The homeowners on Marigayle Circle unanimously agreed to eliminate the intercom control
from the security gate system. The proposed gates (entry and exit) will open automatically as a
vehicle approaches. Thank you for your work on this project.

Process for a General Public Street/Easement Vacation
ollows CA Streets and Hi wa s Code
Applicant files for vacation with the City Engineer and pays initial Public Works (PW)
fees ($3,702 for general street vacation effective 1/20/06).
PW Engineering routes application to other departments for comments.
Comments are received and conveyed to applicant.
Applicant retains licensed engineer/surveyor to prepare a legal description and plat map
for the proposed vacation area.
Applicant submits an application (with application fee of $4,251) to the Planning
Department for determination of General Plan Conformance.
Planning Dept. will assign a planner who will process and schedule the application for
review of General Plan Conformity with the Planning Commission.
Public hearing at Planning Commission for review and action on the General Plan
Conformity.
PW Engineering requests City Attorney to prepare two resolutions: 1) Resolution of
Intent, and 2) Final Resolution.
Upon receipt of the resolutions, PW Engineering prepares two (2) public hearing agenda
items (Requests for Council Action) for City Council adoption of. 1) Resolution of Intent,
and 2) Final Resolution.
Note: The "Final Resolution", which is a public hearing, cannot go to City Council less
than 15 days from the adoption of the "Resolution of Intent".
At least two (2) weeks prior to the public hearing for the Final Resolution, PW
Engineering will post a minimum of three notices of vacation along the street being
vacated. Obtain certified copies from the City Clerk.
File "Affidavit of Posting ". Director of Public Works takes document to City Clerk for
signature.
Process "Final Resolution " to City Council . Upon approval, the City Clerk will record
the document with the County Recorders Office. Vacation is effective immediately upon
recordation.
Other Considerations:
Exempt from vacation any easements and rights necessary to maintain, operate, remove,
replace or renew the public utility facilities

Dear Department of Planning,
We, the entire small eight home Nautical North community located at Marigayle Circle
would like to kindly apply for a permit to construct an entry gate against the entrance to
Marigayle Circle. We have consulted with the departments of planning, public works as
well as the Fire Department, and accordingly developed an architectural drawing for the
construction of such a gate. The plan showing an esthetic rod Iron Gate, planted island,
and turn around is being submitted in conjunction with this letter. This letter is to request
a meeting with the department assistance team on July 26th 2007.
Please note that Marigayle Circle is a dead end court (not a drive through) and houses
only eight homes, and the homeowners are unanimous in desiring to proceed with
constructing a gate as planned. We believe that Marigayle Circle has been treated as a
private street until recently when question of a gate was raised by the home owners.
Some documents in public works department still show it to be a private street. The gate
has been considered by homeowners to increase security as well as safety of children
playing in the outdoors as well as deterring trespassing traffic that use the circle to make
U-turns.
We would like to thank you very much for your attention in this matter and hope to hear
from you in a positive way.

Dear Mr. Talmood:
This letter is provided as a follow-up to the meeting with the Development Assistance
Team (DAT) on Thursday, August 2, 2007. At that meeting you presented a conceptual
plan for the installation of privacy gates at the entrance to Marigayle Circle. To aide with
the streamlining of the internal review process and ensure that the proposed project
complies with all the necessary design standards and code requirements, this letter shall
provide a brief overview of the entitlement process and departmental issues.
Processin Re uirements:
Prior to commencement and processing of the proposal, written authorization
shall be provided to the City disclosing that each property owner has authorized
the processing of each of the required steps for the public street vacation and
privatization of Marigayle Circle and the installation of the privacy gates.
Submittal of a General Public Street/Easement Vacation to the Public Works
Department (Attachment 1) and the submittal of the associated plans, written
narrative and payment of the applicable processing fee. The Public Works
Department shall process the General Plan Conformance (GPC) request to
vacate the public street to the Planning Commission. The Planning Commission
must approve the request and make findings of conformity to the General Plan
for the proposed public street vacation.
After the Planning Commission reviews and approves the General Plan
Conformance, the Public Works Department shall process the request to vacate
the public street to the City Council. The City Council must approve the public
street vacation to move to the next step.
Upon the approval of the GPC and public street vacation, the installation of
privacy gates is subject to review by the City's Design Review Board and an
Administrative Permit for compliance with all the applicable design requirements.
The Planning Department shall process these applications. The submittal
requirements and fees for the applications are attached for your review.
Desi n Standards:
Plannin De artment: The Huntington Beach Zoning and Subdivision
Ordinance (HBZSO) section 231.18, 8. Privacy Gates indicates the criteria for
compliance for installation of privacy gates without the need for a conditional use

permit. It is recommended that the privacy gate design comply with these
minimum requirements as well as the requirements of the other City
departments. Attached please find section 231.18, 8. for your review.
Police De artment: Provide adequate access for emergency police services.
Public Works: Demonstrate adherence with Federal ADA (Americans with
Disabilities Act) requirements for sidewalks and streets widths, adequate
vehicle(s) queuing at the call box, adequate lane widths for ingress and egress,
fulfillment of a Special Utility and Water Utility Easement Agreement, and
establishment of a Home Owners Association for the privatization and
maintenance of a public street.
Fire De artment: Provide adequate access for emergency fire services; street
load capacity for emergency vehicles, and adequate ingress and egress for
emergency vehicles.
Buildin De artment: Demonstrate adherence with Federal ADA requirements.

project and can change based on any unforeseen variations to the development. If you
