LOCATION: 8692 Rath Circle, 92646 (west side of Meander Lane at the terminus of Rath Circle) DATE OF ACTION: March 26, 2013 On March 26, 2013, the Planning and Building Department of the City of Huntington Beach took action on your application, and your application was conditionall a roved. Attached to this letter are the conditions of approval for your application. Please be advised that the Department of Planning and Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning and Building is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Planning and Building Department's action. The notice of Administrative Permit No. 13-001 March 26, 2013 Page 2 of 2 appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems themselves aggrieved. The last day for filing an appeal and paying the filing fee for the above noted application is Frida A ril 5 2013 at 5:00 m. The site plan received and dated February 20, 2013, shall be the conceptually approved layout and location of the pool. 2. The amended narrative received and dated February 20, 2013, shall be the approved operation of the home occupation. The swim school shall only operate from the beginning of May through August each year between the hours of 10:00am and 4:10pm, Monday through Friday. 3. The maximum number of students in the swimming pool and instruction area at one time is two (2) and the maximum number of instructors in the pool at one time is two (2), resulting in a maximum total of four (4) people in the pool at any given time. 4. No students or patrons shall be permitted to wait on site prior to his/her scheduled appointment nor remain on site after his/her instruction period. Parents and siblings arriving in the same vehicle with scheduled consecutive or overlapping appointments may be permitted on site during consecutive appointment times and remain until scheduled instruction has completed. 5. Each appointment start time is required to be staggered ten (10) minutes apart. 6. All parking for this home occupation shall be provided within the three (3) car driveway and patrons of the swim school shall not park in any other location. 7. Prior to operation, proof of residency shall be provided to the Planning Division for any instructor(s) who are not the property owner(s) of the swim school site. The proof of residency shall be provided to the Planning Division annually and prior to the swim school's operation each year in the month of April. 8. A review of the use shall be conducted within one year of operation of the swim school by the Huntington Beach Planning and Building Department to verify compliance with all conditions of approval as well as the Huntington Beach Noise Ordinance. At that time the Director may consider modifications to the conditions of approval to address noise issues or any other codes or conditions. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 13-001 shall not become effective until the ten-calendar day appeal period has elapsed and the required conditions of approval have been satisfied. 3. Administrative Permit No. 13-001 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning and Building Department a minimum 30 days prior to the expiration date. 4. The Planning and Building Department reserves the right to revoke Administrative Permit No. 13-001, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. Pursuant to Section 241.24 of the Huntington Beach Zoning & Subdivision Ordinance (HBZSO), Neighborhood Notification is required. Notices were sent to surrounding residences during the City's closure (from December 21 through December 31, 2012), which did not provide sufficient time for public comment and review. This notice is being sent to surrounding residences to offer additional time for public comment and review. You ma review the lans and submit comments between Janua 29 2013 and Februa 12 2013. All comments must be received by the Planning Division by 5:00pm on February 8, 2013. Please be advised that the swim school operation has been amended by the applicant. Amber's Swim School is proposing to operate between the hours of 10:00am and 4:00pm, Monday through Friday during the months of May through August, commencing this year. Each lesson will be twenty (20) minutes long with no more than two (2) students and two (2) instructors in the pool and each lesson time will be staggered ten (10) minutes apart. Parking will be provided for the swim school within the driveway. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the basis for the appeal. A filing fee shall also accompany the notice of appeal.
