Pursuant to Section 214.24 of the Huntington Beach Zoning and Subdivision Ordinance, the Neighborhood Notification process is required. You may review the proposal plans at the Planning Department, 200 Main Street, Huntington Beach, CA for January 21 to February 1 or contact the Planning Department at (714 ) 536-5271 _ All comments must be submitted to the Planning Department prior to the expiration date for review of the proposal. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Director of Planning becomes final, unless appealed. A person desiring to appeal the decision shall file a written notice of appeal with the Planning Department within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the basis for the appeal. A filing fee shall also accompany the notice of appeal. The Homeowners of Marigayle Circle request the City of Huntington Beach vacate the street in which their homes front. Marigayle Circle is a cul-da-sac street, which off-sets across Edwards Avenue from Ellis Avenue. Ellis dead ends at Edwards. Automobiles traveling west on Ellis turn left on Edwards and right on Marigayle, thinking Marigayle is a through street heading to Pacific Coast Highway. After turning on Marigayle, they U-turn in the cul-da-sac to return to Edwards. This undue traffic is a safety concern and a nuisance to Marigayle Circle residents. To eliminate these problems, the Homeowners propose building private security gates across Marigayle. The street would become private with public utility easements once security gates are installed. The gate plan allows for secure entry and emergency egress and for safe turn-out before the gated area. If the City of Huntington Beach approves in concept the gate layout, the Homeowners would proceed with the necessary entitlement processing including General Plan Conformance (CPC). Guest Parking. All guest parking shall be fully accessible. (3334-6/97) 6. Coastal Zone. The following requirements shall apply to residential development in the Coastal Zone: (Resolution No. 2009-36-9/09) 1) Each dwelling unit located in the Coastal Zone shall have a minimum of 2 on-site parking spaces. If the total coastal parking requirements exceed the total minimum parking as required by this chapter, the additional required parking spaces may be in tandem with enclosed spaces, provided the tandem space is assigned to an enclosed space and complies with the required turning radius. (3334-6/97, Resolution No. 2009-36-9/09) 2) The streets of new residential subdivisions between the sea and the first public road shall be constructed and maintained as open to the public for vehicular, bicycle and pedestrian access. General public parking shall be provided on all streets throughout the entire subdivision. Private entrance gates and private streets shall be prohibited. All public entry controls (e.g. gates, gate/guard houses, guards, signage, etc.) and restriction on use by the general public (e.g. preferential parking districts, resident-only parking periods/permits, etc.) associated with any streets or parking areas shall be prohibited. In a planned residential development where a garage is constructed a minimum of 20 feet from the curb, the driveway in front of the garage may be used to provide one of the required uncovered spaces. Privacy gates may be installed without a conditional use permit provided there is compliance with the following criteria prior to the issuance of building permits : (3526-2/02) 1) Fire Department approval for location and emergency entry. (3526-2/02) 2) Public Works Department approval of stacking and location. (3763-3/07) 3) Postmaster approval of location for mail boxes or entry for postal carrier. (3526-2/02, 3763-3/07) 4) Shall provide a driveway with a minimum of twenty (20) feet for vehicle stacking. (3526-2/02, 3677-12 /04, 3763-3/07) 5) No adverse impacts to public coastal access, including changes in the intensity of use of water, or access thereto, shall result from installation of the privacy gates. The air space above all driveways which exceed 150 feet in length shall remain open to the sky, except that eaves or roof overhangs with a maximum 4-foot projection may be permitted above a height of 14 feet.
