Dear Ms. Nguyen,
I was just completing the project plans for submittal into the building department and I discovered
that my new 2"dfloor square footage number was incorrect. We of course still need the CDP so I
do not believe it will be an issue but I wanted to let you know since I discovered it.
In my previous application I stated that we were adding 667 square feet of new 2nd floor footage
but it is actually 807 square feet of new area. The 667 square feet was the new livable footage but
did not also include the existing deck being changed to new interior footage.
I am sorry for the discrepancy. The correct footages are the following...
Existing 1St floor is ........................... 3,065.74 s.f.
Existin 2nd floor is 1 325.50 s.f.
Total existing livable footage is ............ 4,391.24 s.f.
Existin ara es 515.82 s.f.
Total Existing structural footage is........... 4,907.06 s.f.

Dear Ms. Nguyen,
I received your notice of filing status letter dated April 11, 2013, and have reviewed it with my
client Mr. Pepe and have corrected the plans as requested for your review at this time. You will
find that I have indicated the new information in a revision cloud with a delta #1 designation.
Here are some responses to your corrections.
Minimum A lication Re uirements
1. Please see attached letter regarding the Administrative Permit request. The additional fees
have been paid at this time.
2. Regarding the new house roof or in this case top of new wall heights, refer to the elevations
for new dimensions relative to the existing top of curb at street. See sheet A-5.
Code Re uirements
1. The front 15 foot setback area across the front width of the lot is 537.32 s.f. Please see the
site plan on sheet A-1 for the 40% minimum (214.92 s.f. ) of landscaped planter area now
indicated on the plan.
2. Please see revised plans that indicate that the new 2nd floor deck area has been removed from its
previous encroachment of about 42" to 36" maximum into the 10 foot rear setback. The new
2d floor deck and the guardrail have been relocated to the allowed 36" maximum
encroachment. The other remaining rear 2nd floor deck that is currently encroaching
approximately 4'-5'/2" into the 10 foot setback is existing. I met with Jennifer in your planning
department on April 18, 2013 who confirmed with me that this existing deck can stay and that
the variance issue was with the new deck encroachment. With the new 2ndfloor deck
relocation , there is no need for a variance at this time.

At this time, I would like to ask for an Administrative Permit review of a new proposed
encroachment we have on this project remodel as follows...
When this home was originally constructed, the entire rear width of the first and second floor
levels was constructed with approximately a 5'/2" encroachment into the 10 foot rear setback. Even
on the right and left sides of the project there are additional encroachments of a few inches as
shown on the revised site plan sheet A-1. Please see new setback lines added to this site plan. Note
that this site plan drawing is actually a survey drawing we had prepared by a licensed surveyor with
some added architectural notes. It is very accurate.
We are proposing that the new 2n'floor exterior wall that is parallel to the rear property line, be
allowed to align with the existing 1" and 2d floor building lines. If this is allowed, this new
exterior wall will be approximately 21'-I" long and about 5'/2" wide as show on sheet A-5 of the
project plans.

This is a written narrative of this project for your reviews and approval.
(a Pro'ect Descri tion
On this project site, there is an existing 2 story single family residence with two separate one car
attached garages. There are two one car garage parking spaces as well as a driveway that can
accommodate an additional 2 cars on site. The site is located in a residential neighborhood on a bay
front location. No new exterior flatwork is proposed at this time as the proposed new 2ndfloor
addition will occur above existing 1St floor areas.
The existing property is an irregular shaped lot with 6,625 square feet.
Existing and new square footages of the home are as follows...

This project approval will not affect the existing site coverage either higher or lower.
Project Setbacks:
Bay Front ........................ 10
Front at Street .................... 15'-0" to house or
20'-0" to garage
If you review the topographic survey, you will see that the existing home was not built parallel to
the side property lines on either side and currently has small encroachments of up to a few inches.
At the bay front setback, the existing home was built within the 10'-0" setback by about 6.5
inches. At this time, the only proposed new construction within any required setback is along the
new rear master bathroom bay front wall that is about 20 feet long and in order to align with the
existing 2ndfloor bayfront walls it will encroach this same approximately 6.5 inches into the 10'-0"
setback. Please see plans for this specific location.
Landscaping - No changes are proposed or required to be made to the existing landscaping.
Hardscaping - No changes are proposed to any existing hardscaped areas.
Color Change - New finished color of the stucco will match the existing color.
New exterior doors and windows shall be white vinyl to match existing.
(b) Reason for initiating his application:
This application is required because the new square footage added exceeds 10% of the existing
structural footage in the home and the two one car garages.
(c) Description of surrounding uses:
Directly to the south of subject site along the rear property line, there is a bay front area with an
existing bulkhead.
Directly to the west and east are single family homes and directly to the north at the street is a
normal residential neighborhood.
(d) Description of population served by the proposed use or project.
There is no public access from the street front to the bay front on this property as there is not on
the adjoining residential properties.
I would like to add some information about the project roof or structure heights.
Maximum existing height of the pyramid skylight structure ridge is approximately 27.46' above
the lowest 9.20 top of curb elevation at the street front or about 27.41' above the I" floor slab at
entry doors.
Maximum new height of addition at new master bathroom will align with other existing roof wall
lines at approximately 22.36' above the same lowest 9.20 top of curb elevation at the street front.
There are also two new chimney caps that will extend an additional code minimum 24" plus 12" for
the cap as shown on the exterior elevations sheet A-6.

than 50% of the value may be completely rebuilt subject to conditional use permit
approval by the Planning Commission provided current requirements for setback

236.06 Alterations to a Nonconforming Structure or Use
A. Interior alterations and/or repairs may be made which do not enlarge the square
footage or increase the height of a nonconforming use. Reroofing for health and
safety purposes may also be permitted. (3254-10/94)
B. A structure for a nonconforming use shall not be enlarged or altered on the
exterior in any manner unless: (3254-10/94)
1. All aspects of the existing structure and the proposed addition are made to
conform to applicable provisions of this Code, or (3254-10/94)
2. The Director permits such alteration subject to Neighborhood Notification
pursuant to Chapter 241 and the following findings: (3254-10/94,3528A-2/02,
3679-12/04)
a. That the alteration is necessary to secure added safety or reduce the
fire hazard or to improve the aesthetic appearance of the structure's
architecture by bringing the design into greater conformance with
the surrounding neighborhood. (3254-10/94)
b. That the alteration or addition will not increase the number of
stories. (3254-10/94)
c. That the alterations will not cause the floor area to exceed more
than ten (10%) percent of the floor area the structure contained at
the time the use became nonconforming. (3254-10/94)
C. Nonconforming structures may be altered or enlarged provided that the alteration
or enlargement is in conformance with applicable provisions of Titles 21 and 22.

D. Additions to nonconforming structures proposed to be constructed at the existing
nonconforming yard setbacks shall be subject to Director approval and
