance

Dear Mr. Fauland,
We are contacting you at the direction of your staff, and we would like to request
a Zoning Letter regarding the feasibility of placing another office trailer at an
existing oil separation facility. The facility is operated by DCOR and is located at
4541 Heil Ave in Huntington Beach.
The initial new office trailer specifications are 10' wide by 24'-27' long, and the
height would likely be 15' or lower. We understand from your staff that the parcel
is zoned RM (Residential Medium density), and the trailer placement would meet
all required property line setbacks. The trailer would contain a bathroom and
would be connected to existing sewer. We have the following questions:
• Is this project allowed under the City's Zoning Ordinance?
• What is the Planning permit type and process for the trailer?
• What are the submittal requirements and fees?

This letter is official acknowledgment of your annual operatingqIpermit
fee payment for the Permit (s) to rate listed on the-enclosed '
attachment. A Facility Permit sha l serve as comprehensive-Permit
to Operate for all equipment at a Regional Clean Air Incentives
Market (RECLAIM ) facility.
For the holder- of a Permit to Operate , pursuant to District Rule 203(b),
equipment shall not be operated contrary to the conditions specified in
the permit to operate. A Facility Permit holder shall, -pursuant to
Air Quality Management District (AQMD ) Rule;2004 (f),,at all times
comply with all applicable District rules and shall comply with all
permit conditions as specified in the Facility Permit
You may consider the Permit(i) to Operate listed on the enclosed
attachment renewed; the permit expiration date is stated on-the
attachment . Pursuant to AAQMD Rule 206, a ,person granted a permit under
Rule 202 or 203 shall not operate or use any,•equipment -unless the
entire permit to operate or.a legible facsimile of the entire permit
is affixed upon the equipment in such manner that the permit number,
equipment description, and the specified operating conditions are
clearly visible and accessible. In the event that the-equipment is
so constructed or operated that the - permit to'operate -or a legible
facsimile cannot be so placed , the'entire permit to operate or
the legible facsimile of the entire permit shall be mounted soas to be clearly visible in an accessible place within 8 meters
(26 feet ) of the equipment , or as otherwise approved in writing
by AQMD's zuecutive Officer.

This letter is to notify you that DCOR is proposing to add one 10-foot by 24-foot office
trailer to an existing oil and gas facility located at 4541 Heil Ave, Huntington Beach, CA.
Pursuant to Section 241.24 of the Huntington Beach Zoning and Subdivision Ordinance,
the Neighborhood Notification process is required. You may review the proposed plans
at the Planning Department, 2000 Main Street, Huntington Beach, CA, from September
10, 2012 to September 21, 2012 (10 business days), or contact the Planning
Department at (714) 536-5271. All comments must be submitted to the Planning
Department prior to the expiration date for review of the proposal.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the
action taken by the Director of Planning becomes final, unless appealed. A person
desiring to appeal the decision shall file a written notice of appeal with the Planning
Department within ten calendar days of the date of the Planning Department's action.
The notice of appeal shall include the name and address of the appellant, the decision
being appealed, and the basis for the appeal. A filing fee shall also accompany the
notice of appeal. The appeal fee is $494.00. The appeal period starts at the end of the
10-day review period.
